RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION
OF AN AGREEMENT BETWEEN SAID CITY AND THE NATIONAL ORANGE SHOW, A
NON-PROFIT ORGANIZATION CONCERNING THE PROVISION OF LAW ENFORCEMENT
AND SECURITY SERVICES AT THE NATIONAL ORANGE SHOW DURING THE 1994
EXPOSITION.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the city of San Bernardino is hereby
authorized and directed to execute, on behalf of the city, an
agreement of the provision of law enforcement and security services
at the National orange Show during its 1994 exposition, which
agreement is attached hereto as Exhibit "A", and is incorporated
herein by reference as though fully set forth at length.
SECTION 2. The authorization to execute the above-referenced
agreement is rescinded if the parties to the agreement fail to
it within sixty
days
of the passage of this

A G R E E MEN T
This AGREEMENT made and entered into this 2..t. -t-Jv day of
~J ' 1994 by and between the NATIONAL ORANGE SHOW, a non-
profit organization, hereinafter called "Orange Show" and the CITY
OF SAN BERNARDINO, a municipal corporation of the state of
California, hereinafter called "City".
WIT N E SSE T H
WHEREAS, Orange Show will present a citrus Fruit Fair and
Exposition for eleven days, from May 12 through May 22, 1994; and
WHEREAS, Orange Show desires that city provide law enforcement
and security for said Fair and Exposition; and
WHEREAS, City is willing to provide said law enforcement and
security,
NOW THEREFORE, the parties hereto agree as follows:
1. The Chief of Police of city shall have the sole and
exclusive responsibility of enforcing San Bernardino city
ordinances, applicable State and Federal laws and regulations, and
all law enforcement related rules and regulations of the orange
Show, on the grounds of the National Show for the entire duration
of the 1994 Annual Exposition from May 12 up to and including
May 22, 1994. The Chief of Police shall furnish and provide such
number of duly authorized and qualified police officers and
reserves dressed in distinctive uniform and undercover officers, as
shall be reasonably necessary for law enforcement purposes to
maintain law and order and prevent breaches of the peace.
2. Orange Show shall adopt and prominently post on all

12 reserve police coverage. The actual number of hours worked may
13 vary due to unforseen events.
14 5. Orange Show agrees to pay individual reserve officers
15 directly in the total amount of no more than $29,145 for police
16 coverage as specified in their operational Plan marked Exhibit "A"
17 and attached hereto.
18 6. Orange Show agrees to pay $43,234 in 1994 to City to
19 offset overtime and administrative costs of regular officers
20 assigned to the Orange Show to maintain law and order and prevent
21 breaches of the peace. The actual number of hours worked may vary
22 due to unforseen events.
23 7. Orange Show agrees to pay 100% of reserve officer's
24 charges and 100% of all regular police overtime charges for all
25 future citrus Fruit Fairs and Expositions.
26 8. There shall be no divided responsibility for law
27 enforcement and all matters of law enforcement shall be under the

entrances its rules and regulations including, but not limited to,
the prohibition of admission of any person wearing gang attire, the
prohibition of possession of any weapons, and notice that those
persons entering orange Show are subject to search for weapons and
contraband.
3. Orange Show and its concessionaires and lessees shall
provide the Chief of Police of the City upon request a roster of
their temporary migrant workers and employees performing services
at the National orange Show during the 1994 Annual Exposition.
4. city agrees that the San Bernardino Police Department
Reserve Officer Unit shall provide approximately 1413 hours of

1 exclusive and unified control of the Chief of Police during the
2 periods of time herein provided for, and all law enforcement
3 personnel shall be deemed to be under the Chief of Police's direct
4 supervision and control and shall not be deemed to be employees of
5 or under the direction or control of the National Orange Show.
6 9. orange Show shall take out and maintain during the life
7 of the agreement such public liability and property damage
8 insurance as shall insure City, i ts elective and appointive boards,
9 commissions, officers, agents and employees from claims for damages
10 for personal injury, including death, as well as from claims for
11 property damage which may arise from Orange Show's or its agents'
12 or lessees' operations hereunder, whether such operations by Orange
13 Show, its agents, concessionaires or lessees or by anyone directly
14 or indirectly employed by Orange Show, its agents, concessionaires,
15 lessees or attendees, and the amounts of such insurance shall be as
16 follows:
17 (al Public Liability Insurance. In an amount not less than
18 $2,000,000 for injuries, including but not limited to, death, to
19 anyone person and, subject to the same limit for each person, in
20 an amount not less than $2,000,000 on account of anyone
21 occurrence;
22 (bl Property Damage Insurance. In an amount of not less than
23 $2,000,000 for damage to the property of each person on account of
24 anyone occurrence.
25 (cl Liability Certificate. The state of California, the
26 National Orange Show, and the city of San Bernardino, their agents,
27 officers, servants and employees shall be made additional insureds,

1 but only insofar as the operations under this contract are
2 concerned. All liability certificates must have 30 (thirty) days
3 cancellation notice.
4 10. Orange Show undertakes and agrees to defend, indemnify
5 and hold harmless the City and its officers, agents and employees
6 from and against all suits and causes of action, claims, cost of
7 litigation, damage or liability of any nature whatsoever, for death
8 or injury to any person, including the employees and agents of
9 Orange Show and its concessionaires and lessees, or damage or
10 destruction to any property of either party hereto or third persons
11 in any manner arising by reason of or incident to the performance
12 of this Agreement.
13 11. Both the city and the National Orange Show agree in the
14 fulfillment of this agreement to not discriminate against any
15 person on the basis of race, creed, color, religion, sex, national
16 origin, age, handicap, or ancestry.

L. Special Promotions
1. Speci a 1 promoti ona 1 events schedul ed pri or to normal openi ng
hours will be staffed with two to four reserves.
II. UNIFORM REQUIREMENTS
Uniform of the day will be Class A Uniform, unless modified by
the Orange Show Commander. Hats and ties are optional.
Utility uniforms are optional during inclement weather.
III. EMERGENCY RESPONSE:
A. In the event that additi ona 1 pol ice response is necessary,
units will meet at Sub #1 and under supervision will be
directed to any location on the Orange Show Grounds as a
unit.
B. In the event uni ts are requested to 1 eave the Orange Show
Grounds, they wi 11 meet at Sub #1 and under supervi si on
depart the to 1 ocati on whi ch was requested by the Watch
Commander.
C. The number of emergency response units will be determined
by the Watch Commander, Orange Show Commander or affected
Area Commander based on the immediate situation.
IV. SUB STATION - STAFFING AND COMMUNICATIONS:
A. Sub Station #1 dispatch will be staffed by a reserve
offi cer or the Reserve Coordi nator duri ng all deployment.
The Reserve Coordinator will staff it on swing shift.
B. Primary communi cati ons wi 11 be operated on Tacti ca 1
Channel Three (Valley Net) under the control of the Sub
Station #1 dispatcher. Communications for emergency or
10-3 situations will be maintained on TAC Three and the
Sub Station #1 dispatch will maintain control of the radio
traffi c unl ess the di spatch center is requested to take
over to coordinate city wide response.
V. REPORTS:
A. Assigned personnel will be responsible for completing
crime and arrest reports for all events occurri ng on the
Orange Show Grounds during assigned day and swing shifts.
B. A 11 reports must be handwritten or di ctated pri or to the
end of the employee's assigned shift. Any additional
overtime needed to complete reports after the end of
the employee' shift wi 11 be charged to the Orange Show
account.

C. Assi stance by on-duty city personnel or speci a 1 i zed units
may be utilized if approved by the Watch Commander.
VI. BOOKING/PRISONER TRANSPORT
A. The arresting officers or a reserve officer team will be
responsible for prisoner transportation, using a marked
police unit assigned to the Orange Show.
B. Any transportation of prisoners by police personnel not
assi gned to the Orange Show must be approved by the Watch
Commander.
C. Re 1 i ef for regul ar /reserve offi cers who encounter extended
delays at County Hospital for pre-booking jail checks must
be approved by the Watch Commander.
D. All applications for booking and juvenile applications for
petition will be completed by the arresting officer prior
to the pri soner departi ng the Orange Show Grounds, except
when approved by the Orange Show Commander or assi gned
supervisor.
E. Police personnel not working the Orange Show who are
assigned to transport prisoners will enter the Orange Show
off of "E" Street and proceed to Sub Substati on #1 for
transport.
VII. PARKING:
A. All emergency vehicles will be parked in the parking
spaces provided north of Sub Station #1.
B. Private vehicles for regular officers will remain at the
Pol i ce Department and transportati on back and forth wi 11
be provided by marked police vehicles assigned to the
Orange Show.
C. Parking for private vehicles for reserve officers will be
provided for and accessible via gate #1 by showing proper
identification.
VIII. BRIEFING:
A. Briefing for day and swied by on-duty reserves or the
supervisor.

X. NECESSARY EQUIPMENT:
A. The following equipment will be needed:
1. Three marked police units on swing shift, one
on day shift and promotional events.
2. Sufficient H.T. 's and chargers.
3. A base radio console with all police frequencies.
4. Sufficient seating for personnel and prisoners at Sub
Station #1.
5. Prisoner hobbles.
6. Bull Horn.
7. Report forms.
8. Extra flashlight batteries.
g. Two Ci ty Centrex telephone instruments and two
extension phone numbers (384-5787 and 384-5788).
10. Taser - maintained at Sub Station #1.
11. Fl ex cuffs.
12. Slim jims.
B. Regular officers will use a separate H.T. log to sign out
H.T. units prior to transport to the Orange Show.
C. Communications will provide and install the base radio
console and will move and install the reserve H.T.
chargers.
D. The City Operator will coordinate the installation of
the City Centrex telephone instruments and two extension
phone numbers (384-5787 and 384-5788).
B. Regular officers will use a separate H.T. log to sign out
H.T. units prior to transport to the Orange Show.
C. Communications will provide and install the base radio
console and will move and install the reserve H.T.
chargers.
D. The City Operator will coordinate the installation of
the City Centrex telephone instruments and the telephone
lines from General Telephone.
XI. VICE/NARCOTICS ENFORCEMENT:
A. All vice/narcotic enforcement, other than routine arrests,
will be conducted by the Vice/Narcotic Detail in either an
on call capacity or assigned by their supervisors.

B. All Vice/Narcotic Officers, M.E.T. Officers and other
on-duty personnel will be required to report to the Orange
Show Commander or Supervisor upon their arrival and
departure from the Orange Show Grounds.
C. Additionally, they will be required to maintain radio
contact with the Sub Station #1 via the Valley Net
frequency or be available on pager.
XII. SPECIAL ENFORCEMENT:
A. The National Orange Show will post in the area of ticket
booths/entry gates si gns i ndi cati ng Orange Show rul es and
prohi bi ti ng gang atti re and weapons. Orange Show
personnel wi 11 be trai ned in i dentifyi ng gang attire and
will enforce these rules at the entry gate with the
assistance of Inland City Security, at their request.
B. Police personnel will enforce all local, state and federal
laws and make arrests when appropriate on Orange Show
Grounds.
C. The Orange Show Commander or Supervisor may deploy special
enforcement teams to address identified problems.
