HomeMy WebLinkAbout1995-091 " 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 RESOLUTION NO. 95-91 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CREATING UNDERGROUND UTILITY DISTRICT NO. 24, GENERALLY LOCATED ALONG PORTIONS OF TIPPECANOE AVENUE, BETWEEN 3RD STREET AND CENTRAL AVENUE AND ALONG PORTIONS OF NORTON WAY, NORTIf OF "B" STREET. WHEREAS, a public hearing was held on the 3rd of April, 1995, at the hour of 10:00 a.m., at the Council Chambers, 300 North "D" Street, San Bernardino, California, to determine whether the public necessity, health, safety or welfare required the formation of an Underground Utility District No. 24 located along portions of Tippecanoe Avenue, between 3rd Street and Central Avenue, and along portions of Norton Way, North of "B" Street (within former Norton Air Force Base) , San Bernardino, California; and WHEREAS, notice of said hearing has been given to all affected property owners as shown on the last equalized assessment roll and to all utilities concerned in the manner and for the time required by law; and WHEREAS, said hearing has been duly and regularly held and all persons interested have been given an opportunity to be heard. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, AS FOLLOWS: SECTION 1. It is hereby found and determined pursuant to Chapter 13.36 19 of the San Bernardino Municipal Code of the City of San Bernardino, and to 20 definitions contained therein that the public necessity, health, safety and 21 welfare require the formation of an underground utility district, located 22 along said public streets as described herein, in order to remove utility 23 poles, overhead wires and associated structures and to underground 24 utilities along said portions of said streets. 25 SECTION 2. An underground utility district to be known as Underground 26 Utility District No. 24 is hereby established in that area located along 27 said portions of Tippecanoe Avenue and Norton Way extension, and more 28 particularly shown on Drawing No. 9263 by the Engineering Division, 3-20-95 .",' RESOLUTION CREATING UNDERGROUND UTILITY DISTRICT NO. 24 ALONG PORTIONS OF TIPPECANOE AVENUE AND ALONG PORTIONS OF NORTON WAY. 1 2 3 4 5 6 7 8 9 Department of Public Works, City of San Bernardino, on file in the office of the City Clerk's office of the City of San Bernardino. SECTION 3. All poles, overhead wires and associated overhead structures shall be removed and underground installations made in said underground utility district within the following times: a. Underground installation by utility companies and property owners and reconnect ions not later than April 30, 1997. b. Removal of poles, overhead wires and other associated structures not later than June 30, 1997. 10 SECTION 4.
