SECTION 1. J. H. Rentals, Inc. is the lowest responsible
bidder
for: Widening the east side 0= Waterman Avenue, from
Sixth Street to Ninth Street, per Plan No. 9047. A contract is
awarded accordingly to said bidder for the total amount of
$117,260.81, but such award shall be effective only upon the
contract being fully executed by both parties. All other bids,
therefore, are hereby rej ected.
The Mayor is hereby authorized
and directed to execute said contract on behalf of the City; a
copy of the contract is on file in the office of the City Clerk
and incorporated herein by reference as fully as though set forth
at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
or waivers
modifications

agreements,
are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3.
This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.

NOTICE INVITING BIDS
NOTICE IS HEREBY GIVEN that the City of San Bernardi no will
receive bids or proposals for:
WIDENING OF WATERMAN AVENUE EAST SIDE
BETWEEN
SIXTH STREET AND NINTH STREET (STREET IMPROVEMENTS)
in accordance with Special provisions No. 9047 on file in
the Office of the City Engineer, 3rd Floor, San Bernardino City
Ha 11 .
Deliver all bids to the City Engineer's Office, 3rd floor, City
Hall, 300 North "D" Street, San Bernardino, California, with
the Specification title and number clearly marked on the
outside of the envelope.
Sa i d bi ds or proposa 1 s wi 11 be recei ved up to the hour of 2: 00
p.m., on March 29 , 1994, at which time all of said bids
or proposals wl11 be publicly opened, examined and declared in
the City Engineer's Conference Room, third floor, City Hall.
No bid will be received unless it is made on a proposal form
furnished by the City. All bids or proposals shall be signed,
sealed and accompanied by cash, cashier's check, certified
check or bid bond made payable to the City of San Bernardino,
in the amount of ten percent (10%) of the bi d. Such cash,
check or bond shall be given as a guarantee that the bidder
will enter into the contract if awarded to him. In the event
the bi dder refuses to execute said contract, the use by the
public of the improvements will be delayed, and the public will
suffer great damage. From the nature of the case, it would be
extremely difficult and impractical to fix said amount of
damages. Therefore, the Ci ty and the bi dder agree that the
above sum of 10% shall be paid to the City upon the condition
above set forth as liquidated damages and not as a forfeiture.
All bonds furnished pursuant to this notice must be
underwritten by a surety cOmpany having a rating in Best's most
recent Insurance Guide of "A" or better.

Pursuant to 1 aw, the Mayor and Common Council of the City of
San Bernardino, by Resolution No. 90-358 and any and all
amendments thereto which are hereby referred to and made a part
thereof by references as fully as though set forth at 1 ength
herein, have ascertained and determined the general prevailing
rate of per diem wages, and of per diem wages for legal
holidays and overtime work for each craft or type of workman
needed in the execution of contracts under jurisdiction of said
Mayor and Common Council.
Said prevailing rates of wages shall conform to "General
Prevailing Wage Determination made by the Director of
Industrial Relations", filed in the Office of the City Clerk,
which are made a part of said Resolution No. 90-358 and
amendments thereto.
The Contractor may substitute securities for any monies
withheld by the Agency to ensure performance under the contract
as provided for in Section 22300 of the California Government
Code and Section 10263 of the California Public Contract Code.
It shall be mandatory upon the Contractor to whom the contract
is awarded and upon any sub-contractor under him to pay not
less than said specified rates to all laborers, workmen, and
mechani cs employed by them in the exec uti on of the contract,
and to prevent discrimination in the employment of persons
because of race, creed, color, or national origin, as set forth
in the provisions of Resolution No. 7414 of the Mayor and
Common Council of the City of San Bernardino.
The Contractor shall possess a Class "A" License or Class
"C-12" License at the ti me the contract 1 s awarded. The
Specifications do require the prime Contractor to complete a
minimum of 50% of all work with his own forces.
A Pre-Bid Meeting will be held on March 16. 1994 ,
1994, at 1:00 p.m., at the office of the Dlrector of PubllC
Works/City Engineer, City Hall, Third Floor, 300 North "D"
Street, San Bernardino, CA 92418. This meeting is to inform
MBEs/WBEs of subcontracting and material supply opportunities.
Bidder's attendance at this meeting is a prerequisite for
demonstrating a good faith effort to obtain the goals for
MBE/WBE parti ci pati on; however. if the MBE/WBE goal is met or
MBE/WBE participation is obtained, attendance is not required.
The City of San Bernardino reserves the right to
all bids. No bidder may withdraw his bid within
days from the date of the bid opening.

words shall prevail.

hereinabove described shall be commenced within 10 days
from the date of the "Notice to Proceed", and shall be
completed within 45 working days from the date of said
notice.

SECTION 2
2-1 PROPOSAL REQUIREMENTS AND CONDITIONS
2-1.01 GENERAL -- Bi ds must be submi tted on the proposal
form contained herein. All bids or proposals shall be signed,
sealed and accompanied by cash, cashier's check or bid bond made
payable to the City of San Bernardino, in the amount of ten
percent (10%) of the bid. Such cash, check or bond shall be
given as a guarantee that the bidder will enter into the
contract, if awarded to him. In the event the bidder, to whom
the contract is awarded, refuses to execute said contract, the
use by the public of the improvements will be delayed and the
public will suffer great damage. From the nature of the case, it
would be extremely difficult and impractical to fix said amount
of damage. Therefore, the City and the bidder agree that the
proposal guarantee of 10% of the bid shall be paid to the City
upon the conditions set forth above as liquidated damages and not
as a forfei ture. Bi d bonds shall be underwri tten by a surety
company having a rating in Best's most recent Insurance Guide of
"A" or better.
2-1.02 MINORITY AND WOMEN'S BUSINESS ENTERPRISES -- A
policy for establishing goals for participation of Minorlty and
Women's Business Enterprises (MBE/WBE) was adopted by Resolution
No. 93-411 of the Mayor and Common Counci 1 of the Ci ty of San
Bernardino, on 11-1-93. A Standard Operating Procedures Manual
(SOP) has been developed to implement this policy and is
available for review at the Department of Public Works.
The adopted pol i cy establ i shes an annual aggregate goal of
15% participation by Minority Business Enterprises (MBE) and 5%
participation by Women's Business Enterprises (WBE) for public
works contracts. In order to achieve compliance with this
policy, the following goals have been established for this
project.

have been certified by the California Department of
Transportation. in accordance with Section 2054 of the Public
Contract Code. prior to the bid opening. Only those firms that
are certified by Caltrans will be counted toward meeting the
establ i shed goal.
Any bid that fails to meet the established goals for this
project will be considered as non-responsive, unless a waiver is
approved - based upon a finding that a good faith effort was made
to meet the goal s. A "Good Faith Effort Affi davit" may be
submitted by any of the three (3) low bidders. along with the
forms demonstrating the effort of participation by MBE/WBE.
It is incumbent on any such bi dder to submit suffi ci ent
documentation to provie that a good faith effort was made to meet
the established goals. Documentation shall include the items
listed in Section II. B(2) of the SOP.

SECTION 3
3-1 AWARD AND EXECUTION OF CONTRACT
3-1.01 GENERAL -- Award of the contract will normally be
made by the Mayor and Common Council at the subsequent Council
Meeting after opening of the bids. The bidder, to whom the
contract is awarded, shall file with the Engineer all required
bonds and insurance policies, and execute the contract, within 10
calendar days after receiving notification of the award. Failure
to file the stipulated documents and execute the contract within
the prescribed time shall constitute good and sufficient grounds
for rescission of the award and payment of 10% of the bid to the
City as liquidated damages.

4-1 CONSTRUCTION SCHEDULE AND COMMENCEMENT OF WORK,
TIME OF COMPLETION AND LIQUIDATED DAMAGES
4-1.01 Attention is directed to the provisions in
Section 6-1, "Construction Schedule and Commencement of Work",
in Section 6-7.1, "Time of Completion", and in Section 6-9,
"Liquidated Damages", of the Standard Specifications and these
Special Provisions.

SECTION 5
5-1 LEGAL REQUIREMENTS
5-1.01 LIABILITY INSURANCE The Contractor's attention
is directed to Section 7-3, "Liability Insurance", of the
Standard Specifications, providing that the Contractor shall
furnish the City with a policy or certificate of liability
insurance as prescribed therein, prior to execution of the
contract.
5-1.02 WORKMEN'S COMPENSATION INSURANCE -- The Contractor's
attention is directed to Section 7-4, "Workmen's Compensation
Insurance", of the Standard Specifications, providing that the
Contractor shall file a signed certification Certificate of
Workmen's Compensati on Insurance before exec uti on of the
contract.
5-1.03 PAYMENT OF PREVAILING WAGE RATE -- The Contractor
and all subcontractors shall pay each craft or workman employed
on this project not less than the prevailing wage rates specified
in Resolution No. 90-358 of the Mayor and Common Council of the
City of San Bernardino. The Engineer shall have the right to
interview any craft or workman on the project site in order to
verify payment of prevailing wage rates in accordance with
Resolution No. 90-358. Prevailing wage shall comply with current
rates and all updates.
5-1.04 PAYROLL RECORDS -- The Contractor's attention is
directed to the following provisions of Labor Code Section 1776
(Stats. 1978, Ch. 1249). The Contractor shall be responsible for
the compliance with these provisions by his subcontractors.
(a) The Contractor and all subcontractors shall keep an
accurate payroll record, showing the name, address, social
security number, work classification, straight time, and overtime
hours worked each day and week, and the actual per deim wages
paid to each journeyman. apprentice, worker, or other employee
employed by him or her in connection with the public work.
(b) The payroll records enumerated under subdivision (al
shall be certified and shall be available for inspection at all
reasonable hours at the principal office of the Contractor on the
following basis:
(1) A certi fi ed copy of an employee's payroll record
shall be made available for inspection or furnished to such
employee or his or her authorized representative on request.

(c) Each Contractor shall file a certified copy of the
records enumerated in subdivision (a) with the Engineer on a
weekly basis. It will be the Contractor's responsibility to
submit the records enumerated in subdivision (al for all of his
subcontractors, in addition to his own employees. Failure to
submit the records enumerated in subdivision (a) on a timely
basis shall constitute good and sufficient reason for withholding
the partial payments for work accomplished.

SECTION 6
6-1 GENERAL
6-1.01 INCREASED OR DECREASED QUANTITIES -- If the total
pay quantity of any item of work, subJect to the provisions in
Section 3-2.2.1, "Increased or Decreased Quantities", of the
Standard Specifications varies by more than 25 percent,
compensation payable to the Contractor will be determined in
accordance with said Section 3-2.2.1 and these Special
Provisions.
When the compensation payable for the number of units of an
item of work performed in excess of 125 percent of the Engineer's
Estimate is less than $1,500 at the applicable contract unit
price, the Engineer reserves the right to make no adjustment in
said price if he so elects, except that an adjustment will be
made if requested in writing by the Contractor. Such
Contractor's request shall be accomplished by adequate, detailed
data to support costs of the item.
Should the total pay quantity of any item of work required
under the contract be 1 ess than 75% of the Engi neer' s Estimate,
therefore, the Engineer reserves the right to make no adjustment
in said price if he so elects, except that an adjustment will be
made if requested in wri ti ng by the Contractor. Such
Contractor's request shall be accompanied by adequate, detailed
data to support costs of the item.
The payment for the total pay quantity of such item of work
wi 11 in no case exceed the payment whi ch woul d be made for the
performance of 75 percent of the Engineer's Estimate of the
quantity at the original contract unit price.
6-1.02 SOUND CONTROL REQUIREMENTS -- Sound control shall
comply with Chapter 8.54 of the City of San Bernardino Municipal
Code and these Special Provisions.
The noise level from the Contractor's operations, between
the hours of 9:00 p.m. and 6:00 a.m., shall not exceed 86 dbA at
a distance of 50 feet. This requirement in no way relieves the
Contractor from responsibility for complying with local
ordinances regulating noise level.
Said noise 'level requirements shall apply to all equipment
on the jOb or related to the job, including but not limited to
trucks, transit mixers or transient equipment that mayor may not
be owned by the Contractor. The use of loud sound signals shall
be avoi ded in favor of 1 i ght warni ngs except those requi red by
safety laws for the protection of personnel.

6-1.03 PERMITS AND LICENSE -- The Contractor shall obtain a
City Business Registration, prior to execution of the contract.
6-1.04 EXTRA WORK -- Any extra work done shall conform to
the provisions of Section 3.3, "Extra Work", of the Standard
Specifications, subject to the restrictions of Section 20452 and
20455 of the Publ ic Contract Code. However, equipment rental
rates shall conform to State of Cal i forni a Busi ness and
Transportation Agency, Department of Transportation. Division of
Construction, "LABOR AND EQUIPMENT RENTAL RATES", latest edition,
unless the extra work is done for a negotiated price.
6-1.05 HOURS OF LABOR -- In the event that the Engineer is
requi red by the Contractor ' s operati ons to work more than forty
(40) hours in any given week, or on any "off" Friday, Saturday,
Sunday, or Holiday, in the setting of Lines and Grades or
performing inspections, the Contractor shall pay an amount to the
City equal to one and a half (1 1/2) times the Engineer's normal
wages and fringe benefits. Such amount shall be deducted from
the next following progress payments. The City's normal work
week is 9 hours per day Monday through Thursday, and 8 hours on
Friday with alternate Fridays off. A calendar of City's working
days is provided to the Contractor. The City "off" Friday will
be considered as a working day for the Contractor.
Designated legal holidays are: January 1st, the third
Monday in February, the last Monday in May, July 4th, the first
Monday in September, November 11th, Thanksgiving Day, and
December 25th. When a designated legal holiday falls on a
Sunday, the following Monday shall be a designated legal holiday.
When November 11th falls on a Saturday, the precedi ng Fri day
shall be a designated legal holiday.
6-1.06 PAYMENTS -- Attenti on is di rected to Secti on 9-3,
"Payments", and 9-3.2, "Partial and Final Payment", of the
Standard Specifications and these Special Provisions.
No partial payment will be made for any materials on hand
which are furnished but not incorporated in the work.
The Contractor shall submit "As Built" project drawings to
the Construction Engineer (City) prior to the release of final
payment and/or bonds.
6-1.07 PROJECT APPEARANCE -- The Contractor shall maintain
a neat appearance to the work.

concurrently with its removal. If stockpiling is necessary.

6-1.08 TIME AND LENGTH REQUIREMENTS FOR OPEN TRENCH -- Open
trench, as referred to herein. is defined as all excavations made
for the permanent installations required on the project. which
have not been completely backfilled (including attaining relative

10-1 TRAFFIC
10-1.01 GENERAL -- Attention is directed to Section 7-10,
"Public Convenience and Safety", of the Standard Specifications
for Public Works Construction, 1991 Edition and these Special
Provisions.
Warni ng si gns, 1 i ghts, and devi ces for use in performance
of work upon hi ghways shall conform to the "Manual of Traffic
Controls", 1985 Edition, published by the State of California,
and the "Work Area Traffic Control Handbook", 1985 Edition,
adopted by the City of San Bernardino, California.
The Contractor shall so conduct his operations as to offer
the least possible obstruction and inconvenience to the public.
Convenience access to abutting properties shall be maintained
whenever possible and as directed by the Engineer.
The full width of the traveled way shall be open for use
by public traffic on Saturdays, Sundays, and designated legal
holidays, after 3:00 p.m. on Fridays and the day preceding
designated legal holidays, and when construction operations are
not actively in progress on working days.
Personal vehicles of the Contractor's employees shall not
be parked on the traveled way at any time.
The Contractor shall notify local authorities of his
intent to begin work at least five (5) days before work is
begun. The Contractor shall cooperate with local authorities
relative to handling traffic through the area and shall make
his own arrangements relative to keeping the working area clear
of parked vehicles.
All places of business and residences along the streets
that are within the limits of any work shall be notified by the
Contractor in writing at least five (5) days prior to
commencement of work. This notification shall explain the
sequence of work and indicate any restrictions of access.
Verbal notification shall be given to all places of business
and residences at least 18 hours in advance of commencing work
that will affect' access to and from their properties.
10-1.02 TURN RESTRICTIONS -- The Contractor shall post

10-1.03 PARKING RESTRICTIONS -- Unless otherwise provided
herein, the Contractor may post temporary "NO PARKING" signs
within the area of work as required to facilitate construction
operations, subject to the approval of the Engineer.
10-1.04 TRAFFIC LANES -- Traffic lanes shall have a
minimum width of 10 feet. A minimum width of 2 feet shall be
provi ded adjacent to curbs, posts, and other si mi 1 ar
obstructi ons, and 5 feet shall be provi ded adjacent to any
excavation, unless otherwise authorized by the Engineer.
10-1.05 PUBLIC CONVENIENCE -- During the progress of
work, adequate provisions shall be made by the Contractor to
accommodate the normal vehicular and pedestrian traffic along
streets, roads, and highways, immediately adjacent to or
crossing the work, so as to cause a minimum of inconvenience to
the general public.
The Contractor shall furnish, install, and upon completion
of the work, remove all signs and warning devices required for
directing, protecting, and detouring the public during
construction.
Emergency vehicles shall be permitted access at all times
to any street.
10-1.06 PAYMENT -- Full compensati on for furni shi ng and
installing signs, lights, flares, barricades and other traffic
control devices necessary to expedite passage of public traffic
through the work area shall be considered as included in the
Lump Sum price paid for "Traffic Control", and no additional
compensation will be allowed therefor.
The provisions in this Section may be modified or altered
if, in the opinion of the Engineer, public traffic will be
better served and work expedited. Said modifications or
alterations shall not be adopted until approved in writing by

12-1 UNCLASSIFIED EXCAVATION
12-1.01 GENERAL --Unclassified excavation shall comply to

Earthwork for the channel and debris basin shall be considered
as unclassified excavation.
Unsuitable material shall be removed from the foundation

13-1 ASPHALT CONCRETE
13-1.01 GENERAL -- Asphalt concrete shall comply with the
requirements of Section 206-3, "Asphalt Concrete", and Section
302-5, "Asphalt Concrete Pavement", of the Standard
Specifications and these Special Provisions.
Class and grade of asphalt concrete shall be C2-A-4000.
A soil sterilant and tack coat shall be applied as
directed by the Engineer.
13-1.02 SOIL STERILIZATION -- Soil sterilant shall be
"Poly-Bor-Chlorate" or "Borascu", with colored marker dye,
manufactured by Paci fi c Coast Borax Company or an approved
product of another manufacturer provided they are of
non-flammable type.
After all fi ne gradi ng, checki ng, shapi ng and compacti ng
of the subgrade has been completed, all soil in the areas to
receive bituminous concrete pavements shall be thoroughly
treated with soil sterilant and thoroughly sprinkled to
distribute the chemical through the first two or three inches
of the subgrade.
The Contractor shall provide all necessary protection to
prevent injury to animal or plant life and property occasioned
by the application of the soil sterilant. The Contractor will
be held responsible for all personal injury or property damage
caused by the application of the soil sterilant or the storage
of same.
Soil sterilant shall be applied in accordance with the
manufacturer's recommendations.
The contract unit price paid per ton for aggregate base
shall include full compensation for doing all the work involved
in preparing the subgrade and placing soil sterilant material
as shown on the Plans and as directed by the Engineer and no
additional compensation will be allowed therefor.

himself with copies of these "Orders", "Laws", and

particular importance.
All excavations 5 or more feet in depth shall be braced in
accordance with the requirements of Section 306-1.1.6 of the
Standard Specifications.
The Contractor shall take precautionary measures to
protect, in place, all existing structures and fences during
excavation.
The Contractor shall submit to the Engineer, at least 48
hours in advance of any excavation, a detailed plan Showing
design of shoring, bracing, sloping, or other provisions to be
made for worker protection from the hazard of caving ground
during the excavation. No excavation shall be done until such
plan has been approved in writing by the Engineer, and a permit
has been obtained from the State Division of Industrial Safety
in accordance with the requirements of Section 7-10.4.1 of the
Standard Specifications.

19-1 RESTORATION OF ASPHALT CONCRETE PAVEMENT
19-1.01 GENERAL -- Asphalt concrete shall comply with the
requirements of Section 203-6, "Asphalt Concrete", and Section
302-5, "Asphalt Concrete Pavement", of the Standard
Specifications and these Special Provisions.
19-1.02 TEMPORARY RESURFACING -- Temporary resurfacing
shall comply with the requirements of Sub-Section 306-1.5.1,
"Temporary Resurfacing", of the Standard Specifications and

Temporary resurfacing shall be placed over all backfill in

22-1.01 GENERAL -- The work to be done consists, in
general, of construct' ng Portland Cement Concrete foundations
for street light poles; installing street lighting system;
installing conduit, pull boxes, and conductors to existing
street lighting system, and such other items or details not
mentioned above that are required by the Plans. Relocate

27-1 RELOCATION AND REPLACEMENT OF WATER FACILITIES
27-1.01 GENERAL -- Relocation and replacement of water
facilities shall be ln accordance with the Plans, these Special
Provisions and as directed by the Engineer.
In general, the work includes the following: the
replacing of existing plastic water lines with copper pipes,
relocating the existing water meters, relocating existing fire

b. Boring a New Service Line Under the Pavement:
This method includes jacking sections of rigid
galvanized pipe under road bed and then pulling
new I" service line through with a cable.
This method requires specialized equipment and
shall be in accordance with manufacturer's
procedure. The equipment and procedure shall be
revi ewed and approved by the Water Department's
Engineer prior to the start of construction.
When using either of the above methods, the
Contractor shall remove the existing service line at
the tapping valve and reconnect the new services per
Water Department standard drawings.
27-1.08 EXCAVATION, TRENCHING AND BACKFILL All
excavation, trenching, and backflll shall be ln accordance with
Public Works Standards and shall be inspected by a Public Works
inspection.
28-1.09 PAVEMENT REPLACEMENT When it is necessary to
break pavement 1n order to lay the pipelines shown on the
construction drawings, the existing pavement shall be cut
vertically as nearly as possible to a straight line by a method
approved by the City of San Bernardino Public Works, Department

of Engineering, as shown on the Plans. The pavement so removed
shall be haul ed away and shall be repl aced wi th 1 i ke materi al.
All pavement removal and replacement shall conform to the
standards and specifications of the governing body having
jurisdiction and shall meet with their approval. The
Contractor shall be responsible for removing, disposing of, and
replacing all necessary pavement. All paving shall be
inspected by Public Works. It is understood by Public Works
that all pavement repl aced by thi s constructi on is not the
responsibility of the Water Department.
27-1.10 INSTALLATION -- All foreign matter and dirt shall
be removed from the lnterior of the pipe prior to its
installation. The pipe shall be inspected for defects. Any
defective, damaged, or unsound pipe shall be rejected. The
entire joint including coupling, machined sections of the pipe,
and the rubber gasket or ri ng shall be thoroughly cl eaned at
the time the joint is made. The entire procedure and method of
installation of the pipe and making joint shall be done in a
workmanl i ke manner, and shall be in stri ct accordance with the
pipe manufacturer's direction and recommendations.
All pipe shall be laid according to the size, class,
location and grade shown on the Plan. The faces of all spigot
ends and all shoulders in the hubs or sockets must be true and
brought into firm contact. Rubber ring installation shall be
checked with suitable gages to ensure that they are located in
the proper position relative to the pipe ends.
When pipe laying is not in progress, the unfinished end of
the pipe shall be securely closed with a suitable water-tight
pl ug or cover to prevent the entrance of animal s or forei gn
matter into the line.
The Contractor shall take all necessary care and
precautions to prevent the pipe from floating due to water
entering the trench from any source. The Contractor shall be
responsible for damage caused by floating pipe and shall, at
hi s sol e expense, restore and repl ace the pi pe to its proper
condition, alignment and grade.
Where pipe is laid on a curve or at horizontal or vertical
angles in the trench, the maximum deflection at the joint shall
not exceed sixty (60) percent of the limitations specified by
the pipe manufacturer, and each joint shall be adequately
blocked to take the thrust until properly backfilled.

1. Hauling and Unloading Pipe:
During loading, transportation and unloading, every
precaution shall be taken to prevent injury to the
pipe, its lining and its coating. No pipe shall be
dropped from cars to trucks nor allowed to roll down
skids. Each pipe shall rest upon suitable pads,
strips or blocks during transportation and while
awaiting installation in the field, and shall be
securely wedged or tied in place. Padding shall be
used on all car stakes, skids and other material to
prevent damage of the coati ng duri ng transportati on
and handling.
Where necessary to move the pipe longitudinally along
the trench, it wi 11 be done in such a manner as not
to injure the pipe or its coating. Pipe shall not be
rolled or dragged on the ground.
Where pipe is placed in stock piles, it shall be
neatly piled and blocked with strips between tiers,
and bonded with steel bonding material acceptable to
the Department (to be determined by Engineer based on
type of pipe. length, diameter, number of vertical
rows, and location).
2. Protection of Work and Material:
The Contractor shall at all times take care to
protect and preserve all materials to be used in the
layi ng of the pi pe. The pi pe sha 11 be handl ed in
such a manner as not to injure its shape. All pipe
and materials which, in the opinion of the Water
Department, have been damaged shall be replaced by
the Contractor at his own expense.
The Contractor shall be responsible for the safe
storage of all material furnished by him until it has
been incorporated in the compeleted project. All
material damaged or broken by the Contractor shall be
replaced in exact type and kind by the Contractor at
his expense. All materials received by the
Contractor and not used shall be removed by the
Contractor at his expense.
3. Handling of Pipe and Accessories:
Pipe and accessories shall be loaded at the point of
delivery, hauled to, and distributed at the site of
the project by the Contractor at hi s expense. They
shall at all times be handled with care to avoid

damage. Whether moved by hand, skidways or hoists,
materi al shall not be dropped or bumped agai nst pi pe
or accessori es al ready on the ground or agai nst any
other object on the ground.
Pipe shall be handled in such a manner as to avoid
damage to machined or special ends. When such damage
cannot be repaired to the Water Department's
satisfaction, they shall be replaced by the
Contractor at his expense.
The interior of all pipe and accessories shall be
kept free from dirt and foreign matter at all times.
All pipe, fittings, and accessories shall be
carefully lowered into the trench in a workmanlike
manner, using proper tools and equipment. Under no
circumstances shall pipe or accessories be dropped or
dumped into the trench.
4. Installation of Ductile Iron Pipe:
The ductile iron water mains shall be laid and the
work incidental thereto performed in accordance with
applicable requirements of A.W.W.A. C600 "Standards
for Installation of Cast Iron Water Mains".
All pipe shall be carefully inspected for defects
before installation. Such inspection shall include
light tapping with a hammer while the pipe is
suspended in the air. No pipe or fitting which is
cracked or which shows defects excluded by the
specifications for such fittings shall be used. Any
injuries to the protective coating of the pipe or
fittings shall be carefully repaired by the
Contractor wi th coal tar pi tch varni sh. The pi pes,
valves, and fittings shall be carefully cleaned
immediately before installation. Every open end of a
pipe shall be carefully plugged or capped before
leaving the work.
5. Fire Hydrant Assembly Installation:
Fire hydrants shall be installed by the Contractor at
the locations shown on the accompanying plans and
positioned to provide complete accessibility, and to
minimize the possibility of damage from vehicles or
injury to pedestrians (See attached Appendix of Water
Department Standards). The size and type of hydrant
shall correspond to the designation shown on the
Plans. The entire hydrant assembly shall be plumb.

details shown on the Plans. Service stubs shall be
installed in a like manner and in accordance with
accepted water works standards with a minimum cover
of thirty (30) inches.

All flanged valves and fittings shall be properly
positioned and aligned in the trench in such a manner
as to relieve any stress or strain on the connecting

system resting in its final position and all fittings

pressure on the size of pipe under consideration.
Trust blocks shall be constructed of concrete between
the fitting of pipe and the trench wall. The
concrete shall be pl aced so that it extends to the
trench wall in a manner that enables the entire
bearing area to be in contact with undisturbed
freshly cut material.
Concrete shall be kept behind the bell of the fitting
and shall not be permitted to run against the pipe.
Concrete shall be kept cl ear of all bol ts or fl anged
fittings to enable proper future removal of all such
bolts. (Normally, restraining joint pipe and
fittings are required by the Water Department).
27-1.11 PAYMENT -- The contract unit bid price paid per
each for "Relocate Water Meter", "Relocate Fire Hydrant", and
"Replace Plastic Water Service Lines", shall include full
compensation for furnishing all labor, materials, tools,
equipment, restoration of asphalt pavement, testing and
incidentals necessary to complete the work as shown on the
Plans, as specified in these Special Provisions, and as
directed by the Engineer, and no additional compensation will
be allowed therefor.

1. For and in consideration of the payments and agreements
hereinafter mentioned, to be made and performed by the City, and under the
conditions expressed in the bond as deposited with the City, receipt of
whi ch is hereby acknowl edged, Contractor agrees with the Ci ty, at
Contractor's own proper cost and expense in the Speci a 1 Provi si ons to be
furni shed by the City, necessary to compl ete in good workmanl i ke and
substantial manner the
WIDENING OF WATERMAN AVENUE EAST SIDE
BETWEEN
SIXTH STREET AND NINTH STREET (STREET IMPROVEMENTS)
in strict conformity with Plans and Special Provisions No. 9047 , and
also in accordance with Standard Specifications for Public
Works/Construction, 1991 Edition, City of San Bernardino, Department of
Public Works/Engineerlng Division, on file in the Office of the City
Engi neer, whi ch said Speci al Provi si ons, and Standard Specifi cati ons are
hereby especially referred to and by such reference made a part hereof.
2. Contractor agrees to receive and accept the prices as set forth
in the bi d schedul e as full compensati on for furni shi ng all materi a 1 sand
doing all the work contemplated and embraced in this agreement; also for all
loss or damage arising out of the nature of the work aforesaid or from any
unforeseen difficulties or obstructions which may arise or be encountered in
the prosecution of the work and for all risks of every description connected
wi th the work; a 1 so for all expenses incurred by or inconsequence of the
suspension or discontinuance of work, and for well and faithfully completing
the work and the whole thereof, in the manner and according to the Plans
and Special Provisions, and requirements of the Engineer under them.

hei rs, executors, admi ni strators, and assi gns, and all persons cl aimi ng
under or through them, that there shall be no discrimination against or
segregation of, any person or group of persons on account of race, color,
creed, religion, sex, marital status, national origin, or ancestry in the
sa 1 e, 1 ease, subl ease, transfer, use, occupancy, tenure, subcontractor, or
enjoyment of the premises related to herein, nor shall the Contractor or any
person claiming under or through him or her, establish or permit any such
practice or practices of discrimination or segregation with reference to the
selection, location, number, use or occupancy of tenants, lessees,
subtenants, sub 1 essees, subcontractor, or vendees in the premi ses herei n

3. City hereby promises and agrees with the said Contractor to
employ, and does hereby employ the said Contractor to provide the materials
and to do the work according to the terms and conditions herein contained
and referred to, for the pri ces a fore sa i d, and hereby contracts to pay the
same at the time, in the manner, and upon the conditions above set forth;

Performance Bond

1. The Contractor and the Surety, jointly and severally, bind themselves, their heirs, executors, administrators, successors and assigns to the
Owner far the periarmance of the Construction Contract, which is incorporated herein by reference.
2. If the Contractor performs the Construction Contract, the Surety and the Contractor shall have no obligation under this Bond, except to
partIcipate in conferences as provided in Subparagraph 3.1.
3. If there is no Owner Default, the Surety's obligation under this Bond shall arise after:
3.1 The Owner has notified the Contractor and the Surety at its address described In Paragraph 10 below that the Owner is considenng
declanng a Contract Default and has requested and attempted to arrange a conference With the Contractor and the Surety to be held not
later than fifteen days after receipt of such notice to discuss methods of performing the Construction Contract. If the Owner, the Contractor
and the Surety agree, the Contractor shall be allowed a reasonable time to perform the Construction Contract but such an agreement shall
not waive the Owner's nght, if any, subsequently to declare a Contractor Default; and
3.2 The Owner has declared a Contractor Default and formally terminated the Contractor's nght to complete the contract. Such Contractor
Default shall not be declared earlier than twenty days after the Contractor and the Surety have received notice as prOVided in Subparagraph
3.1; and
3.3 The Owner has agreed to pay the Balance of the Contract Pnce to the Surety In accordance With the terms of the Construction Contract
or to a contractor selected to perform the Construction Contract In accordance with tile terms of the contract with the Owner.
4. AHer the Owner has declared Contractor in default and has satisfied the conditions of Paragraph 3, and the Surety has conducted lis OWll
prompt and reasonable Investigation as to whether or not the Contractor's default has actually occurred, the Surety may at Its own option elect
one or more of the following actlons:
4.1 Arrange lor the Contractor, With consent of the Owner, to perform and complete the Construction Contract; or
4.2 Undertake to perform and complete the Construction Contract itself, through its agents or through independent contractors; or
4.3 Obtain bids or nagobated proposals Irom qualified contractors acceptable to the Owner for a contract for performance and completion 01
the Construction Contract, arrange for a contract to be prepared for execution by the Owner and the Contractor selected with the Owner's
concurrence, to be secured with performance and payment bonds executed by a qualifIed surety equivalent to the bonds issued on It 10
ConstructIon Contract, and pay to the Owner the amount of damages as described in Paragraph 6 In excess of the Balance of the Contract
Price Incurred by the Owner resulting from the Contractor's default; or
4.4 Waive its right to perform and complete, arrange for complebon, or obtain a new contractor and with reasonable promptness under the
circumstances:
.1 After investigation, determine the amount for which it may be liable to the Owner and as soon as practicable after the amount IS
determined, tender payment therefor to the Owner; or
.2 Deny liability in whole or in part and notify the Owner citing reasons therefore.
5. If the Surety proceeds as provided In Subparagraph 4.4, and the Owner refuses the payment tendered or the Surety has denied liability, in
whole or in part, without further notice the Owner shall be entitled to enforce any remedy available to the Owner.
6. After the Owner has terminated the Contractor's right to complete the Construction Contract, and if the Surety elects to act under
Subparagraph 4.1, 4.2, or 4.3 above, then the responslbilites of the Surety to the Owner shall not be greater than those of the Contractor under
the Construction Contract, and the responsibilities of the Owner to the Surety shall not be greater than those of the Owner under the
Construcllon Contract. To the limit of the amount of thiS Bond, but subject to commitment by the Owner of the Balance of the Contract Pnce to
mitigation of costs and damages on the Construction Contract, the Surety is obligated WithOut duplication for:
6.1 The responSibilities of the Contractor for correction of defective work and completion of the Construction Contract; and
6.2 Liquidated damages. or if no liquidated damages are specified In the Construction Contract, actual damages caused by delayed
performance or non-performance of the Contractor.
7. The Surety shall not be liable to the Owner or oUlers for obligations of the Contractor that are unrelated to the Construction Contract, and the
Balance of the Contract Price shall not be reduced or set off on account of any such unrelated obhgations. No right of action shall accrue on this
Bond to any person or entity other than the Owner or its heirs, executors, administrators or successors.
8. The Surety hereby waives notice of any change, including changes of time, to the Construction Contract or to related subcontracts, purchaso
orders and other obligallons.
9. Any proceeding, legal or eqUitable, under this Bond may be instituted In any court of competent junschction in the location in whIch the work or
part of the work is located and shall be Instituted within six months after Contractor Default or within six months after the Contractor ceased
working or within six months after the Surety refused or falls to perform its obligations under this Bond, whichever occurs first. If the provisions 01
this Paragraph are void or prohibited by law, the minimum penod of Ilmltatlon available to sureties as a defense in the junsdictlon of the SUIt shall
be applicable.
10. Notice to the Surety, the Owner or the Contractor shall be mailed or delivered to the address shown on the signature page.
11. When this Bond has been furnished to comply with a statutory or other legal requirement in the location where the construction was to be
performed. any proviSion In thiS Bond conflicting With said statutory or other legal reqUIrement shall be deemed Incorporated herein.
12. DEFINITIONS
12.1 Balance of the Contract Price: The total amount payable by the Owner to the Contractor under the Construction Contract after all
proper adjustments have been made, includIng allowance to the Contractor of any amounts received or to be received by the Owner in
settlement 01 insurance or other claims for damages to which the Contractor IS entitled, or reduced by all valid and proper payments made to
or on behalf of the Contractor under the Constructlon Contract.
12.2 Construction Contract: The agreement between the Owner and the Contractor identified on the signature page, including all Contract
Documents and changes thereto.
12.3 Contractor Default: Failure of the Contractor, which has neither been remedIed nor waived. to perform or othelWlse to comply willl the
terms of the Construction Contract.
12.4 Owner Default: Failure of the Owner, which has neither been remedIed nor waived, to pay the Contractor as required by the
Construction Contract or to perform and complete or comply WIth the other terms hereof.

1. The Contractor and the s~e4; jOintlP~ severally, bind themselves, their heirs. executors. administrators, successors and assIgns to the
Owner to pay for labor, materials and equipment furnished for use in the performance of the Construction Contract, which is incorporated herein
by reference.
2. With respect to the Owner. this obligation shall be null and void if the Contractor:
2.1 Promptly makes payment, directly or indirectly, for all sums due Claimants, and
2.2 Defends, indemnifies and holds harmless the Owner from all claims, demands, liens or suits by any person or entity whose labor,
matenals or equipment were furnished for use in the performance of the Construction Contract, provided the Owner has promptly notified the
Contraclor and the Surety (at the address described in Paragraph 11) of any claims, demands, liens or suits and tendered defense of such
claims, demands, liens or suilS to the Contractor and the Surety and provided there is no Owner Default.
3. With respect to Claimants, this obligation shall be null and void if the Contractor promptly makes payment, directly or indirectly, for all sums
due.
4. The Surety shall have no obligatIon to Claimants under this Bond until:
4.1 Claimants who are employed by or have a direct contract with the Contractor have given notice to the Surety at P.O. Box 4500,
Woodland Hills, Callforrlla 91365-4500 and sent a copy, or notice thereof, to the Owner, stating that a claim is being made under !tus Bonu
and, with substantial accuracy, the amount of the claim.
4.2 Clalfnants who do not have a dIrect contract with the Contractor:
.1 Have furnished written nOllce to the Contractor and sent a copy, or notice thereof, to the Owner, WIthin 90 days after haVing last
performed labor or last furmshed malerials or equipment included lrl the cl81ms stating, with substantial accuracy, the amount of the
claim and the name of the party to whom the materials were furnished or supptied or for whom the labor was done or performed;
and
.2 Have either received a rejection in whole or in part from the Contractor, or not received within 30 days of furnishing the above
notice any communication from the Contractor by which the Contractor has indicated the claim will be paid directly or Indirectly;
and
.3 Not having been paid Within the above 30 days, have sent a written notice to the Surety at P.O. Box 4500, Woodland Hills,
CalifornIa 91365-4500 and sent a copy, or notice thereof, to the Owner, stating that a claim is being made under this Bond and
enclosing a copy of the prevIous written notice furnished to the Contractor.
5. II a notice required by Paragraph 4 is given by the Owner to the Contractor or to the Surety, that IS sufficient compliance.
6. The Surety's total obligation shall not exceed the amount of this Bond, and the amount of this Bond shall be credited for any payments made
In good faith by the Surety.
7. Amounts owed by the Owner to the Contractor under the Construction Contract shalf be used for the performance of the Construcllofl
Contract and to satisfy clmms, If any, under any Construction Performance Bond_ By the Contractor furnishing and the Owner accepting lhlt;
Bond, they agree that aU funds earned by the Contractor in the performance of the Construction Contract are dedicated to satisfy obligallons of
the Conlractor and lhe Surety under thiS Bond, subject to the Owner's priority to use the funds for the compfetion of the work.
8. The Surety shall not be liable to the Owner, Claimants or others for obligations of the Contractor that are unrelated to the Construc!lon
Contract. The Owner shall not be liable to make payments to, give notices on behalf of, or otherwise have obligations to Claimants under thiS
Bond.
9. The Surety hereby waives notice of any change, including changes of lime, 10 the Construction Contract or to related subcontracts, purchase
orders and other obligalJons.
10. No suit or action shall be commenced by a Claimant under this Bond other than in a court of competent jurisdiction in the location in whIch
the work or part of the work is located or after the expiratlon of six months from the date (1) on which the claimant gave the notice required by
Paragraph 4.1 or Clause 4.2.3 or (2) on which the last labor or service was performed by anyone or the last materials or eqUIpment were
~urnlshed by anyone under the Construction Contract, whichever of (1) or (2) first occurs. If the provisions of this Paragraph are void or
prohibited by law, the mInimum period of limitation available to sureties as a defense in the jurisdiction of the suit shall be applicable.
11. Notice to the Surety, the Owner or the Contractor shall be mailed or delivered to the address specified or shown on the signature page.
Actual receipt of notice by Surety, the Owner or the Contractor, however accomplished, shall be sufficient compliance as of the date received al
the address shown on the signature page.
12. When this Bond has been furnished to comply With a statutory or other legal requirement in the location where the construction was to be
performed, any proVision in this Bond conflictlng with said stalutory or legal requirement shall be deemed deleted herefrom and proVisions
conforming to such statutory or other legal requirement shall be deemed incorporated herein.
13. Upon request by any person or entity appearing to be a potential, beneficiary of this Bond, the Contractor shall promptly furnish a copy of
this Bond or shall permit a copy to be made.
14. DEFINITIONS
14.1 Claimant: An indiVidual or entity havlOg a direct contract with the Contractor or with a subcontractor of the Contractor to furnish labor,
materials or equipment for use in the performance of the Contract The intent of this Bond shall be to include Without limitation in the terms
"labor, materials or equipment" that part of water, gas, power, light, heat, oil, gasoline, telephone service or rental equipment used In the
Construction Contract, architectural and engineering services required for performance of the work of the Contractor and the Contractor's
subcontractors, and all other Items for which a mechanic's hen may be asserted in the jurisdiction where the labor, materials or equipment
were furnished.
14.2 Construction Contract: The agreement between the Owner and the Contractor identified on the signature page:, including all Contract
Documents and changes thereto.
14.3 Owner Default: Failure of the Owner, which has neither been remedIed nor Waived, to pay the Contractor as required by the
Constructlon Contract or to perform and complete or comply with the other terms thereof.
