RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, MAKING CERTAIN DETERMINATIONS IN ACCORDANCE WITH HEALTH AND SAFETY CODE SECTION 33679 WHEREAS, the city of San Bernardino (the "city"), is a municipal corporation and charter city, organized and existing pursuant to the laws of the State of California; and WHEREAS, the Redevelopment Agency of the City of San Bernardino (the "Agency"), is a redevelopment agency, a public body, corporate and politic of the State of California, organized and existing pursuant to the Community Redevelopment Law (Part 1 of Division 24 commencing with Section 33000) of the Health and safety Code of the State of California (the "Act"); and 16 WHEREAS, pursuant to section 33679 and 33445 of the 17 Act, the Agency may, with the consent of the Mayor and Common 18 Council (the "Council") of the City of San Bernardino (the 19 "City"), pay all or a part of the value of land and construction 20 of any publicly owned building if the Council determines: (1) 21 that such buildings, facilities, structures or other improvements 22 are of benefit to the redevelopment project area or the immediate 23 neighborhood in which the project is located, regardless of 24 whether such improvement is within another project area, or in 25 the case of a project area in which substantially all the land is 26 publicly owned, that the improvement is of benefit to an adjacent 27 project area of the Agency, (2) that no other reasonable means of 28 financing such buildings, facilities, structures or other -1- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 96-23 improvements is available to the community, and (3) that the payment of funds for the cost of the facilities, structures or other improvements will assist in the elimination of one or more blighting conditions inside the project and said payment is consistent with the implementation plan pursuant to section 33490; and WHEREAS, the Agency issued its $97,825,000 San Bernardino Joint Powers Financing Authority Tax Allocation Refunding Bonds, Series 1995A and $17,960,000 San Bernardino Joint Powers Financing Authority Subordinated Tax Allocation Refunding Bonds, Series 1995B (the "Bonds") on or about October 19, 1995; and WHEREAS, the Bonds are secured by the tax increment revenues of the Central city North Project Area, State College Project No.4, Southeast Industrial Park Project Area, Northwest Project Area, Tri-City Project Area, South Valle Project Area and Uptown Project Area, (collectively, the "Project Areas"); and WHEREAS, the Agency proposes to apply a portion of the proceeds of the Bonds to fund the acquisition of land and construction of a professional baseball stadium (the "Baseball Stadium") within the City, as follows: State College $6,705,000; Central City North - $596,000; Southeast Industrial Park $3,725,000; Northwest - $1,043,000; South Valle $447,000; Tri-city - $1,788,000; Uptown - $596,000; and -2- 96-23 . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the site for the Baseball Stadium is located in the Central City Merged project Area; and WHEREAS, the use of funds from the Project Areas shall promote development, eliminate blighting conditions, create jobs and provide recreational services for the residents of the Project Areas and the citizens of the city and is therefore of benefit to the Project Areas; and WHEREAS, the Agency has found no other viable means of financing the Baseball Stadium; and WHEREAS, there are currently a number of blighting conditions existing within the Project Areas, namely, lack of, and unsafe and unhealthy, commercial and recreational facilities and lack of job opportunities; and WHEREAS, it is projected that the construction for the Baseball Stadium will improve the blighting conditions in the Project Areas by providing a safe recreational activity for the citizens of the Project Areas, creating jobs for said citizens, increasing sales tax revenues to the city and attracting new residents to the City thereby increasing the tax base, all of which promote the health, safety and welfare of the residents of the Project Areas; and WHEREAS, it is appropriate at this time for the City to make certain findings and determinations and take certain action -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 .96-23 with respect to the foregoing. NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, DO HEREBY FIND, RESOLVE, DETERMINE AND ORDER AS FOLLOWS: section 1. The Recitals hereinabove are true and correct and are incorporated herein by this reference. section 2. The city authorizes the use of a portion of the proceeds of the Bonds to fund the construction of the Baseball Stadium and finds that said use of Bond proceeds is of benefit to the Project Areas and other neighborhoods within the city for the reasons set forth in the Recitals hereinabove. The city also finds and determines that no other reasonable means of financing the Baseball Stadium is presently available. The City further finds that the Project will provide economic growth, employment opportunities and necessary recreational facilities, which will in turn enhance economic investment in the Project Areas and surrounding areas, and thereby eliminate existing blighting conditions. section 3. The City Clerk is hereby authorized and directed to cause this Resolution to be transmitted to the Agency for consideration in connection with appropriate action by that body. -4- 96-23 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, MAKING CERTAIN DETERMINATIONS IN ACCORDANCE WITH HEALTH AND SAFETY CODE SECTION 33679 section 4. This Resolution shall take effect from and after the date of its passage and adoption.
