2 RESOLUTION OF THE CITY OF SAN BERNARDINO CERTIFYING THE
TRAFFIC IMPACT ANALYSIS REPORT FOR THE INLAND CENTER MALL EXPANSION
3 PROJECT PURSUANT TO THE CONGESTION MANAGEMENT PLAN.

SECTION I. Recitals
5 (a) WHEREAS, on November 3, 1993 the San Bernardino
6 Associated Governments adopted the Congestion Management Plan (CMP)
7 pursuant to California Government Code section 65089.3 (c) which
8 requires the county and cities to adopt and implement "a program to

analyze the impacts of land use decisions, including an estimate of
the costs associated with mitigating these impacts" on the CMP
network of roadways; and
(b) WHEREAS, the Mayor and Common Council adopted a Land
Use/Transportation Analysis Program for the city pursuant to the
CMP for the city of San Bernardino by Resolution No. 93-74 on
March 22, 1993; and
(c) WHEREAS, the city determined that the proposed
Inland Center Mall Expansion Project would exceed the threshold
number of vehicle trips during peak traffic hours and thus
warranted the preparation of a Traffic Impact Analysis (TIA) Report
pursuant to the congestion Management Plan (CMP); and
(d) WHEREAS, a Draft TIA Report was prepared to address
the traffic impacts of the Inland Center Mall Expansion project on
designated CMP roadways and Freeways, and appropriate mitigation
and
fair share contribution toward CMP roadway and Freeway
improvements; and
(e) WHEREAS, the Draft TIA Report was made available to
the various regional and sub-regional agencies and to the adjacent
jurisdictions for their reyiew, as required by the CMP during a 60

1 day review period which began on October 16, 1995, and ended on
2 December 18, 1995; and
3 (f) WHEREAS, verbal and written comments were received
4 on the Draft TIA Report and corresponding changes were made to the
5 Draft TIA Report; and
6 (g) WHEREAS, the Mayor and Common Council conducted a
7 noticed public hearing on April 1, 1996, and fully reviewed and
8 considered the Draft TIA Report, the Planning Division staff report
9 and the recommendations of the Planning Division and the Public
10 Works Department.
11 SECTION II. Traffic Impact Analvsis Report
12 NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED BY THE
13 MAYOR AND COMMON COUNCIL THAT:
14 A. The TIA Report for the Inland Center Mall Expansion Project
15 has been completed in compliance with the regional CMP and the
16 City's Land Use/Transportation Analysis Program and found to
17 be consistent with the regional comprehensive Transportation
18 Plan model. The TIA Report and all the evidence and
19 information contained therein is attached hereto as Attachment
20 A (Draft TIA Report) and incorporated herein by reference.
21 B. The TIA Report was presented to the Mayor and Common Council
22 who reviewed and considered the information in the land use
23 decision and traffic impact mitigation process prior to
24 approving the Inland Center Mall Expansion Project
25 (Development Agreement No. 91-01).
26 c. The TIA Report has identified all of the Inland Center Mall
Expansion Project's traffic impacts to designated CMP roadways

and Freeways, the appropriate mitigation and fair share

contribution toward CMP roadway and Freeway improvements.
All of the Inland Center Mall Expansion Project's traffic
impacts can be mitigated by the implementation of the
mitigation measures as identified in the TIA Report.
The Inland Center Mall Expansion Project's estimated fair
share contribution is $1,501,017 for CMP roadway improvements
and freeway improvements.
The Mayor and Common council, in considering the Traffic
Impact Analysis (TIA), have given great weight to the
project's traffic impacts to designated CMP roadways and
Freeways, and the project's appropriate mitigation and fair
share contribution toward CMP roadway and freeway
improvements.
The project proponent has acknowledged the necessity to obtain
funding for Inland Center Mall Expansion Project's estimated
fair share contribution which shall be made available when
traffic counts indicate that the CMP roadway and freeway
improvements are required. Such obligation to make fair share
contributions toward CMP roadway and freeway improvements
shall not become operative as to the project proponent until
traffic counts warrant it. All development activities
occurring in areas adjacent to and in proximity to the Inland
Center Mall shall be monitored by the City to determine the
allocable fair share contribution to be made by such adjacent
or proximate development.
SECTION III. Certification of the Traffic Impact Analysis Report
NOW THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the
Mayor and Common Council that the Traffic Impact Analysis (TIA)
