HomeMy WebLinkAbout1997-243 ~ 1 2 3 4 5 RESOLUTION NO. 97-243 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING THE MOVEMENT AND UPGRADING OF THE POLICE DEPARTMENT'S SECURE CLETS (CALIFORNIA LAW ENFORCEMENT TELECOMMUNICATIONS SYSTEM) LINK FROM CITY HALL TO THE CENTRAL POLICE FACILITY. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 6 CITY OF SAN BERNARDINO AS FOLLOWS: 7 SECTION 1. The Police Department connected to the 8 California Law Enforcement Telecommunications System (CLETS) 9 and the National Law Enforcement Telecommunications System 10 (NLETS) via a secure telephone connection to the San 11 Bernardino County Sheriff's Department. The Mayor of the City 12 of San Bernardino is authorized to allow the Police Department 13 to contract with the San Bernardino County Sheriff's 14 Department to move and upgrade the secure connection between 15 the Police Department and the Sheriff's Department from city 16 Hall directly to the Central Police Facility. 17 SECTION 2. SHERIFF'S DEPARTMENT SUBJECT: SERVICES AGREEMENT WITH THE CITY OF SAN BERNARDINO FOR RELOCATION OF THE CITY'S CLETS LINE. RECOMMENDATION: Approve Services Agreement with the City of San Bernardino for the Sheriff's Department to relocate the City's CLETS line. BACKGROUND INFORMATION: The City of San Bernardino has contracted with the County for access to the California Law Enforcement Telecommunications System (CLETS) since 1975. Currently the City's CLETS line is located at City Hall (300 North D Street). The City is requesting the CLETS line be moved to the Central Police Facility (710 North D Street). The Sheriff's Department estimates the relocation cost to be $3,112. REVIEW BY OTHERS: This agreement has been reviewed by the County Administrative Office, has been reviewed and approved as to form by Deputy County Counsel Kevin Norris, and has been reviewed on behalf of Risk Management by Deputy County Counsel Paula Tobler. FINANCIAL IMPACT: This agreement provides for full reimbursement to the County for the cost of the service of approximately $3,112. WITNESSETH: A. WHEREAS, CITY has a need for CLETS line move within the City; and, B. WHEREAS, CONTRACTOR is competent, experienced and able to perform said services; and, C. WHEREAS, CONTRACTOR has provided the lowest responsible bid for providing such services; NOW THEREFORE, the parties hereto agree as follows: 1. CONTRACTOR shall furnish CLETS line move services to CITY in accordance with Bid Specifications F - none required. 2. Over the term of this Agreement, CONTRACTOR shall be paid for such services in an amount in accordance with actual services rendered and equipment purchased. 3. CONTRACTOR shall provide the MIS Department with a monthly invoice in arrears and shall be provided payment within thirty (30) days therefrom. CITY retains the right to challenge all or any part of an invoice. 4. While not restricting or limiting the foregoing, during the term of this Agreement, CONTRACTOR shall maintain in effect comprehensive public, general and automobile liability self- insurance, in the amount of $ 1,000,000.00 combined single limit, and statutory workers' compensation coverage, and shall file certificates of self-insurance coverage with the CITY's Risk Manager prior to any work under this Agreement. 5. CONTRACTOR shall perform work tasks as directed by the MIS Department, but for all intents and purposes CONTRACTOR shall be an independent contraclor and not an agent or employee of the CITY. 97-243 6. In the performance of this agreement and in the hiring and recruitment of employees, CONTRACTOR shall not discriminate on the basis of race, creed, color. religion, sex, physical handicap, ethnic background or country of origin. 7.
