BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The City Administrator of the City of San Bernardino is hereby authorized to enter into a mutually cooperative agreement with the County of San Bernardino to assist in the development and maintenance of an inter-agency economic development geographic information system (EDGIS). SECTION 2. This resolution is rescinded if the parties to the agreement fail to execute it within sixty (60) days of the passage of this resolution. Penman, 21 city Attorney 22 ~~~ 23 24 25 26 27 28 2 , 95-122 I MEMORANDUM OF UNDERSTANDING SBIATC/AGUA MANSA ECONOMIC DEVELOPMENT GIS PROJECT This Memorandum of Understanding is made and entered into between the City of San Bernardino and the County of San Bernardino as stipulated below, WHEREAS, the County of San Bernardino, through the Department of Economic and Community Development (ECD) is developing the Economic Development Geograph- ic Information System (EDGIS) for the Agua Mansa Enterprise Zone (AMEZ) and the San Bernardino International Airport and Trade Center (SBIA TC) and surrounding project area; and, WHEREAS, the economies of the Counties of San Bernardino and Riverside have experienced a direct and significant adverse impact due to military base closures and downsizing of the defense industry, are now additionally threatened with impending base realignment, and continue to experience unemployment higher than in other portions of Southern California; and, WHEREAS, the Agua Mansa Enterprise Zone and San Bernardino International Airport and Trade Center are designated as regional employment generators providing a basis for industrial job development for surrounding communities and areas; and, WHEREAS, the objectives of the EDGIS are to expand job supply in the Inland Empire by providing quick access to existing information on industrial land to prospective site users, thereby facilitating business attraction, expansion and retention; and, WHEREAS, the EDGIS is intended to be a public-private effort to create an inter- active database and user-friendly query software which provides quick access to detailed public information on industrially zoned sites and facilities within the project area for private and public sector users; and, WHEREAS, the EDGIS database and software will be accessible at an office of each participating jurisdiction, and will provide various user-requested maps, descriptive characteristics and reports portraying industrial land data made available through this system; and, WHEREAS, convenient availability of a common database is expected to streamline the permit process and facilitate economic development, benefiting the private sector and each participating jurisdiction through cumulative increases in jobs and revenues; and, WHEREAS, once developed, the software and prototype area database will be provided without charge to each participating jurisdiction for initial use and refinement pending expansion of the system to other areas of San Bernardino and Riverside Counties; and, WHEREAS, the EDGIS application will encompass lands within the responsibility of the following joint powers agencies and local jurisdictions Agua Mansa Enterprise Zone and San Bernardino International Airport and Trade Center project area: Agua Mansa Industrial Growth Association (AMIGA), the Inland Valley Development Authority (IVDA), the San Bernardino International Airport Authority (SBIAA), the Counties of San I 1 ,.'" ..- r, Bernardino and Riverside, and the Cities of Colton, Rialto, Riverside and San Bernardino; and, WHEREAS, the County of San Bernardino Board of Supervisors has committed up to $250,000 of its HUD Community Development Block Grant (CDBG) allocation to offset costs of implementing the EDGlS; and, WHEREAS, the Environmental Systems Research Institute (ESRI) recently has been engaged by San Bernardino County as the GIS vendor to develop the EDGlS, and Topping Jaquess Consultants is providing third-party project management assistance to ECD; and, WHEREAS, in order to develop a satisfactory product, the County of San Bernar- dino County is in need of active cooperation and assistance from participating jurisdictions in sharing existing digital and other data and in maintaining their respective portion of the EDGlS database over time without charge; and, WHEREAS, if successful, the prototype EDGlS will be the first step in the creation of an expanded system for the entire Inland Empire, in cooperation with the private sector and other jurisdictions; NOW, THEREFORE, the parties agree as follows: L Agreement to Share Data and Cooperate A, The City of San Bernardino will provide to ECD, without charge in and accor- dance with the project work plan schedule, the following datasets for the EDGlS project area which exist within its jurisdiction in digital or other form: I, Assessor's parcels 2, Alquist-Priolo fault zones 3, Census tracts 4, City boundaries 5, County boundaries 6, City sphere of influence boundaries 7, Enterprise zone boundaries 8, IVDA and SBlAA boundaries 9, Street network 10, Land use (existing) 11, Zoning 12, Circulation element designations 13. Railroads 14, Flood Insurance Rate Map zones IS, Airport runways 16, Map reference grid 17, Building data 18, Fire district boundaries 19, Gas network 20, Sewer network 2 L Water network r ,~ 9,5-122. 22, Other data items, as agreed upon specifically, B. The City of San Bernardino will provide staff participation in periodic project review meetings, and work cooperatively with the County of San Bernardino and its GIS vendor and project management consultants; C. The City of San Bernardino will make every reasonable effort to provide up- dates to the EDGIS database for its respective portion of the area without charge in the future as the system is implemented and possibly expanded, II. A~reement to Provide System A, The County of San Bernardino will fund and oversee the work of the EDGIS project vendor, and will work cooperatively with participating jurisdictions to achieve an optimally beneficial product; B. The County of San Bernardino will arrange to have the EDGIS prototype soft- ware and database distributed without charge to each participating jurisdiction, provided the jurisdiction gives the general public reasonable access to use of the EDGIS application, C. The County of San Bernardino will seek to actively involve each participating jurisdiction in the evaluation of the EDGIS prototype project and, to the extent feasible, arrange for modifications and adjustments which will increase its benefits to users; D, The County of San Bernardino will actively solicit advice and comments from representatives of the private sector develop and implement the prototype EDGIS applica- tion so as to maximize its potential value to users and to identify opportunities to expand the system to other parts of the Inland Empire, E.
