RESOLUTION NO.

2 RESOLUTION OF THE CITY SAN BERNARDINO MAKING APPOINTMENTS IN A
SPECIAL ASSESSMENT DISTRICT

WHEREAS, the COMMON COUNCIL of the CITY OF SAN
5 BERNARDINO, CALIFORNIA, is considering the formation of a
6 special assessment district, pursuant to the terms and
7 provisions of the "Municipal Improvement Act of 1913", being
8 Division 12 of the Streets and Highways Code of the State of
9 California, for the installation of certain public works of
10 improvement, together with appurtenances and appurtenant work,
11 said special assessment district to be known and designated as
12 ASSESSMENT DISTRICT NO. 1015 (NEW PINE AVENUE) (hereinafter
13 referred to as the "Assessment District"); and,

WHEREAS, at this time, this legislative body is
15 desirous of making the required appointments and designating
16 persons to perform certain duties, in order to allow the
17 proceedings to go forward to completion in accordance with the
18 provisions of law.

NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
SECTION 1. That the above recitals are all true and
21 correct.
22 SECTION 2. That the DIRECTOR OF PUBLIC WORKS is hereby
23 appointed to perform all of the duties and functions of the
24 Superintendent of Streets as said duties are specified and
25 designated in the "Municipal Improvement Act of 1913", being
26 Division 12 of the Streets and Highways Code of the State of
27 California, for the above-referenced Assessment District.

3 SECTION 3. That the place for recordation of the
4 assessment roll and diagram shall be in the Office of the
5 Superintendent of streets, and said assessment roll and diagram,
6 upon recordation, shall be kept as a permanent record.
7 SECTION 4. That the SAN BERNARDINO SUN is hereby
8 designated as the newspaper for all publications as required by
9 law and as necessary for completion of this Assessment District.
10 SECTION 5. That GFB-FRIEDRICH & ASSOCIATES, INC. is
11 hereby appointed the Assessment Engineer for said proceedings,
12 and said Assessment Engineer shall perform all of the duties and
13 responsibilities as set forth by law as they relate to said
14 Assessment District.
15 SECTION 6. That BROWN, DIVEN & HENTSCHKE, Attorneys at
16 Law, is hereby appointed to act as Bond Counsel for the purposes
17 of preparing proceedings and issuing an approving opinion
18 attesting to the validity of the proceedings and the
19 enforceability of the bonds.
20 SECTION 7. That this legislative body hereby
21 establishes a special IMPROVEMENT FUND designated by the name
22 and number of the Assessment District, and into said fund shall
23 be placed all proceeds from the sale of bonds and cash
24 collections. In order to expedite the improvements or
25 acquisition under these proceedings and as authorized by law,
26 funds from any available source may be transferred into said
27 special fund. Any funds transferred are a loan to the fund and

3 shall be repaid out of the proceeds of the sale of bonds, or
4 collection of assessments, as authorized by section 10210 of the
5 Streets and Highways Code of the State of California.
6 I HEREBY CERTIFY that the foregoing resolution was
7 adopted by the Mayor and Common Council of the city of San
8 Bernardino at a regular meeting thereof, held on the 16th
9 day of October , 1995, by the following vote, to wit:
