HomeMy WebLinkAbout1996-050 1 RESOLUTION NO. 96-50 2 RESOLUTION OF THE CITY OF SAN BERNARDINO CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT; ADOPTING THE STATEMENTS OF OVERRIDING 3 CONSIDERATION AND THE MITIGATION MONITORING REPORTING PROGRAM; ADOPTING SPECIFIC PLAN NO. 95-01; AND ADOPTING GENERAL PLAN 4 AMENDMENT NO. 95-03 TO ESTABLISH A NEW LAND USE CATEGORY, TO AMEND THE LAND USE MAP OF THE GENERAL PLAN AND TO AMEND THE CIRCULATION ELEMENT; AND APPROVING THE SAN BERNARDINO INTERNATIONAL TRADE CENTER SPECIFIC PLAN. 5 6 7 SECTION 1. Recitals (a) WHEREAS, the Mayor and Common Council adopted the 8 General Plan for the City of San Bernardino by Resolution No. 89- 9 10 11 12 13 159 on June 2, 1989; and (b) Planning and Building Services Division WHEREAS, staff determined that to develop Specific the proposed Plan 11,056,617 feet commercial, & office, of research square development, industrial and international trade center on 652 acres 14 and the proposed General Plan amendment to establish a new land use 15 category of 'International Trade Center', to amend the land use map 16 from PF (Public Facilities) to ITC (International Trade Center), 17 and to amend the Circulation Element could have a significant 18 effect on the environment and thus warranted the preparation of an 19 Environmental Impact Report pursuant to the California 20 Environmental Quality Act (CEQA); and 21 (c) WHEREAS, the City held a pUblic scoping meeting on 22 July 7, 1994 to solicit public comment on the preparation of the 23 Draft EIR, and 24 (d) WHEREAS, the intent of the City to prepare a Draft 25 Environmental Impact Report was made known to the public, 26 responsible agencies and other interested persons for their 27 concerns and comments from August 28, 1995 to September 26, 1995 as 28 1 RES 96-50 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 required by CEQA; and (e) WHEREAS, a Draft Environmental Impact Report (EIR) was prepared to address the San Bernardino International Trade Center Specific Plan (SPL 95-01) which includes General Plan Amendment No. 95-03; and (f) WHEREAS, the Draft EIR was made available to the public, responsible agencies and other interested persons for their review and comment from November 21, 1995 to January 5, 1996 as required by CEQA; and (g) WHEREAS, verbal and written comments were received on the Draft EIR; and (h) WHEREAS, these comments were responded to both orally and in writing as required by CEQA; and (i) WHEREAS, the Planning commission conducted a noticed public hearing on February 6, 1996 in order to receive public testimony and written and oral comments on the San Bernardino International Trade Center Specific Plan and EIR (SPL 95-01) which includes General Plan Amendment No. 95-03; and (j) WHEREAS, the Planning and Building Services Department Staff Report dated February 6, 1996, which summarizes the potential effects of the San Bernardino International Trade Center Specific Plan which includes the amendment to the General Plan; and Mitigation Monitoring Planning commission in (k) WHEREAS, the proposed Reporting Program was reviewed by the compliance with CEQA; and (1) WHEREAS, the Planning Commission, after receiving public testimony, recommended approval of the Specific Plan, 2 RES 96-50 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 adoption of the General Plan Amendment, certification of the Environmental Impact Report, adoption of the statements of Overriding consideration, adoption of the Mitigation Monitoring Reporting Program; and (m) WHEREAS, the Mayor and Common Council conducted a noticed public hearing on March 4, 1996 and fully reviewed and considered Specific Plan No. 95-01, General Plan Amendment No. 95- 03, Draft EIR, Final EIR, Mitigation Monitoring Reporting Program, Statements of Overriding Consideration, the Planning Division staff report and the recommendation of the Planning commission. SECTION II. Final Environmental Impact Report NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED THAT THE MAYOR AND COMMON COUNCIL HEREBY CERTIFY: A. The Final Environmental Impact Report (EIR) for Specific Plan No. 95-01 and General Plan Amendment No. 95-03 has been completed in compliance with the California Environmental Quality Act. The Final EIR and all the evidence and information contained therein is attached hereto as Attachment A-I (Draft EIR), Attachment A-2 (draft FEIR), Attachment B (Statements of Overriding Consideration), Attachment C (Mitigation Monitoring Reporting Program) , Attachment D (Draft Specific Plan), Attachment E (Recommended specific Plan Changes), Attachment F (Site Vicinity and General Plan Land Use Designation Map), Attachment G (General Plan Text Revisions), and Attachment H (Circulation Element Revision Map) and incorporated herein by reference; B. The Final EIR was presented to the Mayor and Common Council who have reviewed and considered the information in the Final 3 RES 96-50 1 2 3 c. 4 5 6 7 D. 8 9 10 11 12 13 14 15 16 E. 17 18 19 20 21 22 23 24 F. 25 26 27 28 EIR prior to adopting Specific Plan No. 95-01 and General Plan Amendment No. 95-03. The Final EIR has identified all significant environmental effects of Specific Plan No. 95-01 and General Plan Amendment No. 95-03 and there are no known potentially significant environmental effects not addressed in the Final EIR. Although the Final EIR identifies certain significant environmental effects that would result if Specific Plan No. 95-01 and General Plan Amendment No. 95-03 are adopted, all significant effects that can feasibly be avoided or mitigated will be avoided or mitigated by the implementation of the mitigation measures as set forth in the Mitigation Monitoring Reporting Program for the Final EIR. The Mitigation Monitoring Reporting Program is hereby adopted and is attached hereto as Attachment C and incorporated herein by reference; Potential mitigation measures and other project alternatives not incorporated into or adopted as part of Specific Plan No. 95-01 and General Plan Amendment No. 95-03 were rejected as infeasible, based on specific economic, social or other considerations as set forth in the statements of Overriding Consideration. The statements of Overriding Consideration are hereby adopted and are attached hereto as Attachment Band incorporated herein by reference; The Mayor and Common Council have given great weight to the significant unavoidable adverse environmental impacts. The Mayor and Common Council find that the significant unavoidable adverse impacts are clearly outweighed by the economic, social, cultural and other benefits of Specific Plan No. 95-01 4 RES 96-50 1 2 3 G. 4 5 6 7 8 H. 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 and General Plan Amendment No. 95-03 as set forth in the statements of Overriding Consideration. The findings contained in the statements of Overriding Consideration with respect to the significant impacts identified in the Final EIR are true and correct, and are based upon substantial evidence in the record, including documents comprising the Final EIR. The Final Environmental Impact Report, Mitigation Monitoring Reporting Program and the statements of Overriding Consideration reflect the independent review, analysis and judgement of the City of San Bernardino. SECTION III. Specific Plan Findinqs BE IT FURTHER RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO THAT: A. The proposed specific plan is consistent with the General Plan in that it fulfills Goal lB, Goal lG(b) and Goal lI. Specifically, Goal II directly relates to the orderly and economic transition of Norton Air Force Base. B. The proposed specific plan would not be detrimental to the public interest, health, safety, convenience, or welfare of the City in that implementation of the Specific Plan will be in accordance with all mitigation measures identified in the EIR and contained within the Mitigation Monitoring Reporting Program, all Conditions of Approval, and any subsequent approvals/permits required to implement the project. C. The subject property is physically suitable for the requested land use designations and the anticipated land use developments in that the property is flat, is located in an 5 RES 96-50 1 2 3 D. 4 5 6 7 8 9 10 11 12 13 E. 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 infill area and has adequate infrastructure to support the proposed development. The specific plan will ensure development of desirable character which will be compatible with existing and proposed development in the surrounding neighborhood in that the nature of the development which will occur within the specific plan areas will be governed by comprehensive Planning Area Regulations which provide more specificity as to the types of uses which will be permitted, as well as by development standards regarding setbacks, heights, lot coverage, etc., all of which shall serve to reduce any incompatibilities with adjacent land uses. The proposed specific plan will contribute to a balance of land uses so that local residents may have the opportunity to work and shop in the community in which they live in that the specific plan includes 44.5 acres of office uses, 54.5 acres of R & D uses, 291.2 acres of industrial uses and 141.5 acres for an International Trade Center. SECTION IV. General Plan Amendment Findinqs BE IT FURTHER RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO THAT: A. The proposed general plan amendment is internally consistent with the General Plan in that it fulfills Goal lB, Goal lG(b), Goal 4A, Goal 6A and Goal II. Specifically, Goal II directly relates to the orderly and economic transition of Norton Air Force Base. B. The proposed general plan amendment would not be detrimental to the public interest, health, safety, convenience, or 6 RES 96-50 1 2 3 4 5 6 7 8 9 c. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 welfare of the City in that it provides land use designations that will enable the reuse of the base and avoid deterioration of the site. In addition, implementation of the general plan amendment will be in accordance with all mitigation measures identified in the EIR and contained within the Mitigation Monitoring Reporting Program, all Conditions of Approval, and any subsequent approvals/permits required to implement the project. The proposed general plan amendment would not affect the balance of land uses within the City in that the amendment provides similar uses as were in existence when Norton Air Force Base was existing. SECTION V. certification of the Environmental Imoact Reoort NOW THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the Mayor and Common Council that the Final Environmental Impact Report is certified, the Statements of Overriding Consideration are adopted and the Mitigation Monitoring Reporting Program is adopted. SECTION VI. Amendments NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO THAT: A. The Land Use Element of the General Plan of the City of San Bernardino is hereby amended by establishing a new land use category of ITC - International Trade Center; by changing the land use map from PF Public Facilities to ITC International Trade Center for the project site; and amending the Circulation Element. A copy of the exhibits are attached hereto as Attachments F, G and H and incorporated herein by reference. B. Specific Plan No. 95-01, the San Bernardino International Trade Center is hereby adopted; consisting of Attachment D (Draft Specific Plan) and Attachment E (Recommended Specific Plan Changes) and incorporated herein by reference. C. The specific plan described in section VI, Subsection B is designated as Specific Plan No. 95-01 and shall take effect upon the adoption of this resolution by the Mayor and Common Council. D. The general plan amendment described in Section VI, Subsection A is designated as General Plan Amendment No. 95-03 and shall take effect upon the adoption of this resolution by the Mayor and Common Council. SECTION VII. Text Chanqe This resolution and the specific plan and general plan amendment affected by it shall be referenced or inserted in an appropriate location in the General Plan which has been previously adopted and approved by the Mayor and Common Council and which is on file in the office of the city Clerk. SECTION VIII. Notice Of Determination The Planning Division is hereby directed to file a Notice of Determination with the County of San Bernardino Clerk of the Board of Supervisors certifying the City's compliance with the California Environmental Quality Act in preparing and adopting the Final Environmental Impact Report, Statements of Overriding Consideration and Mitigation Monitoring Reporting Program. A copy of the Notice 8 RES 96-50 RESOLUTION. . CERTIFYING THE ENVIRONMENTAL IMPACT REPORT; ADOPTING THE STATEMENTS OF OVERRIDING CONSIDERATION AND THE 2 MITIGATION MONITORING REPORTING PROGRAM; ADOPTING SPECIFIC PLAN NO. 95-01; AND ADOPTING GENERAL PLAN AMENDMENT NO. 95-03 TO ESTABLISH 3 A NEW LAND USE CATEGORY, TO AMEND THE LAND USE MAP OF THE GENERAL PLAN AND TO AMEND THE CIRCULATION ELEMENT; AND APPROVING THE SAN 4 BERNARDINO INTERNATIONAL TRADE CENTER SPECIFIC PLAN. 5 6 7 8 9 10 1 of Determination will be forwarded to the State Clearinghouse.
