HomeMy WebLinkAbout1995-239 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 95-239 RESOLUTION OF THE CITY OF SAN BERNARDINO MODIFYING THE AMOUNT OF PROPOSED PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND AMONG THE CITY OF SAN BERNARDINO AND THE COUNTY OF SAN BERNARDINO, RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFCO 2781, FOR THE AREA GENERALLY LOCATED SOUTHEAST OF DEVORE ROAD, SOUTIlWEST OF THE 1-215 FREEWAY. WHEREAS, on January 9, 1995, the Mayor and Common Council adopted Resolution No. 95-8, determining the amount of property tax revenues to be exchanged between the City and County of San Bernardino resulting from a proposed jurisdictional 2781, change described by LAFCO for the reorganization of the area generally located Southeast of Devore Road, Southwest of the 1-215 Freeway: and WHEREAS, the Local Agency Formation Commission modified the area proposed for reorganization by reducing the boundaries thereof: and WHEREAS, this reduction of area necessitates a modification of the amount of the proposed tax revenues to be exchanged between the City and the County of San Bernardino to reflect the change of boundaries of the proposed reorganization. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals. The Mayor and Common Council of the City of San Bernardino hereby find and determine that: A, Pursuant to Section 99 of the Revenue and Taxation Code, prior to the issuance of a certificate of filing by the Local Agency Formation Executive Officer, the governing bodies of all local agencies whose service area or service responsibilities will be altered by a proposed jurisdictional change will negotiate and determine by resolution the amount of property tax revenues to be exchanged between and among such local agencies. 06-21-95 r," //., - -<. ..>" 9 10 11 12 13 'RESOtUTI.ON MODIFYING THE PROPOSED PROPERTY. TAX REVENUE EXCHANGE BETWEEN THE CITY AND COUNTY OF SAN BERNARDINO RESULTING FROM JURISDICTIONAL CHANGE DESCRIBED BY LAFCO 2781, 1 B, Except as provided in Section 99.1 of the Revenue and 2 Taxation Code, in the event that a jurisdictional change would affect the 3 service area or service responsibility of one or more special districts, the 4 Board of Supervisors of the County of San Bernardino shall, on behalf of the 5 district or districts, negotiate any exchange of property tax revenues, 6 C. The Mayor and Common Council of the City of San Bernardino 7 and the Board of Supervisors of the County of San Bernardino have determined 8 the amount of property tax revenues to be exchanged as a result of jurisdictional change described by LAFCO 2781. SECTION 2. Implementation, A. The negotiated modified exchange of property tax revenues between the City of San Bernardino and the County of San Bernardino attached hereto as Exhibit "A" and incorporated herein by reference, resulting from 14 the described jurisdictional change, is hereby approved and accepted, The 15 16 17 18 19 20 21 22 23 column entitled " Revenue" shall represent the amount of property tax revenues for the current year to be paid to the County of San Bernardino and its affected agencies, B, The annual tax increment generated in the area subject to the jurisdictional change and attributable to the Local Agencies whose service area or service responsibilities will be altered by the proposed, jurisdictional change shall be allocated in the future years pursuant to the provisions of Section 98 of the Revenue and Taxation Code, SECTION 3.
