BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
The Mayor of the City of San Bernardino is
hereby authorized and directed to execute on behalf of said City
a Contract between the County of San Bernardino and the City of
San Bernardino for access and inquiry into the Sheriff
Department's Central Name Index, a copy of which is attached
hereto marked Exhibit "A" and incorporated herein by reference as
fully as though set forth at length.
SECTION 2.
The authorization to execute the above-
14 referenced agreement is rescinded if the parties to the agreement
15 fail to execute it within sixty (60) days of the passage of this
16 resolution.

IT IS HEREBY AGREED AS FOLLOWS:
(Use space below and additional bond sheets. Set forth service to be rendered, amount to be paid. manner of payment, time for performance or completion,
determination of satisfactory performance and cause for termination, other terms and conditions, and attach plans, specifications. and addenda. if any.)
1. This contract is for the furnishing by COUNTY to CONTRACTOR, teleprocessing
services. It is the intent of the parties to promote more effective regional law
enforcement through the cooperative use and maintenance of the COUNTY'S computerized
data files.
2. The data COUNTY provides for inquiry shall include only the following:
o Property Information System Data Base
o Municipal County Traffic Citation Data Base
o Automated Court Information Data Base
o Sheriff's Central Name Index Data Base (CNI) - Sheriff's Automated
Warrants
o Property Evidence Tracking System
o Sheriff's Sex Offenders File

CONTRACTOR agrees to limit access to COUNTY'S data files to Criminal Justice Law
Enforcement Personnel and to adhere to all State, COUNTY and Federal laws applicable
to the confidentiality and the release of information. Signed agreement of use for
each of the above systems shall be completed by CONTRACTOR.
3. Access to the COUNTY'S Sheriff Central Name Index (CNI) data base is also
limited, as follows:
a. In the interest of maintaining a regional criminal justice data base,
CONTRACTOR is granted update capability to the COUNTY'S Sheriff CNI data
base for Officer reporting and ID transactions. The data entered into eNI
by the CONTRACTOR will be relevant to the criminal justice process. The
completeness, accuracy, objectivity, and verifiability of information
entered into the system is paramount and the CONTRACTOR will cooperate
with regular auditing of the system to assure reliability to stored data;
in addition, procedures for purging or canceling entries will be adhered
to for enhancing reliability of all data.
b. The CONTRACTOR will enter into the CNI system only that data originating
with organizations who are a party to this or a similar contract with the
COUNTY.
c. The CONTRACTOR agrees to cause employees, having access to the Sheriff's
Central Name Index (eNI), to complete clearance forms as provided by the
COUNTY before such access will be allowed.
d. Only authorized data on standard formats will be entered into CNI. For
special, unique information the Sheriff's concurrence must be obtained in
advance.
e. The Sheriff or his representative will act as "Controller" facilitating
the entry and retrieval of computerized CNI information.
f. CONTRACTOR agrees to update CNI for all law enforcement related incidents
reported within its jurisdiction in a timely fashion to insure integrity
of CNI and promote regional cooperation and effectiveness in law
enforcement. (For the first year of this contract, CONTRACTOR will not be
required to comply with this section 3(f). The condition will be subject
to renegotiation in the future).
4. The CONTRACTOR agrees to appoint a security/privacy officer who shall be
responsible for all security and privacy considerations relating to the CNI, and the
terminals attached thereto. This officer will be the liaison point with the controller
regarding security and privacy control.
5. The COUNTY'S Department if Information Services(DIS) shall coordinate a pre-
installation teleprocessing network service site survey and determine installation
requirements for CONTRACTOR location. CONTRACTOR shall render full cooperation to
COUNTY .
6. DIS will act as teleprocessing network service manager and the COUNTY will
offer two types of network services to the CONTRACTOR as selected on the Tele-

processing Network Services "Exhibit A" to this contract. These services are generally
described as follows:
a. Class A - COUNTY provides data circuit and modems, and complete data
communication support services of problem isolation and resolution from COUNTY
host computer to CONTRACTOR terminals. Charges for Class A services are in
accordance with established standard DIS network rate, per each County Central
Computer connected teleprocessing device.
Each request to add equipment for teleprocessing will be evaluated
independently, depending upon specific circumstances of each CONTRACTOR
location and ability of COUNTY to provide additional service.
b. Class B - COUNTY provides data circuit and modems, and specific data
communication support services of problem isolation and resolution from
COUNTY'S Central Computer to the last component of DIS supplied equipment
(usually the modem on the CONTRACTOR end of circuit). The CONTRACTOR is
responsible for the coordination of all problem isolation and resolution
involving equipment and software not supplied by DIS. Charges for Class B
services shall be two network units at the standard DIS network rate at each
CONTRACTOR location. Teleprocessing equipment additions are subject to OMS
review and approval as COUNTY Central Computer compatible devices. Each
request to add equipment for teleprocessing services will be evaluated
independently, depending upon specific circumstances of each CONTRACTOR
location and ability of COUNTY to provide additional services.
7. CONTRACTOR shall pay to COUNTY a monthly sum of money per Schedule "A"
attached to this contract. CONTRACTOR agrees to pay for all installation costs. The
total cost of additional services, equipment, related supplies and changes of
modifications will be paid for by the CONTRACTOR. The total cost to repair or replace
equipment damaged by neglect, malicious actions or accident shall be the
responsibility of the CONTRACTOR.
COUNTY shall have the right to renegotiate the rate of services performed under
this contract at the end of each fiscal year, and said rate may be adjusted upward or
downward to reflect the actual cost.
8. It is understood by and between the parties hereto that this contract shall be
deemed executory to the extent of the monies available to COUNTY and no liability on
account thereof shall be incurred by COUNTY beyond monies budgeted for the purpose
thereof.
9. Training of CONTRACTOR personnel on teleprocessing equipment and operations
shall be provided by the COUNTY upon CONTRACTOR request. Training hours, charges and
content of training are to be mutually agreed upon by both parties at time services
are requested.
10. The term of this contract shall be a period of time commencing on July 1,
1994, and terminating only as hereafter provided. This contract may be terminated at
any time with or without cause by CONTRACTOR or by COUNTY upon written notice given to

the other party at least thirty (30) days before the date specified for such termina-
tion. Any such termination date shall coincide with the end of a calendar month. In
the event of such termination each party shall fully pay and discharge all obligations
in favor of the other accruing prior to the date of such termination and each party
shall be released from all obligations or performance which would otherwise accrue
subsequent to the date of such termination. Neither party shall incur any liability to
the other by reason of termination.
Any and all notices required to be given hereunder shall be given in writing by
registered or certified maill postage prepaid. The addresses of the parties hereto
until further notice are as follows:

11. COUNTY shall provide CONTRACTOR written notification when teleprocessing
services are operational and CONTRACTOR billing shall begin according to this date.
12. The COUNTY'S Sheriff's Department shall bill CONTRACTOR monthly, and shall be
the County Administrator of this contract.
13. CONTRACTOR shall remit monthly payment to:

14. CONTRACTOR agrees to indemnify, defend, and hold harmless the COUNTY and its
authorized agents, officers, volunteers, and employees against any and all claims or
actions arising from CONTRACTOR'S acts, errors, or omissions and for any costs or
expenses incurred by the COUNTY on account of any claim therefore.
15. The COUNTY agrees to indemnify and hold harmless the CONTRACTOR and their
authorized agentsl officers, volunteers, and employees against any and all claims or
actions arising from COUNTY'S negligent acts or omissions on account of any claim
therefore.
16. The documents attached hereto, marked "Schedule A" and "Exhibit A" are
incorporated herein by reference.

17. Upon the effective date of this contract, the Memorandum of Understanding
currently in effect between the parties hereto, for providing said services shall
terminate.

TELEPROCESSING NETWORK SERVICES SELECTION
Check Service Requested:
CLASS "A" A SERVICE - COUNTY EOUIPMENT
Location(s) :
The COUNTY's Department of Information Services (OIS) will provide complete
coordination of data communication installation, problem isolation, and resolution
from the COUNTY Central Computer to the CUSTOMER workstation. This does not include
customer-owned printers of any type.
OIS will coordinate a pre-installation site survey identifying all necessary
pre-installation site requirements. In the case of county departments, this will also
include the ordering of cabling, data circuits, moderns, and electrical power. In the
case of non-county customers, this service will be limited to the definition or
pre-installation site requirements and the ordering of the data communications
circuits and moderns.
1. Complete coordination includes all involved hardware, software (both host-based
and distributed), all data circuits, modems, the reporting, tracking,
diagnosing, and directing of all necessary vendors to restore full equipment
operations and normal data communications in a timely manner.
CLASS "B" SERVICE - CUSTOMER EOUIPMENT
Location(s) :
The COUNTY's Department of Information Services (OIS) will provide coordination of
data communications problems including problem isolation and resolution from the
COUNTY Central Computer to the last component of DIS-supplied equipment (usually the
modem on the CUSTOMER end of dedicated data circuit) .
The CUSTOMER is responsible for the coordination of the isolation and resolution of
all problems involving hardware and software not supplied by DIS. Specifically
excluded from DIS support are CUSTOMER-supplied distributed processors, printers,
display stations; all CUSTOMER cabling such as terminal distribution cables (coax,
twin-ax, twisted pair, etc.), modern interface cables; all CUSTOMER supplied jacks,
switches and splitters; distributed software, including mini-based and micro-based
software; and, all consumables such as printer ribbons and paper.
CIS will coordinate a pre-installation site survey identifying all necessary
pre-installation site requirements. This service will be limited to the definition of
those requirements and the ordering of the data communications circuits and moderns.
The CUSTOMER is responsible for making all site preparations prior to the installation
of data communication service.
2. Coordination includes working with all necessary vendors in an effort to
restore normal data communications in a timely manner. Reporting, tracking, and
diagnosing of problems related to CUSTOMER-supplied equipment and software is
the responsibility of the CUSTOMER.

SUBJECT:
CONTRACT WITH THE CITY OF SAN BERNARDINO FOR ACCESS
TO THE COUNTY'S COMPUTERIZED DATA FILES
RECOMMENDATION:
Approve contract with the City of San Bernardino for the Sheriffs Department to provide
teleprocessing services, and access to the County's computerized data files by the San
Bernardino Police Department.
REASON FOR RECOMMENDATION:
The County provides Teleprocessing services to various Cities throughout the County in order
to promote more effective regional law enforcement through the cooperative use and
maintenance of the County"s computerized data files.
The City of San Bernardino currently must call the Sheriff's Records division for each
transaction it needs to process. Approval of this contract will allow for placement of
equipment at the new San Bernardino Police Department facility and relieve the Sheriffs
Department of the requirement to access information on behalf of the City.
REVIEW BY OTHER DEPARTMENTS:
This contract has been reviewed and approved as to form by Deputy County Counsel Kevin
Norris.
FINANCIAL DATA:
The City will reimburse the County for maintenance and usage fees in the amount of
$23,148.00 per fiscal year. No additional cost to the County.
