4 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO ACCEPTING A GRANT DEED FROM THE SAN BERNARDINO
5 COUNTY FLOOD CONTROL DISTRICT FOR PROPERTY LOCATED ON THE EAST SIDE
OF WESTERN AVENUE, NORTH OF KENDALL DRIVE, AND DEDICATING, THE
6 PROPERTY FOR WATER DEPARTMENT USE.
7 WHEREAS, the City of San Bernardino Municipal Water Department
8 is involved in a project to cleanup groundwater contamination in
9 the Bunker Hill Basin, in particular the Newmark Superfund Cleanup
10 Site; and
11 WHEREAS, a part of the cleanup involved developing a well
12 field to prevent the contaminants from migrating further in the
13 water basin; and
14 WHEREAS, the acquisition of property located on the east side
15 of Western Avenue, north of Kendall Drive is necessary for the
16 placement of a well for this project.
17 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
18 SAN BERNARDINO AS FOLLOWS:

SECTION ONE:
The city of San Bernardino hereby accepts the
20 Grant Deed from the San Bernardino County Flood Control District
21 for property located on the east side of Western Avenue, north of
22 Kendall Drive, as set forth in Exhibit "1" attached hereto and
23 incorporated herein by reference as though fully set forth at
24 length herein.
25 SECTION TWO: That the property acquired herein is dedicated
26 for Water Department use.
27 I HEREBY CERTIFY that the foregoing resolution was duly
28 adopted by the Mayor and Common Council of the city of San

BEGINNING at the point of intersection of the west line of said Section 16 with the
northerly line of Kendall Drive, 80 feet wide; thence North 00"22'00" West along said west
line 100,00 feet to the TRUE POINT OF BEGINNING; thence North 89 38'00" East 126,89
feet to a point which is 150.00 feet northeasterly and measured at right angles from the
