RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 1995-96
ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 994 FOR CITY-WIDE STREET
3 LIGHTING, STREET SWEEPING, TRAFFIC SIGNAL MAINTENANCE AND GRAFFITI REMOVAL.
4 WHEREAS, by Resolution No. 94-198, the Mayor and Common Council found
5 that the public interest, convenience, and necessity required the extension

WHEREAS,

City-wide street lighting, street sweeping, traffic
signal
providing
maintenance and graffiti removal pursuant to the provisions of Chapter
12.90
of the San Bernardino City Municipal Code; and
WHEREAS,
by Resolution No. 94-88, the Mayor and Common
Counci I
13 declared that all the land included within the boundaries of said district
14 will be benefited by said City-wide maintenance; and
15 WHEREAS, said Resolution No. 94-88 declared that an annual assessment
16 shall be levied on all land within the district to provide funding for said
17 maintenance; and
18 WHEREAS, an Assessment Roll has been prepared totaling $4,446,301.59,
19 which sets forth the individual assessments to be levied on each of the
20 parcels of land within Assessment District No. 994 for the fiscal year 1995-
21 96.

WHEREAS, the final Engineer's Report, approved on July 18, 1994,
23 require that a finding be made each year that an amount equal to the net
24 proceeds, as defined therein, have been spent on law enforcement services;
25 and
26 WHEREAS, said Engineer's Report limits the percentage of any increases
27 over the prior year's assessment to the Consumer Price Index (C.P,I), as
28 defined therein.

RESOLUTION CONFIRMING ASSESSMENT ROLL NO. 994 FOR THE 1995-96 FISCAL YEAR.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. That
the Mayor and Common Council
do hereby find and

Engineer's Report approved July 18, 1994, has been spent on law enforcement
services.
SECTION 2. That the Mayor and Common Council do hereby find and
determine that the proportionate costs to be levied against the parcels of
land within Assessment District No. 994 do not exceed the Consumer Price
Index of 1.5% (One and One-half Percent) except as otherwise provided for in
said Engineer's Report and that said assessments are correctly set forth on
Assessment Roll No. 994 for the fiscal year 1995-96, on file in the office of
the City Clerk, and do hereby confirm said assessments.
SECTION 3. That the City Clerk is directed to cause a copy of this
Resolution to be transmitted to the Office of the Auditor-Controller for the
County of San Bernardino with the request that the individual assessments be
placed on the subject 1995-96 property tax bills for collection together with
all other property taxes.
