RESOLUTION NUMBER 95-127
2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO TO APPROVE THE OPTION HOUSE, INC., HOMELESS
3 SHELTER UTILITY PAYMENTS PROGRAM AND AUTHORIZING THE
4 MAYOR TO EXECUTE AN AGREEMENT BETWEEN THE CITY AND THE
OPTION HOUSE, INC., TO BE DRAFTED IN CONFORMANCE WITH THE
5 ATTACHED STAF'F REPORT.
6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
7 OF SAN BERNARDINO AS FOLLOWS:
8 SECTION 1.
9 (a) The Mayor of the City of San Bernardino is hereby authorized and directed to
10 execute, on behalf of the City, an agreement for Community Development Block Grant
11
funding with The Option House, Inc" which agreement will be drafted in conformance
12
with the attached staff report, The agreement provides for the granting of Community
13
14 Development Block Grant funds in the following amount of $6, 000,
15 SECTION 2,
16 (a) The Authorizations to execute the above referenced agreement is rescinded if
17 the parties to the agreement fail to execute it within sixty (60) days of the passage of this

Shelter Utility Payments Program (HSUPP) and the funding of the Program under CDBG Public Services, The
Committee also approved the transfer of the $20,000 in CDBG Transitional Case Manager project to the HSUPP, and
the award of CDBG HSUPP funds to The Salvation Army and Option House, Inc,

TRANSFER OF FUNDS
HOMELESS SHELTER UTILITY PAYMENTS PROGRAM
BACKGROUND
The Homeless Shelter Utility Payments Program (HSUPP) has been funded for the last four (4)
years from the Low- and Moderate-Income Housing Set-Aside funds, Because of recent case
law, a determination has been made by Agency Counsel that set-aside funds cannot be used to pay
for operation costs, This detennination was made after the Request for Proposals (RFP) was
released; two (2) service providers, The Salvation Army and Option House, Inc., were selected
and contracts released for signature, Because an appropriate alternative funding source needs to
be identified and the City has reached its fifteen percent (15%) limit with respect to CDBG
financed public services activities, it is necessary to transfer funds between CDBG funded projects
in order to accomplish the desired objective of meeting existing funding commitments,
CDBG FUNDING SUBSTITUTION
The Housing Division has been allocated $20,000 in CDBG funds for a Transitional Case
Manager Public Service Project, These funds were to provide homeless families residing in a
transitional housing project created under the HOME Investment Partnership Act Program, with
case managers to provide families with support service plans as a component of their self-
sufficiency programs,
The Transitional Housing project was created under the HOME Investment Partnership Act
(HOME), CDBG funds were identified for the case manager aspect of this project because
HOME funds were not available at the time the project was being implemented,
Given the fact that the HSUPP commitment cannot be funded from the Low- and Moderate-
Income Housing Set-Aside funds, it is necessary to proceed with the following actions:
I, Create a Homeless Shelter Utility Payments Program by transferring $20,000 in CDBG
funds from the Housing Division's Transitional Case Manager Project to the Homeless
Shelter Utility Payments Program Project

2, Allocate $14,000 from the $20,000 to the Salvation Army and the remaining $6,000 to
Option House, Inc" to operate the HSUPP Project.
These actions will provide the necessary vehicle to fund the Homeless Shelter Utilities Payment
Program to meet current obiligations, Therefore, this program is considered to require this one
time only approval.
Based upon the foregoing, staff recommends adoption of the form motion.
