HomeMy WebLinkAbout1995-402 1 2 3 4 5 6 7 8 9 RESOLUTION NO. 95-402 RESOLUTION OF THE CITY OF SAN BERNARDINO ADOPTING GENERAL PLAN AMENDMENT NO. 95-04 TO THE GENERAL PLAN OF THE CITY OF SAN BERNARDINO. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals (a) WHEREAS, the General Plan for the city of San Bernardino was adopted by the Mayor and Common Council by Resolution No. 89-159 on June 2, 1989. (b) WHEREAS, General Plan Amendment No. 95-04 to the General 10 Plan of the City of San Bernardino was considered by the Planning 11 commission on October 3, 1995, after a noticed public hearing, and 12 the Planning Commission's recommendation of approval has been 13 considered by the Mayor and Common Council. 14 proposal and associated (c) WHEREAS, the amendment 15 development project was reviewed for compliance with the California 16 Environmental Quality Act (CEQA) and based upon the preliminary 17 review, the project was found to be exempt from CEQA pursuant to 18 CEQA Guidelines ~15061(b) (3) which states that the Act applies only 19 to projects that have the potential for causing a significant 20 effect on the environment. 21 (d) WHEREAS, on September 7, 1995, the City'S Environmental 22 Review Committee concurred with the findings of staff's preliminary 23 review for CEQA and recommended that the Planning commission 24 recommend to the Mayor and Common Council that a Notice of 25 Exemption be filed with the San Bernardino County Clerk of the 26 Board if the project is approved. 27 28 e) WHEREAS, the Planning Commission conducted a noticed 1 ,--, i ,,-- 'f') - '10; c-' 1 public hearing on October 3, 1995 in order to receive public 2 testimony and written and oral comments on General Plan Amendment 3 No. 95-04 (a proposal to change the General Plan Land Use 4 Designation from RU-1, Residential Urban, to CG-I, Commercial 5 General on 2.14 acres located on the south side of Highland Avenue, 6 east of Palm and fully reviewed and considered the Planning 7 Division staff report and the recommendation of the Environmental 8 Review Committee. 9 f) WHEREAS, the Mayor and Common Council held a noticed 10 public hearing and fully reviewed and considered proposed General 11 Plan Amendment No. 95-04 and the Planning Commission and 12 Environmental Review Committee recommendations and Planning 13 Division staff Report on November 20, 1995. 14 (g) WHEREAS, the adoption of General Plan Amendment No. 95-04 15 is deemed in the interest of the orderly development of the City 16 and is consistent with the goals, objectives and policies of the 17 existing General Plan. 18 SECTION 2. Environmental Determination 19 NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the Mayor 20 and Common Council that the proposed amendment to the General Plan 21 of the City of San Bernardino is exempt from the California 22 Environmental Quality Act pursuant to the California Environmental 23 Quality Act Guidelines ~15061(b) (3) which states that Act applies 24 only to projects that have the potential for causing a significant 25 effect on the environment and as such, the proposed amendment is 26 hereby ratified, affirmed and adopted. 27 SECTION 3. The proposed amendment is internally consistent with the General Plan in that it will create a commercial area which will provide for the continued use enhancement, and new development of retail, personal service, entertainment, office and related commercial uses along major transportation corridors and intersections to serve the needs of the residents; reinforcing existing commercial corridors and center and establishment new locations as new residential growth occurs and the proposed designation is not in conflict with the goals, objectives and policies of the General Plan. B. The proposed amendment would not be detrimental to the public interest, health, safety, convenience, or welfare of the City in that the immediate area already contains existing commercial uses that would be made conforming and compatible with future commercial development of the site. C. The proposed amendment would not affect the balance of land uses within the City in that the surrounding area is currently zoned commercial. D. The 2.14 acre amendment site is physically suitable for the requested CG-1 land use designation in that the site has provisions for adequate access and utilities and the existing and proposed commercial uses are compatible with adjoining land uses. SECTION 4. Amendment BE IT FURTHER RESOLVED by the Mayor and Common Council that: A. This amendment is designated as General Plan Amendment No. 95-04 and its location is outlined on the map entitled Attachment A and further described in Attachment B, copies of which are attached and incorporated herein by reference. General Plan Amendment No. 95-04 shall become effective immediately upon adoption of this resolution. SECTION 5. Map Notation This resolution and the amendment affected by it shall be noted on such appropriate General Plan maps as have been previously adopted and approved by the Mayor and Common Council and which are on file in the office of the city Clerk. SECTION 6.
