TAIN REAL PROPERTY SITUATED AT 1505 NORlli WATERMAN AVENUE, IN SAN BERNARDI-
NO.
BE IT RESOLVED BY TIlE MAYOR AND CQMI.KlN COUNCIL OF TIlE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECfION 1. The Mayor of the Ci ty of San Bernardino is hereby au-
thorized and directed to execute on behalf of said City, a First Amendment
to Lease with the Ayala family, relating to that certain real property
located at 1505 North Waterman Avenue, a copy of which is attached hereto
marked Exhibit "A" and incorporated herein by reference as fully as though
set forth at length.
SECfION 2. The authorization to execute the above-referenced
agreement is rescinded if the parties to the agreement fail to execute it
within sixty (60) days of the passage of this resolution.

after called "City" , and SALVADOR AYALA, SALVADOR AYALA, JR., MARIA C.
AYALA, MARIA E. AYALA, FRANK HALSTEAD, BLANCA O. LOPEZ and CARLOS E. LOPEZ,
dba ROSEMEAD INSURANCE AGENCY, hereinafter called "Lessee".
WIT N E SSE T H:
WHEREAS, City and Lessee entered into a Lease Agreement with
Option to Purchase on March 20, 1996, granting to Lessee the use of the
City-owned property located at 1505 North Waterman Avenue, San Bernardino;
and
WHEREAS, City and Lessee desire to amend said Lease to provide for
an extension of free rent to and including November 30, 1996;
NOW, THEREFORE, it is mutually agreed between the parties as
follows:
1. Paragraph 4 of that Lease Agreement between the parties here-
to dated March 20, 1996, is hereby amended to read:

Lease Payments/Option to Purchase.
Lessee agrees to
pay, and Lessor agrees to accept as lease payments for said Premises, a
monthly rental of One Thousand Five Hundred Dollars ($1,500).
Said total
monthly rental is to be paid on or before the first day of each month, made
payable to the Lessor, and sent to:

Real Property Section
300 North "0" Street, 3rd Floor
San Bernardino, CA 92418
The Lease payments of One Thousand Five Hundred Dollars ($1,500) per month
shall not commence until the first day of December, 1996. Each month, Five
Hundred Dollars ($500) of the total monthly lease payment of One Thousand

1505 NORTII WATERMAN AVENUE
Five Hundred Dollars ($1,500) shall be set aside to be credited towards the
down payment for the purchase of said Premises. Said Five Hundred Dollars
($500) credit shall extend to the end of the two (2) year Option to Purchase
the Premises, with a maximum total credit of Eight Thousand Dollars ($8,000)
accruing towards the purchase of said Premises. In the event Lessee does
not exercise said Option to Purchase the Premises within the two year option
period, the Eight Thousand Dollars ($8,000) shall be considered a portion of
the Lease payments and shall not accrue to the benefit of the Lessee. In
the event the Lessee does exercise the Option to Purchase, the Five Thousand
Dollar ($5,000) deposit made at the commencement of the Lease shall also be
credited to the purchase of the Premises as long as all lease payments are
current and the Lessee is in good standing with the Lessor. If the Lessee
does not exercise said Option to Purchase, the Five Thousand Dollar ($5,000)
shall be considered a security deposit for the Lease and shall not be re-
funded, but may be used by Lessee for regular lease payments at the end of
the two (2) year option term."
3. All other terms, conditions and covenants of said Lease shall
remain the same and be in full force and effect.
