AGREEMENT WITH CALIFORNIA BIO-MASS FOR THE PROVISION OF GREE
MATERIALS PROCESSING.

BE IT RESOLVED BY THE MA YOR AND COMMON COUNCIL OF THE CIT
5 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor is hereby authorized and directed to execute on behalf of sai
City an Amendment to the Agreement with California Bio-Mass for the provision of gree
8
materials processing as specified in Addendum, a copy of which is attached hereto,
9
10 Exhibit" I" and incorporated herein by reference as fully as though set forth at length.
11 SECTION 2. The authorization to execute the above referenced amendment is rescind
12 if the parties to the agreement fail to execute it within sixty (60) days of the passage of thi

AGREEMENT
THE AGREEMENT entered into on the 21st day of February, 1995 between California
Biomass, Inc. (CONTRACTOR) and the CITY OF SAN BERNARDINO (CITY) is horohy amondod
in the following manner:
DELETE PARAGRAPH 12 OF THE EXISTING AGREEMENT AND INSERT THE
FOLLOWING NEW PARAGRAPH:
12. The terms of the Agreement shall be for a two year period commencing on January
1.1996. This Agreement may be renewed as provided in Section 13 for up to three (3) additional one
year terms, for a maximum of five (5) years from January I. 1996 to Oecemher 3 I. 2000.
