DECLARATION OF ENVIRONMENTAL IMPACT AND ADOPTING GENERAL PLAN

BERNARDINO

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
5 SAN BERNARDINO AS FOLLOWS:
6 SECTION 1. Recitals

(a) The General Plan for the City of San Bernardino was
8 adopted by the Mayor and Common Council by Resolution No. 89-159 on
9 June 2, 1989.

(b) General Plan Amendment No. 95-01 to the General Plan of
11 the City of San Bernardino was considered by the Planning
12 commission on June 20, 1995, after a noticed public hearing, and
13 the Planning Commission's recommendation of approval has been
14 considered by the Mayor and Common Council.
15 (c) An Initial Study was prepared on April 20, 1995, and
16 reviewed by the Environmental Review Committee and the Planning
17 commission who both determined that General Plan Amendment No. 95-
18 01 would not have a significant effect on the environment and
19 therefore, recommended that a Negative Declaration be adopted.

(d) The proposed Negative Declaration received a 21 day
public review period from April 27, 1995, through May 18, 1995, and
all comments relative thereto have been reviewed by the Planning
commission and the Mayor and Common Council in compliance with the
California Environmental Quality Act (CEQA) and local regulations.
e) The Mayor and Common Council held a noticed public
hearing and fully reviewed and considered proposed General Plan
27 Amendment No. 95-01 and the Planning Division Staff Report on
28 August 7, 1995.

(f) The adoption of General Plan Amendment No. 95-01 is
deemed in the interest of the orderly development of the City and
is consistent with the goals, objectives and policies of the
existing General Plan.
SECTION 2. Neqative Declaration
NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the
Mayor and Common Council that the proposed amendment to the General
Plan of the City of San Bernardino will have no significant effect
on the environment, and the Negative Declaration heretofore
prepared by the Environmental Review Committee as to the effect of
this proposed amendment is hereby ratified, affirmed and adopted.
SECTION 3. Findinqs
BE IT FURTHER RESOLVED by the Mayor and Common Council of the
City of San Bernardino that:
The proposed CH, Commercial Heavy, land use designation is
internally consistent with General Plan Objective 1.30 in that
it will create a commercial area which will be characterized

by an extensive use of outdoor or indoor space for their
sales, service, and/or storage and ensure compatibility with
adjacent uses and the proposed designation is not in conflict
with the goals, objectives and policies of the General Plan.
The proposed amendment would not be detrimental to the public
interest, health, safety, convenience or welfare of the City
in that the amendment area already contains existing
commercial uses that would be made conforming and compatible
with future commercial development of the site.
The proposed amendment to change the land use designation on
7.2 acres from CN, Commercial Neighborhood CH, Commercial

Heavy, would enhance the balance of land uses in that
existing and proposed development on the site would provide
commercial retail and services for the Baseline corridor.
The 7.2 acre amendment site is physically large enough for
uses permitted in the CH, Commercial Heavy, land use
designation and all parcels have or will have adequate access
to Baseline street.
SECTION 4. Amendment
BE IT FURTHER RESOLVED by the Mayor and Common Council that:
The Land Use Plan of the General Plan of the City of San
Bernardino is amended by changing approximately 7.2 acres from
CN, Commercial Neighborhood, to CH, Commercial Heavy. This
amendment is designated as General Plan Amendment No. 95-01
and its location is outlined on the map entitled Attachment A,
and is more specifically described in the legal description
entitled Attachment B, copies of which are attached and
incorporated herein be reference.
General Plan Amendment No. 95-01 shall become effective
immediately upon adoption of this resolution.
SECTION 5. Map Notation
21 This resolution and the amendment affected by it shall be
22 noted on such appropriate General Plan maps as have been previously
23 adopted and approved by the Mayor and Common Council and which are
24 on file in the office of the city Clerk.
25 SECTION 6. Notice of Determination
26 The Planning Division is hereby directed to file a Notice of
27 Determination with the County Clerk of the County of San Bernardino
28 certifying the city's compliance with California Environmental

REQUEST
The applicant is requesting approval of (1) an amendment to the General Plan Land Use Map
to change the underlying land use district for the 7.2 acre, five parcel subject site from
Commercial Neighborhood (CN) to Commercial Heavy (CH) and (2) a Conditional Use Permit
to locate and operate a recreational vehicle storage facility within the three most western parcels.
As a recreational vehicle storage facility is not permitted within the CN zone, the applicant is
requesting approval of the proposed General Plan Amendment to change the parcels' land use
designations to one which conditionally permits the proposed use.
The subject site consists of five parcels; however, only three of the parcels are proposed to
contain the recreational vehicle storage facility (Assessor's Parcel Numbers 286-163-44,45,46).
The remaining two parcels, Assessor's Parcel Numbers 286-163-39 and 40 (owned by the Beaver
Medical Clinic and Richard and Darlene Chado respectively), will remain undeveloped at this
time. The entire five parcel site is currently vacant, with the exception of a 2,500 square foot
multi-tenant commercial structure containing an existing general merchandise market located in
the southwest portion of the five parcel site (2662 East Baseline). The market occupies
approximately 1,250 square feet with the remainder of the structure vacant.
To the rear and side of this structure, the applicant proposes to operate a facility for the storage
of up to 221 recreational vehicles (on the three westernmost parcels and addressed as 2664 East
Baseline). If approved, no construction would occur other than fencing and surfacing of the
proposed parking area. The ;operations office for the proposed facility would be in a suite
adjacent to the existing market. The office could also potentially function as a security office.
LOCATION
The five parcel site has a frontage of approximately 660 feet on the north side of Baseline Street,
while the three parcels to contain the storage facility have a frontage of approximately 330 feet
, on the north side of Baseline. The site, which is to the immediate west of Victoria Avenue
adjacent to the City of Highland, is not located within any redevelopment areas nor is it within
any special district as identified in the General Plan or Development Code.
The five parcel subject site is 7.2 acres and rectangular-shaped. The immediate area along
Baseline is primarily commercial, with the exception of an apartment complex immediately
adjacent to the site on the west. The area to the north and west of the proposed site is zoned
residential and is within the City of San Bernardino, while the area to the immediate south and
east is zoned commercial and located within the City of Highland.

CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) STATUS
Both the proposed amendment to the General Plan Map and the Conditional Use Permit are
subject to the California Environmental Quality Act (CEQA). An Initial Study was prepared and
reviewed by the City's Environmental Review Committee (ERe) on April 20, 1995 and May
18, 1995. It was determined that the proposals will not have an adverse impact on the physical
environment, and the ERC recommended adoption of the Negative Declarations. The public
review and comment period extended from April 27, 1995, to May 18, 1995. No comments
were received.
DEVELOPMENT CODE AND GENERAL PLAN CONFORMANCE
Should the General Plan Amendment be approved, the Conditional Use Permit request would
be consistent with the General Plan and in conformance with the Development Code as shown
in Attachment C. Specifically, the Conditional Use Permit implements the following General
Plan Objective:
1. Provide for the development of limited commercial and industrial uses characterized by
an extensive use of outdoor or indoor space for their sales, service, and/or storage and
ensure their compatibility with adjacent uses (General Plan Objective 1.30).
ANALYSIS
General Plan Amendment
As a proposal to change the site's land use designation from CN to CH, the project will change
the intensity of the land use as designated in the General Plan. As a result, the uses within the
CH district which are currently not permitted in the CN district will be either permitted or
conditionally permitted as indicated in the City's "Commercial Districts List of Permitted Uses."
Generally, the CH district allows for greater flexibility for locating permitted and conditionally
,permitted uses, with the district intended to accommodate automobile and truck sales and repair
facilities, lumberyards, and related hardware sales, plant nurseries, light industrial manufacturing
and storage facilities, and similar uses requiring extensive outdoor or indoor space for their
sales, service and/or storage. The CN district is intended to provide for the continued use,
expansion, and new development of small scale, low intensity neighborhood commercial uses
which serve and are in proximity to residential neighborhoods throughout the City. As such,
the uses allowed are more limited than those of a CH designation. Although it is a heavy
commercial designation, the CH district includes all of the CN uses except: barber/beauty/nail
shops; dance schools/karate studios; health/athletic clubs; laundromats (self serve); convenience
stores; mini malls; and educational services (except trade tech). Therefore, the change to a CH

zone will increase the opportunity for development while still addressing most every use
currently found in the CN zone.
Although uses not currently permitted in the Commercial Neighborhood land use district will
be either permitted or conditionally permitted in the CH district, the general area surrounding
the project site is such that the project site lends itself well to a commercial heavy designation.
The site is bounded on the north and immediate west by residential land use districts; however,
the larger surrounding area within the City of Highland is already designated commercial.
Currently, on the south side of Baseline across from the project site, there exists higher intensity
commercial uses such as an auto body repair and a fireplace manufacturer. Adjacent to these
uses are a warehouse and thrift store. At the northwest and southeast corners of Baseline and
Victoria are a gas station and an auto repair facility respectively, with an additional auto repair
facility to the immediate east of the five parcel project site.
Therefore, the site is already directly exposed to more intense commercial land uses (or the
potential for commercial land uses) immediately to the east and south. Although an existing
mobile home park lies to the immediate north of the proposed site and an apartment complex
to the immediate west, the change in land use designation should not have a negative impact.
The mobile home park is buffered by a flood control channel under the jurisdiction of the San
Bernardino County Flood Control District and the apartment complex will be buffered from the
proposed use by a six foot wall. Future uses on-site would need individual entitlement and
environmental review and therefore, could be evaluated for their impacts on the adjacent
residential. Given the nature of the area and the fact that Baseline is an arterial better suited for
more intensive uses, staff believes that the proposed General Plan Amendment will further these
Goals and the amendment will be in the best interest of the community.
Conditional Use Permit
The Conditional Use Permit element of this request addresses the proposed recreational vehicle
storage facility locating in the western portion of the proposed site. Operations at the facility
,will be such that an individual can lease a designated space within the lot for the purpose of
storing their recreational vehicles (motor homes, boats, etc.). No repair of the vehicles shall
be permitted on-site.
Design
The proposed R. V. Storage Facility will be a low intensity use which will provide for up to 221
parking spaces on-site (in addition to visitor parking). The design of the facility will be similar
to a parking lot, with the exception that the individual spaces will be longer and that multiple
spaces may be necessary to house individual recreational vehicles. The facility will be

surrounded on all sides by a six foot block wall and landscaping will be provided along Baseline.
Currently, a chain link fence surrounds the site and a sign pole with an empty can exist in front
of the market. Conditions of approval have been made a part of the project which will require
the removal of the chain link fencing and the abandoned non-conforming pole sign. In addition
to securing the vehicles being stored on-site, the wall will also help prevent the dumping of trash
which occurs frequently on-site at present. Adequate lighting shall be provided on-site to the
satisfaction of the Police Department.
The facility has been designed to take into consideration the adjacent apartment complex. As
residential uses are sensitive, the facility shall be open no later than 7:30 p.m. and shall house
only recreational vehicles (e.g. motorhomes, boats, etc.). By limiting the types of vehicles and
hours of operation, noise from the vehicles can be kept to a level which will not exceed the
roadway noise from Baseline. The six foot block wall proposed around the entire facility will
screen the subject site from the adjacent uses. The proposed security lighting shall be installed
to minimize spillover impacts to the adjacent residential uses.
Parking, Circulation, and Access
The proposed recreational vehicle storage facility will provide 221 spaces devoted to vehicle
storage. Additionally, there will be three additional spaces for customers to utilize when visiting
the facility's office. The existing general merchandise market will utilize the same parking lot
area it has traditionally used (directly in front of the structure). The on-site circulation has been
designed to allow recreational vehicles to enter the site from Baseline. Two way circulation
provides access to the facility; 'while 24 foot drive aisles allow six rows of parking stalls for the
R. V. 'So The Public Works Department Traffic Division has reviewed the proposed site plan and
found it to be consistent with City standards.
COMMENTS RECEIVED
Staff has contacted the owners of the two adjacent parcels by registered mail and informed them
, of the intent to change the zoning of the subject property. The two individuals were asked to
contact staff by June 8, 1995, if they had any concerns with the proposal. On June 12, 1995,
staff received a letter of support from the Beaver Medical Clinic (one of the two property
owners within 1he, 7.2 acre site). Staff has attempted to contact the other property owner;
however, their telephone number is unlisted. As they have not indicated opposition to this
proposal as of the drafting of this staff report (June 14, 1995), staff will assume that they have
no concerns with the proposal. Additionally, a letter was received from Roger and Delores
Struxness, who reside within 500 feet of the project site, in support of the proposed conditional
use permit for recreational vehicle storage. The City of Highland has requested that landscaping
be provided along the perimeter wall so as to discourage graffiti. Other than these comments

and those received by the City's D/ERC, which have been incorporated into the conditions of
approval, no comments have been received as of the writing of this staff report.
CONCLUSIONS
General Plan Amendment No. 95-01 is reasonable and in the best interest of the community.
It will expand commercial development opportunity on the 7.2 acres. Further, if the General
Plan Amendment is approved, Conditional Use Permit No. 95-05 will be consistent with the
General Plan. Additionally, there is a proposed Negative Declaration.
RECOMMENDATION
Staff recommends that the Planning Commission:
1. Recommend that the Mayor and Common Council adopt the Negative Declaration;
2. Recommend to the Mayor and Common Council that the applications for GPA 95-01 and
CUP 95-05 be approved.

GENERAL PLAN AMENDMENT FINDINGS OF FACT
1. The proposed amendment is internally consistent with the General Plan in that it provides
for a Commercial Heavy land use district which is more compatible with the existing
land uses surrounding the site.
2. The proposed amendment will not be detrimental to the public interest, health, safety,
convenience, or welfare of the City in that the Commercial Heavy land use designation
will allow the subject site to be more consistent with the surrounding area.
3. The proposed amendment will maintain the appropriate balance of land uses within the
City in that it will allow a greater flexibility of land uses on-site which are more
compatible with the surrounding land uses in the City of Highland.
4. The subject site is physically suitable for the requested land use designation and the
anticipated land use developments in that the subject site is large and vacant. The
amendment will allow for future uses to be located with greater flexibility.

CONDmONAL USE PERMIT FINDINGS OF FACT
1. The proposed use is conditionally pennitted within, and will not impair the integrity and
character of the CH, Commercial Heavy, Land Use District, and complies with all of the
applicable provisions of the Development Code.
2. The proposed use is consistent with the General Plan in that it meets all applicable goals,
objectives and policies that are set forth, and specifically implements Objective 1.30 of
the General Plan.
3. The approval of Conditional Use Permit No. 95-05 is in compliance with the
requirements of the California Environmental Quality Act in that an Initial Study has
been prepared for the proposed project which found that no significant impact will occur.
4. There will be no potentially significant negative impacts upon environmental quality and
the natural resources in that this Initial Study found that no significant impacts will occur
to the environment.
5. The location, size, and operating characteristics of the proposed use are compatible with
the existing uses within the general area in which the proposed use is to be located and
will not create significant noise, traffic or other conditions or situations that may be
objectionable or detrimental to other permitted uses in the vicinity or adverse to the
public interest, health, safety, convenience, or welfare of the City.
6. The subject site is physically suitable for the type and density/intensity of use being
proposed, in that its design, site configuration and use complies with the requirements
of the CH Land Use Bistrict, and there are no physical characteristics or constraints
applicable to the site which would prevent the location of the proposed use on the site.
7. There will be adequate provisions for public access, water, sanitation, and public utilities
and services to ensure that the proposed use would not be detrimental to public health
and safety.

CONDmONS OF APPROVAL'

2. The review authority may, upon application being filed 30 days prior to the expiration
date and for good cause, grant one time extension not to exceed 12 months. The review
authority shall ensure that the project complies with all current Development Code
provisions.
3. In the event that approval of the General Plan Amendment and/or Conditional Use Permit
is legally challenged, the City will promptly notify the applicant of any claim or action
and will cooperate fully in the defense of the matter. Once notified, the applicant agrees
to defend, indemnify, and hold harmless the City, its officers, agents and employees
from any claim, action or proceeding against the City of San Bernardino. The applicant
further agrees to reimburse the City of any costs and attorneys' fees which the City may
be required by a court to pay as a result of such action, but such participation shall not
relieve applicant of his or her obligation under this condition.
4. This permit or approval is subject to all the applicable provisions of the Development
Code in effect at the time of approval. This includes Chapter 19.20 - Property
Development Standards, and includes: dust and dirt control during construction and
grading activities; emission control of fumes, vapors, gases and other forms of air
pollution; glare control; exterior lightning design and control; noise control; odor control;
screening; signs, offcstreet parking and off-street loading; and, vibration control.
Screening and sign regulations compliance are important considerations to the developer
because they will delay the issuance of a Certificate of Occupancy until they are complied
with. Any exterior structural equipment, or utility transformers, boxes, ducts or meter
cabinets shall be architecturally screened by wall or structural element, blending with the
building design and include landscaping when on the ground.
,5. A six foot high block wall shall be constructed as indicated on the project plans. Vines
shall be planted on the exterior sides of the wall so as to reduce potential graffiti.
6. Security lighting shall be installed so as to provide one foot candle of light evenly
distributed 'across the storage lot area. Lighting shall be designed and installed so as to
minimize impact on adjacent residential land uses.

7. All chain link fencing visible from the front of the property shall be removed.
8. The existing freestanding pole sign in front of the general merchandise market shall be
removed.
9. Signage shall be installed on the inside of the block wall which specifies that repair or
maintenance of vehicles (including oil changes) is prohibited as is the dumping,
transportation, or disposal of motor oil or any other hazardous or toxic materials.
10. A trash enclosure shall be provided in the rear corner of the subject site. The design and
location of the enclosure shall meet the requirements of the City's Development Code
and shall be reviewed by Planning and Refuse staff at the time permits are issued.
11. The applicant shall remove the graffiti on the existing market.
12. This permit or approval is subject to the attached conditions or requirements of the

ACCESS:

SITE:
o All access roads and streets are to be constructed and usable prior to combustible construction.
o Private fire hydrants shall be installed to protect each building located more than 150 feet from the curb line. No fire hydrants should be within
40 feet of any exterior wall. The hydrants shall be Wet Barrel type, with one 2'/2 inch and 4 inch outlet, and approved by the Fire Department.
Fire hydrants shall be designated as a "NO PARKING" zone by painting an 8 inch wide, red stripe for 15 feet in each direction in front of the
hydrant in such a manner that it will not be bloeked by parked vehicles.
BUILDINGS:
o Address numerals shall be installed on the building at the front or other approved location in such a manner as to be visible from the frontage
street. Commercial and multi family address numerals shall be 6 inches tall, single family address numerals shall be 4 inches tall. The color
of the numerals shall contrast with the color of the background.
o Identify each gas and electric meter with the number of the unit it serves.
o Fire Extinguishers must be installed prior to the building being occupied. The minimum rating for any fire extinguisher is 2A 10B/C. Minimum
distribution of fire extinguishers must be such that no interior part of the building is over 75 feet travel distance from a fire extinguisher.
o Apartment houses with 16 or more units, hotels (motels) with 20 or more units. or apartments or hotels (motels) three stories or more in height
shall be equipped with automatic fire sprinklers designed to NFPA standards.
o All buildings. other than residential. over 5.000 square feet, shall be equipped with an automatic fire sprinkler system designed to NFPA
standards. This includes existing buildings vacant over 180 days.
o Submit plans for the fire protection system to the Fire Department prior to beginning construction of the system.
o Tenant improvements in all sprinklered buildings are to be approved by the Fire Department prior to start of construction.
o Provide fire alarm (required throughout). Plan must be approved by the Fire Department prior to start of installation.
o Fire Department connection to (sprinkler system/standpipe system) shall be required at Fire Department approved location.

INTRODUCTION
This Initial Study is provided by the City of San Bernardino for General Plan Amendment No
95-01 (GPA 95-01) and Conditional Use Permit No. 95-05 (CUP 95-05). It contains an
evaluation of potential adverse impacts that can occur if the proposed General Plan Amendment
and Conditional Use Permit are approved.
The California Environmental Quality Act (CEQA) requires the preparation of an Initial Study
when a proposal must obtain discretionary approval from a governmental agency and is
not exempt from CEQA. The purpose of the Initial Study is to determine whether or not a
proposal, not exempt from CEQA, qualifies for a Negative Declaration or whether or not an
Environmental Impact Report (EIR) must be prepared.

The project proposes to (I) change the proposed site's zoning from Commercial Neighborhood
(CN) to Commercial Heavy (CH) and (2) allow the construction of a recreational vehicle storage
project on-site.
The subject site consists of Assessor's Parcel Numbers 286-163-44, 45 and 46. The site is
located on the north side of Baseline Street, approximately 660 feet west of Victoria in the
Commercial Neighborhood (CN) land use district. The subject site has a frontage of
approximately 330 feet on the north side of Baseline.

SITE AND AREA CHARACTERISTICS
The three parcel site is currently vacant with the exception of a general merchandise market in
the southwest portion of the site. The immediate area along Baseline is primarily commercial,
with the exception of an apartment complex immediately adjacent to the site on the west. The
area to the north and west of the proposed site is zoned residential and is within the City of San
Bernardino, while the area to the immediate south and east is zoned commercial and located
within the City of Highland.

B. DISCUSSION OF ENVIRONMENTAL EVALUATION AND MITIGATION MEASURES
6. Land Use
a. As a proposal to change the site's land use designation from CN to CH, the project will change the
intensity of the land use as designated in the General Plan. As a result, the uses within the CH district
which are currently not permitted in the CN district will be either permitted or conditionally permitted
as indicated in the City's "Commercial Districts List of Permitted Uses." The site is bounded on north
and immediate west by resideittialland use districts; however, the larger surrounding area within the
City of Highland is already designated commercial. Therefore, the site is already directly exposed to
commercial land uses (or the potential for commercial land uses) immediately to the east, west, and
south.
Should this General Plan Amendment be approved, various heavy commercial uses which currently are
not permitted will be either permitted or conditionally permitted. The following is a list of uses
,specifically listed in the Development Code as being either "permitted" or "conditionally permitted" in

Although uses not currently permitted in the Commercial Neighborhood land use district will be either
permitted or conditionally permitted in the CH district, the general area surrounding the project site is
such that the project site lends itself well to a commercial heavy designation. The proposed R.V.
Storage Facility will be a low intensity use which will not negatively impact the adjacent apartment
complex and surrounding residential areas. Any future use other than the R.V. Storage Facility will
require individual environmental analysis and clearance prior to approval, thus allowing them to be
reviewed for potential impacts to the surrounding area.
The two parcels (APN's 268-163-39 and 40 totalling 3.68 acres) to the immediate east of the project
site are currently designated Commercial Neighborhood as well. Staff and the applicant will be
exploring the potential of including this area within the General Plan Amendment. By including this
area within the scope of the General Plan Amendment, the entire area designated as CN would become
CH and, as such, would be subject to the above mentioned permitted and conditionally permitted land
uses.
7. Man-Made Hazards
a. As the proposed use on-site will be recreational vehicle storage, there will be oil stored on-site within
the vehicles. However, the site will function no differently than any typical parking lot and will not
allow for the changing, transpOrtation, or disposal of motor oil or any other hazardous or toxic material.
Conditions of approval will be placed on the project requiring that no dumping or changing of oil occur
as well as no vehicle maintenance or repair. Further, the project will be conditioned to require signage
on the interior side of the perimeter wall stating that no dumping of oil is permitted.
