HomeMy WebLinkAbout1996-187 , I 96-187 RESOLUTION NO. 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO ESTABLISHING FIRE DEPARTMENT ADMINISTRATIVE FEES 3 FOR ANNUAL ROUTINE INSPECTIONS OF PROPERTY AND PROCEDURES REGARDING THE IMPOSITION OF SUCH FEES. 4 WHEREAS, Sections 13145 and 66014 of the Government Code require that building 5 inspection fees shall not exceed the estimated reasonable cost of providing the service for which the fee is charged; 6 WHEREAS, a public hearing has been held pursuant to Section 66018 of the California 7 Government Code; 8 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 1. A Fire Department administrative charge of$25.00 is hereby established when the City of San Bernardino Fire Department incurs costs pursuant to Section 15.16.080 in conducting a third inspection of property to determine compliance with fire code safety standards arising out of the Fire Department's routine annual inspection of property. SECTION 2. A Fire Department administrative charge of $50.00 is hereby established when the City of San Bernardino Fire Department incurs costs pursuant to Section 15.16.080 in conducting a fourth inspection of property to determine compliance with fire code safety standards arising out of the Fire Department's routine annual inspection of property. SECTION 3. A Fire Department administrative charge of $1 00.00 is hereby established when the City of San Bernardino Fire Department incurs costs pursuant to Section 15.16.080 in conducting a fifth inspection of property, as well as any ensuing inspection, to determine compliance with fire code safety standards arising out of the Fire Department's routine annual inspection of property. SECTION 4. No charge will be imposed for the first or second inspection arising out of the Fire Department's routine annual inspections of property. On the second inspection, if the fire inspector determines that the owner has not substantially complied in correcting the violations previously cited as part of the first inspection, the inspector will issue a notice to the property owner informing the owner of fees to be charged in the amount of$25.00 for the third inspection; $50.00 for the fourth inspection; and $100.00 for the fifth and any ensuing inspection.
