RESOLUTION NO 95-248
RESOLUTION OF THE CITY OF SAN BERNARDINO OPPOSING THE "RENTAL
ASSISTANCE" PROPOSITION THAT WILL PRE-EMPT LOCAL MOBILEHOME RENT
CONTROL
WHEREAS, the State of California has recognized, by the adoption of special legislation,

that mobilehome residents in mobilehome parks are "homeowners", and that they are not the

same as typical residential tenants, and has specifically left the issue of rent regulation to local

government; and
WHEREAS, there are a substantial number of homeowners living in mobilehome parks
within this jurisdiction, an overwhelming number of them senor citizens or citizens on low or
fixed incomes; and
WHEREAS, due to the prohibitive cost of moving, the lack of available spaces in parks,
and the existence of park restrictions limiting the type and size of mobilehomes which can be
16 placed in parks, mobilehomes are really "immobile", and homeowners are, thus, captive to

rising rents; and
WHEREAS, mobilehome owners typically have a substantial investment in their homes
which, many times, is their only asset; and

WHEREAS, nearly 100 California counties, cities and towns have seen fit to exercise
their local police powers to enact a Mobilehome Rent Protection Ordinance for the purpose of
safeguarding mobilehome residents from rising rents, and this jurisdiction wishes to preserve its
ability to do so; and
WHEREAS, this body opposes any attempt to pre-empt or remove its power to protect
its needy citizens or make policy which responds to the crises' created by high rents and
immobility; and
WHEREAS, an initiative is due to appear on the next statewide ballot titled as a "Rental
Assistance" initiative which would phase out all existing mobilehome rent ordinances in
