Home My WebLink About1996-377 1 RESOLUTION NO. 96-377 2 RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS 3 INTENTION TO ORDER THE VACATION OF A PORTION OF CLUB CENTER DRIVE, EAST OF CLUB WAY AND RESERVING EASEMENTS FOR SANITARY 4 SEWER AND WATERLINES. 5 6 7 8 9 10 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council of the City of San Bernardino hereby declares its intention to order the vacation of a portion of Club Center Drive, east of Club Way, described as follows: 11 12 13 14 15 16 17 18 19 20 21 22 Those portions of Club Center Drive, 60 feet wide (formerly Caroline Street) in the City of San Bemardino, County of San Bernardino, State of California, being a portion of Parcel 6, Parcel Map 840 I as per map recorded in Book 88 of Parcel Maps, pages 32-33, portions of which are dedicated on Document No. 87- 359087, Official Records of said County and portions of which are shown on Parcel Map No. 11148, recorded in Book 135 of Parcel Maps, pages 31 to 32, records of said County, described as follows: Beginning at the Southeast comer of said Parcel 6, said point also being on the South line of said Club Center Drive; thence South 890 49' 45" West, along the South line of said Parcel 6 and said South line of Club Center Drive, a distance of 287.56 feet; thence Northeasterly, along a non-tangent reverse curve having a radial bearing of North 330 43' 42" West, concave Northwesterly and having a radius of 72 feet, through a central angle of 630 13' 32", and arc distance of 79.45 feet; thence South 450 10' IS" East, a distance of 12.03 feet; thence North 890 49' 45" East, along the North line of said Club Center Drive, a distance of 247.42 feet to East line of said Parcel 6.; thence continuing along said North line, a distance of 86 feet, more or less; to the intersection of the Northerly prolongation of the West line of that certain 20' North South alley as shown on said Parcel Map 11148; thence South, along said Northerly prolongation, a distance of 60 feet, more or less, to the South line of said Club Center Drive; thence West, along said South line to the Point of Beginning. 23 24 25 vacating the above described portion of said street, elects to proceed under and in accordance 26 SECTION 2. That the Mayor and Common Council of the City of San Bernardino, in 27 with the provisions of the "Public Streets, Highways, and Service Easements Vacation Law", 28 being Division 9, Part 3, of the Street and Highways Code of the State of California. 12/11/96 14-' 077 RESOLUTION OF INTENTION --- VACATION OF A PORTION OF CLUB CENTER DRIVE, EAST OF CLUB WAY . 1 2 3 4 5 SECTION 3. That the hour of 10:00 a.m., on January 13, 1997, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California, is fixed as the time and place when and where all persons interested in or objecting to the proposed vacation may appear before the said Mayor and Common Council and offer evidence in relation thereto, For 6 further particulars as to the proposed vacation, reference is made to that map marked "Plan No. 7 9603", approved on 12/02/96 , a copy of which is on file in the office of the City Clerk of said 8 City. 9 10 11 SECTION 4. Nothing in this Resolution shall in any way affect or disturb any existing easements for public utility purposes belonging either to the City of San Bernardino or to any 12 public utility and there is hereby specifically reserved for the City of San Bernardino, an 13 easement for sanitary sewer and appurtenance facilities over the entire area proposed to be 14 vacated including the right to construct, maintain, operate, replace and renew said sewer or 15 appurtenances; and there is hereby specifically reserved for the City of San Bernardino 16 Municipal Water Department, an easement for water utility purposes over the entire area 17 18 proposed to be vacated, including the right at any time, or from time to time, to construct, 19 20 maintain, operate, replace and renew one or more pipelines or appurtenances thereto for the transportation of water and for the construction and maintenance of water wells and related 21 22 incidental purposes, including the right of ingress and egress thereto. SECTION 5. That the City Engineer of the City of San Bernardino hereby is directed to 23 24 cause Notices of Street vacation to be posted as required by said "Public Street, Highways and 25 Service Easements Vacation Law." 26 SECTION 6.
