RESOLUTION NO. 95-405
RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE
3 DESTRUCTION OF CERTAIN OBSOLETE RECORDS BY THE SAN BERNARDINO
POLICE DEPARTMENT.
WHEREAS the Chief of San Bernardino Police Department has
submitted a request for authority to destroy obsolete records and;
WHEREAS said request is in accordance with the procedures
and requirements of Sections 34090, 34090.5 and 34090.6 of the
California Government Code; and
NOW, THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
1. Subject to written consent of the City Attorney, as
provided in Sections 34090, 34090.5 and 34090.6 of the Government
Code, the following city records, documents, instruments, books or
papers may be destroyed:
(a) Citizen/personnel complaints dated prior to
January 1, 1990;
(b) Internal investigations dated prior to
January 1, 1990;
( c ) Pol ice canine acti vi ty and bite reports
dated prior to January 1, 1990;
(d)
Employee grievances dated prior to January
1, 1991;
(e) Internal promotional tests and evaluations
dated prior to January 1, 1986;
(f) All personnel records of former employees
who resigned or were terminated from City

Unless otherwise provided by law, with the approval of the legislative body
by resolution and the written consent of the city attorney the head of a city
department may destroy any city record, document, instrument, book or
paper, under his charge, without making a copy thereof, after the same is no
longer required.
This section does not authorize the destruction of:
(a) Records affecting the title to real property or liens thereon.
(b) Court records.
(c) Records required to be kept by statute.
(d) Records less than two years old.
(e) The minutes, ordinances. or resolutions of the legislative body or of a
city board or commission.
This section shall not be construed as limiting or qualifying in any manner
the authority provided in Section 34090.5 for the destruction of records.

:sNotwithstanding the provisions of Section 34090, the city officer havm,
custody of public records, docunients, instruments, books, and papers, may,
wfihout the approval of the legislative body or the written consent of the city
attorney, cause to be destroyed any or all of such records, documents,
instruments, books, and papers, if all of the following conditions are complied
with:
(a) The record, paper, or document is photographed, microphotographed.
or reproduced on film of a type approved for permanent photographic
records by the National Bureau of Standards.
(b) The device used to reproduce such record, paper, or document on film
is one which accurately and legibly reproduces the original thereof in all
details.
(c) The photographs, microphotographs, or other reproductions on film are
made as accessible for public reference as the book records were.
(d) A true copy of archival quality of such film reproductions shall be kept
in a safe and separate place for security purposes.
Provided, however, that no page of any record, paper, or document shall be
destroyed if any such page cannot be reproduced on film with fulllegibiIity.
Every such unreproducible page shall be permanently preserved in a mannft'
that will afford easy reference.

lish a procedure to investigate citizens' com-
plaints against the personnel of such de-
partments, and shall make a written de-
scription of the procedure available to the
public."

Title 3

responsible for the prevention and detection of crime and the general
enforcement"'of the criminal laws of this state, shall obtain the basic
certificate iSSued by the Commission on Peace Officer Standards and
Training witliiD 18 months of his employment in order to continue to
exercise the powers of a peace officer after the expiration of such
lS-month period.

scription of procedure; retention of records
(a) Each department or agency in this state which employs peace
officers shall establish a procedure to investigate citizens' complaints
against the personnel of such departments or agencies, and shall make a
written description of the procedure available to the public.
(b) Complaints and any reports or findings relating thereto shall be
retained for a period of at least five years.
