95-332
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO, CALIFORNIA, REGARDING THE USE OF
HOME FUNDS IN CONNECTION WITH THE MODERATE OR
SUBSTANTIAL REHABILITATION OF TROPICANA MOBILE ESTATES
WHEREAS, the City of San Bernardino is a municipal
corporation and charter city (the "City"), duly organized and
existing under and pursuant to the provisions of the Constitution
of the State of California; and
WHEREAS, the City receives certain funds from the
Federal Government for certain housing purposes pursuant to the
HOME Investment Partnerships Program, 24 CFR Part 92 ("HOME
Funds"); and
WHEREAS, the City desires to assist the Redevelopment
Agency of the City of San Bernardino (the "Agency) in the
moderate or substantial rehabilitation of certain mobilehome
parks situated in the City, as defined in United States
Department of Housing and Urban Development form HUD-40094
entitled Homeowner Assistance/Rental Housing Project Set-Up
Report, which includes acquisition, rehabilitation and homeowner
assistance ("Rehabilitation"); and

WHEREAS, certain members of the staff of the City have
recommended the use of HOME Funds for the Rehabilitation of that
certain mobilehome park commonly known as Tropicana Mobile
Estates ("Tropicana"); and
WHEREAS, on April 17, 1995, the Mayor and Common
Council of the City of San Bernardino ("Common Council") duly
adopted that certain Resolution No. 95-119 ("Resolution No. 95-
119") regarding the pledge of certain funds of the City as
security for certain bonds; and
WHEREAS, on June, 5, 1995, the Mayor and Common Council
duly adopted Resolution No. 95-179 superseding Resolution No. 95-
119 to provide for the authorization of the use of HOME Funds to
implement the Rehabilitation of Friendly Village.
WHEREAS, certain members of the staff of the City have
recommended the use of additional HOME Funds for the
Rehabilitation of Tropicana.
NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO, CALIFORNIA, DO HEREBY FIND, RESOLVE,
DETERMINE AND ORDER AS FOLLOWS:

SECTION 1.
Recitals. The Recitals contained herein
are true and correct and are incorporated herein by this
reference.
SECTION 2.
Determinations.
The City finds and
determines that assistance to the Agency for the Rehabilitation
of Friendly Village through the use of HOME Funds benefits the
residents of the City by providing better housing conditions,
alleviating blighting conditions and improving the health, safety
and welfare of the residents of the City.
SECTION 3.
Use of HOME Funds. The
City hereby
authorizes the assistance to the Agency and the use of HOME Funds
by and on behalf of the Agency for the purposes hereinabove set
forth in the sum of fifty thousand dollars ($50,000). The actual
transfer of such funds from the City to the Agency shall be
evidenced in an agreement providing for the grant or loan of such
HOME Funds under such terms and conditions and pursuant to such
instructions as set forth therein to be prepared and executed by
the City and the Agency. Such agreement between the City and the
Agency shall provide for the City's authorization of Economic
Development Agency staff to request draws of HOME Funds and to
execute documents as required on behalf of the City. The City

hereby authorizes the preparation of such agreement and further
authorizes its execution by the Mayor and the City Clerk on
behalf of the City.
SECTION 4.
Limitations on Use of HOME Funds.
Authorization for the Agency's use of HOME Funds in the
Rehabilitation of Tropicana Mobile Estates is limited to
expenditures made in accordance with the provisions of the HOME
Investment Partnerships Program. Said HOME Funds may only be
utilized in a manner consistent with those eligible activities
set forth in 24 CFR Section 92.205 et seq. and may not be used in
furtherance of activities prohibited by 24 CFR Section 92.214.
