HomeMy WebLinkAbout1997-355 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO.~355 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY 0 SAN BERNARDINO AMENDING RESOLUTION NOS. 88-140, 89-510 AND 93-38 RELATING TO THE DEFERRAL OF CERTAIN DEVELOPMENT FEES NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMO COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Subsection D of Section 1 of Resolution No. 88-140, relating to Traffi Systems Fee, is hereby amended to read as follows: "D. For the construction of new single-family homes, the fees imposed b Section 3.26.030 of the San Bernardino Municipal Code, and Subsection A ofthi Resolution, may be deferred at the request of the owner of the property until th release of utilities is issued or eighteen (18) months from the issuance of th Building Permit, whichever occurs first. The owner of the property mus personally guarantee payment of the fees, sign documents authorizing the City t place a lien on the property in the amount of the fees, agree to place the paymen of the fees in any escrow for the sale of the property, authorize the City t demand payment in any such escrow, and pay an administrative fee in an amoun set by resolution of the Mayor and Common Council. The amount of the fee due shall be the amount in effect at the time of collection of the fees. In no even shall utilities be released until the fees are paid. This Subsection D shall expir and be of no further force and effect on and after January 19, 1999." SECTION 2. Subsection E of Section 1 of Resolution No. 89-510, relating to Sewer Connection Fees, is hereby amended to read as follows: "E. The fees imposed by Section 13.08.050 of the San Bernardino Municip Code, and Subsection B of Section 1 of this Resolution may be deferred a provided in Section 13.08.055 of the San Bernardino Municipal Code. Thi Subsection E shall expire and be of no further force and effect on and afte January 19, 1999." SECTION 3. Section 6 of Resolution No. 93-381, relating to Storm Water Drainage Fees, is hereby amended to read as follows: "SECTION 6.
