HomeMy WebLinkAbout1996-340 RESOLUTION NO. 96-340 1 2 RESOLUTION OF THE CITY OF SAN BERNARDINO ADOPTING GENERAL PLAN AMENDMENT NO. 96-10 TO THE GENERAL PLAN OF THE CITY OF SAN 3 BERNARDINO. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 5 SECTION 1. Recitals 6 7 was adopted by the Mayor and Common Council by Resolution (a) WHEREAS, the General Plan for the City of San Bernardino 8 No. 89-159 on June 2, 1989. 9 10 11 12 13 and associated (b) amendment proposal WHEREAS, the development project was reviewed for compliance with the California Environmental Quality Act (CEQA) and based upon the preliminary review, the project was found to be exempt from CEQA pursuant to CEQA Guidelines ~15061(b) (3) which states that CEQA applies only to 14 projects that have the potential for causing a significant effect 15 on the environment. 16 (c) WHEREAS, on September 5, 1996, the City'S Environmental 17 Review Committee concurred with the findings of staff's preliminary 18 review for CEQA and recommended that the Planning Commission 19 recommend to the Mayor and Common Council that a Notice of 20 Exemption be filed with the San Bernardino County Clerk of the 21 Board if the project is approved. 22 (d) WHEREAS, the Planning commission conducted a noticed 23 public hearing on September 17, 1996 in order to receive public 24 testimony and written and oral comments on General Plan Amendment 25 No. 96-10, a proposal to change the General Plan Land Use 26 Designation from CG-1, Commercial General, to PF, Public 27 Facilities, on four parcels of land totaling 1.5 acres located on 28 1 1 the northwest corner of 7th street and Waterman Avenue, and fully 2 reviewed and considered the Planning Division staff report and the 3 recommendation of the Environmental Review Committee. 4 (e) WHEREAS, the Mayor and Common Council held a noticed 5 public hearing and fully reviewed and considered proposed General 6 Plan Amendment No. 96-10 and the Planning Commission and 7 Environmental Review Committee recommendations and Planning 8 Division Staff Report on October 21, 1996. 9 (f) WHEREAS, the adoption of General Plan Amendment No. 96-10 10 is deemed in the interest of the orderly development of the City 11 and is consistent with the goals, objectives and policies of the 12 existing General Plan. 13 SECTION 2. Environmental Determination 14 NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the Mayor 15 and Common Council that the proposed amendment to the General Plan 16 of the city of San Bernardino is exempt from the California 17 Environmental Quality Act pursuant to the California Environmental 18 Quality Act Guidelines s15061(b) (3) which states that CEQA applies 19 only to projects that have the potential for causing a significant 20 effect on the environment and as such, the proposed amendment is 21 hereby ratified, affirmed and adopted. 22 SECTION 3. Findinqs BE IT FURTHER RESOLVED by the Mayor and Common Council of the 23 24 city of San Bernardino that: A. The proposed amendment is internally consistent with the 25 General Plan in that it meets the General Plan's goal to 26 "permit the continuation and expansion of existing public 27 facilities (police, fire, social service, cemeteries, 28 2 1 2 3 4 B. 5 6 7 8 9 10 c. 11 12 13 14 D. 15 16 17 18 19 20 21 22 A. 23 24 25 26 27 28 governmental administrative, and other) in areas designated as "Public Facilities" (PF) and new development in any zone (I 1.1 and I 1.18)" (General Plan Policy 1.37.13). The proposed amendment would not be detrimental to the public interest, health, safety, convenience, or welfare of the City in that the proposed land use designation is in accordance with the existing land use adjacent on the west. The addition of burial plots on the site will not encroach onto other property or affect the circulation of the immediate area. The proposed amendment would not affect the balance of land uses within the City in that the proposal would not create a new public facility but, rather, would expand the service of an existing public facility. The 1.5 acre amendment site is physically suitable for the requested PF land use designation in that the site is presently designated as a commercial district and no structures exist on the site. Any actual on-site improvements would be reviewed at the time of their proposal and conditions implemented when the proposal is approved. SECTION 4. Amendment BE IT FURTHER RESOLVED by the Mayor and Common Council that: The Land Use Plan of the General Plan of the City of San Bernardino is amended by changing four parcels of land totaling approximately 1.5 acres from CG-l, Commercial General, to PF, Public Facilities. This amendment is designated as General Plan Amendment No. 96-10 and its location is outlined on the map entitled Attachment A, a copy of which is attached and incorporated herein by reference. 3 1 B. General Plan Amendment No. 96-10 shall become effective 2 immediately upon adoption of this resolution. 3 SECTION 5. Map Notation 4 This resolution and the amendment affected by it shall be 5 noted on such appropriate General Plan maps as have been previously 6 adopted and approved by the Mayor and Common Council and which are 7 on file in the office of the City Clerk. 8 SECTION 6.
