I RESOLUTION OF THE CITY OF SAN BERNARDINO A WARDING A
CONTRACT TO HOLLAND-LOWE CONSTRUCTION, INC. FOR STREET AND
2 TRAFFIC SIGNAL IMPROVEMENTS ON TIPPECANOE A VENUE FROM REDLANDS
BOULEVARD TO HOSPITALITY LANE.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
4 SAN BERNARDINO AS FOLLOWS:

SECTION
I. Holland-Lowe Construction, Inc. is the lowest responsible bidder for:
6 Street and Traffic Signal Improvements on Tippecanoe Avenue, from Redlands Boulevard to
7 Hospitality Lane, per Plan No. 8888. A contract is awarded accordingly to said bidder for the
8 total amount of $326,419.45, but such award shall be effective only upon the contract being fully
9 executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby
10 authorized and directed to execute said contract on behalf of the City; a copy of the contract is on
II file in the office of the City Clerk and incorporated herein by reference as fully as though set forth
12 at length.
13 SECTION 2. This contract and any amendment or modifications thereto shall not take
14 effect or become operative until fully signed and executed by the parties and no party shall be
15 obligated hereunder until the time of such full execution. No oral agreements, amendments,
16 modifications or waivers are intended or authorized and shall not be implied from any act or
17 course of conduct of any party.

4 SECTION: 3. This resolution is rescinded if the parties to the contract fail to execute
5 it within ninety (90) days of the passage of this resolution.
6 I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the Mayor and
7 Common Council of the City of San Bernardino at a regular meeting thereof, held on the 17th
8 day of June, 1996, by the following vote, to wit:
