2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AMENDING RESOLUTION NOS. 88-140, 89-510 AND 93-381
3 RELATING TO THE DEFERRAL OF CERTAIN DEVELOPMENT FEES
4 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
5 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
6 SECTION 1. Subsection D is hereby added to Section 1 of Resolution No. 88-140,
7 relating to Traffic Systems Fee, to read as follows:
8 "D. For the construction of new single-family homes, the fees
imposed by Section 3.26.030 of the San Bernardino Municipal Code,
9 and Subsection A of this Resolution, may be deferred at the request of
the owner of the property until the release of utilities is issued or
10 eighteen (18) months from the issuance of the Building Permit,
whichever is less, The owner of the property must personally guarantee
11 payment of the fees, sign documents authorizing the City to place a lien
on the property in the amount of the fees, agree to place the payment of
12 the fees in any escrow for the sale of the property, authorize the City to
demand payment in any such escrow, and pay an administrative fee in
13 an amount set by resolution of the Mayor and Common Council. The
amount of the fees due shall be the amount in effect at the time of
14 collection of the fees. In no event shall utilities be released until the fees
are paid. This Subsection D shall expire and be of no further force and
15 effect on and after April 1, 1997."
16 SECTION 2. Subsection E is hereby added to Section 1 of Resolution No. 89-510,
17 relating to Sewer Connection Fees, to read as follows:
l8 "E. The fees imposed by Section 13.08,050 of the San Bernardino
Municipal Code, and Subsection B of Section I of this Resolution may
19 be deferred as provided in Section 13.08.055 of the San Bernardino
Municipal Code. This Subsection E shall expire and be of no further
20 force and effect on and after April 1, 1997,"
21 SECTION 3. Section 6 is hereby added to Resolution No, 93-381, relating to Storm
22 Water Drainage Fees, to read as follows:
23 "SECTION 6. Only for the construction of new single-family
homes, the fees imposed by Section 3.38,040 of the San Bernardino
24 Municipal Code, and Section 2 of this Resolution, may be deferred at
the request of the owner of the property until the release of utilities is
25 issued or eighteen (18) months from the issuance of the Building Permit,
whichever is less. The owner of the property must personally guarantee
26 payment of the fees, sign documents authorizing the City to place a lien
on the property in the amount of the fees, agree to place the payment of
27 the fees in any escrow for the sale of the property, authorize the City to
demand payment in any such escrow, and pay an administrative fee in
