RESOLUTION 95-170
RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH THE MANAGEMENT AND TRAINING
CORPORATION, INLAND EMPIRE JOB CORPS CENTER AND ITS CORPS MEMBERS
RELATING TO TRAINING RELATED WORK EXPERIENCE FOR STUDENTS,
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1,
The Director of Parks, Recreation and Community Services
Department of the City of San Bernardino is hereby authorized and directed to execute on
9 behalf of said City an Agreement with the Management and Training Corp, Inland Empire

Job Corps Center and its Corps members, relating to a training related work experience
program for students, a copy of which is attached hereto, marked Exhibit "A" and
incorporated herein by reference as fully as though set forth at length,
14 SECTION 2, The authorization granted hereunder shall expire and be void and of no
15 further effect if the agreement is not executed by both parties and returned to the office of
16 the City Clerk within 60 days following effective date of the resolution,

WHEREAS the Cooperator iI interested in obtaining the assistance of stu-
dents in the Cooperator's business operation and 11 intereated in pro-
viding off-center work experience:

4. Advise students on the value of good work habits and attitudes as
opportunities permit.
5. Keep a record of student's attendance.
s. Report problems ~n attendance, conduct, dress or job performance to
the work experience coordinator immediately.
IT IS MUTUALLY AGREED:
1. The students will be covered by Pederal Employee's Compensaticn.
There will be no need for the cooperator to provide Worker's Com-
pensation Insurance on students.
2. No charge will be made by the Inland Empire Job Corps Center for
services by students.
3. No charge will be made by the cooperator for providing work experi-
ence.
4. The Cooperator and the Center will work out a schedule for off-
center work experience based on the availability of work and shop
facilities and other factors involved to best suit the needs of the
cooperator and center.
5. Students utilized in the off-center Work Experience Program will
not replace cooperator's full-time (present or future) employees,
6. In connection with the performance of work under this agreement,
the Cooperator agrees not to discriminate against any Job Corps
student, employee, or applicant for employment because of race,sex,
religion, color, or national origin.
7. That any property damage to products or facilities, etc., where the
student may be working will be the responsibility of the cooperator
8. That ordinarily students should not be permitted to operate motor
vehicles. However, if the cooperator determines a student is suf-
ficiently skilled and possess a valid operator's license. the co-
operator may permit the student to operate motor vehicles, the co-
operator assumes full liability and responsibility for any propercy
or vehicle damages.
9. A maximum of twenty five (25) hours per week during a six week
period will serve as the student's service period. There are no
exceptions to this rule. Any violation to this rule will be in
breach of Federal ~aw.

health purposes, with safety and. health protection which shall be
at lea. as effective as that "hich is relf1ired under the
Occupational safety and Health Act of 1970 129 U. s. C.l and 29 Code
of rederal Regulation (CFR) Parte 1910, U26, and 1960.
Thil agrelllllll1t may be terminated by notification of either part or
modiUed in 1friting by consent of both parties.
