HomeMy WebLinkAbout1996-082 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 96-82 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, MAKING FINDINGS AND DETERMINATIONS AS TO THE BENEFIT OF CERTAIN IMPROVEMENTS IN THE VARIOUS REDEVELOPMENT PROJECT AREAS OF THE AGENCY WHEREAS, the City of San Bernardino, California (the "City") is a municipal corporation duly created and existing pursuant to the Constitution and the laws of the State of California; and WHEREAS, the Redevelopment Agency of the City of San Bernardino (the "Agency") is a public body, corporate and politic of the State of California, organized and existing pursuant to the Community Redevelopment Law, California Health & Safety Code Section 33000, et. sec;[. (the "Act"); and WHEREAS, the City, together with the County of San Bernardino and the Cities of Colton, Lorna Linda, Highland and Redlands adopted a certain Joint Exercise of Powers Agreement, as amended, dated as of May 20, 1992 (the "JP A Agreement"), creating the San Bernardino International Airport Authority ("SBIAA"); and WHEREAS, the SBIAA requires additional funds at this time for the purposes of: (i) undertaking public improvement projects to gain better vehicular access to the aviation portions of the former Norton Air Force Base (the "SBD Airport") and (ii) upgrading the aviation -1- RES 96-82 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 facilities located on the SBD Airport (the "Improvements") by contributing local match funds together with federal grant funds; and WHEREAS, pursuant to Section 33445 of the Act, the Agency may, with the consent of the Mayor and Common Council of the City (the "Council"), pay all or a part of the cost of installation and construction of any building, facility, structure or other improvement which is publicly owned either within or without the boundaries of a redevelopment project area if the Council determines: (1) that such buildings, facilities, structures or other improvements are of benefit to the redevelopment project area or the immediate neighborhood in which the project is located, regardless of whether such improvement is within another project area, or in the case of a project area in which substantially all the land is publicly owned that the improvement is of benefit to an adjacent project area of the Agency, (2) that no other reasonable means of financing such buildings, facilities, structures or other improvements is available to the community, and such determination by the Agency and the Council shall be final and conclusive, and (3) that the payment of funds for the cost of the facilities, structures or other improvements will assist in the elimination of one or more blighting conditions inside the project area or provide housing for low-or moderate income persons and is consistent with the implementation plan adopted pursuant to Health & Safety Code Section 33490; and WHEREAS, the SBD Airport is located in the City and improvements located at the SBD Airport will be of benefit to each of the several redevelopment project areas of the Agency (the "Agency Redevelopment Project Areas"); and -2- RES 96-82 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, poor vehicular access to the SBD Airport prevents and substantially hinders the economically viable use and capacity of the aviation facilities located at the SBD Airport, thereby contributing to blighting conditions in the Agency Redevelopment Project Areas; and WHEREAS, the Council previously adopted Resolution No. 96-73 on March 25, 1996, approving the issuance of tax exempt notes (the "Notes") by the SBIAA which shall be used to finance the Improvements at the SBD Airport and further acknowledges the obligation incurred by the City to commit to the repayment of the entire indebtedness evidenced by the Notes; and WHEREAS, the Agency has agreed to guarantee the repayment obligations of the City to finance the Improvements since it is in the interests of the present landowners within the Agency Redevelopment Project Areas and the residents, both within the Agency Redevelopment Project Areas, specifically, and within the City generally, that the Agency ensure the funding of the construction and installation of the Improvements; and WHEREAS, the Improvements will improve the facilities at the SBD Airport and increase accessibility to the SBD Airport which will benefit those residing and conducting business both within and outside the Project Area; and WHEREAS, no other viable means of financing the Improvements is available; and -3- RES 96-82 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, in order to promote the City's health, safety and welfare, it is important that the Improvements be financed in order to ensure the orderly development of the Project Area and neighboring areas throughout the City; and WHEREAS, it is appropriate at this time for the Council to make certain findings and determinations and take certain action with respect to construction of the Improvements. NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. herein by this reference. The Recitals hereinabove are true and correct and are incorporated Section 2. The City finds that the Improvements will be of benefit to the Proj ect Area and other neighborhoods within the City for the reasons set forth in the Recitals hereinabove. Section 3. The City also finds and determines that no other reasonable means of financing the construction of the Improvements is presently available to the City. -4- RES 96-82 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Section 4. The findings and determinations herein shall be final and conclusive. This Resolution shall take effect upon the date of its adoption.
