RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION
NO, 6413 ENTITLED IN PART, "A RESOLUTION , , , ESTABLISHING A BASIC
COMPENSATION PLAN. , , , "BY UPDATING INFORMATION CODIFYING PRIOR
COUNCIL ACTION, (MANAGEMENT & CONFIDENTIAL)
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO, AS FOLLOWS:
SECTION I: Section Five and One-Half of Resolution No, 64]3 is hereby amended as
follows:
SECTION FIVE AND ONE-HALF: Section Five and One-Half shall apply to all non-
safety management and confidential employees:
(a) Effective July], ]998, employees will be adjusted from their current salary ranges
and steps to the new ranges and steps as set forth in Sections Twelve and Fourteen of this
resolution, Step placement will be nearest dollar using a 1 % salary scale, Employees who
would have advanced to a higher step during the month of July, 1998 will receive their July
advancement and then will be placed in the range and step nearest their July salary,
(b) Employees hired within the last six months, or who will be hired at Step I after July
], 1998, will be eligible for a maximum of a 5% step increase after the successful completion of
the first six months of service,
(c) Annually, all management and confidential employees who have not yet reached top
step, may receive an increase ranging from 1 % to 5%, based upon the performance evaluations,
if given, completed within the previous evaluation period, The evaluation period is six months
from Step I to Step 2 for employees initially hired at Step ], and twelve months between all
other steps,
(d) Elected officials, the Civil Service Board, Library Board and Water Board may
determine whether or not to conduct evaluations in writing, Regardless of whether or not written

evaluations are given, elected officials, the Civil Service Board, Library Board and Water Board
may give Step increases not to exceed a 5% Step increase,
(e) All other management and confidential employees shall be evaluated in writing,
(I) Evaluation of department heads and heads of divisions within the City
Administrator's Office will be performed by the City Administrator and reviewed by the Mayor.
(2) Evaluation of other management/confidential employees will be performed by
the department head, or division head, In the case of divisions within the City Administrator's
Office, the division head will perform the evaluation of the management/confidential employees
in that division and may be reviewed by the City Administrator. Evaluation forms for these
employees will be provided by the Director of Personnel.
(1) Recommendations for increases shall be submitted to payroll on a form provided by
Finance at least 30 days prior to the expiration of the evaluation period,
(I) Recommendations for salary advancement of a department head, or division
head within the office of the City Administrator, shall be submitted by the City Administrator,
(2) Recommendations for salary advancement of the Civil Service Chief Examiner
shall be submitted by the Civil Service Board.
(3) Recommendations for salary advancement of the City Librarian shall be
submitted by the Library Board,
(4) Recommendations for salary advancement of employees of elected officials,
with the exception of the Council Office, shall be approved and submitted by the Elected
Official..
(5) Recommendations for salary advancement within the Council Office shall be
submitted by the Council Committee,

PRIOR COUNCIL ACTION,
(6) Recommendations for advancement of all other management/confidential
employees shall be submitted by their perspective department heads,
(g) When an employee returns to work after an approved leave of absence without pay
and has over two (2) months of uncompensated service within the prior twelve-month period,
his/her anniversary date and compensation advancement date, for the purpose of establishing
compensation as provided for in this section, shall be extended by the length of time for which
the leave of absence was granted,
In circumstances in which either the Federal Family Leave Act or the State Medical and
Family Leave Act apply, the City shall adhere to the requirements of the Acts,
(h) Employees will participate in a reasonable suspicion testing program for drugs and
alcohol, following the Reasonable Suspicion Drug! Alcohol Testing procedure described in the
City of San Bernardino's policy on Drugs and Alcohol Testing of Employees with Commercial
Drivers Licenses,
(I) All Supervisors will receive training consisting of at least six (6) hours on
identification of actions, appearance or conduct which are indicative of the use of drugs or
alcohol.
(2) A Supervisor must directly observe and document the behavior on a reasonable
suspicion checklist. Reasonable suspicion may not be based on hearsay.
(i) For any employee hired on or after January 1, 1998, the City will pay five percent
(5%) of the members' contribution to PERS credited to the employee's account as a fringe
benefit. Upon said employees completing five (5) years of service, the City will pay two percent
(2%) additional of the members' contribution to PERS credited to the employee's account as a
fringe benefit on the first pay period of the sixth year of service,

1 (j) The City agrees to amend its PERS contract to pay the employer contribution for the

Level of 1959 Survivors' Benefit contingent on agreement by the other miscellaneous

bargaining units,

5 (k) The City will implement 2% @ 55 benefit with employees paying the increased
6 costs for funding this benefit, contingent upon agreement by the other miscellaneous bargaining
7 units,
