RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING AND
3 DIRECTING THE EXECUTION OF AN AGREEMENT WITH JESUS OUTREACH
MINISTRIES FOR THE SALE AND REMOVAL OF A CITY OWNED BUILDING
4 LOCATED AT 1214 SOUTH WATERMAN AVENUE.

RESOLUTION NO. 97-228
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. That the Mayor of the City of San Bernardino is hereby authorized and
8 directed to execute on behalf of said City, an Agreement with Jesus Outreach Ministries for the

sale and removal of a City owned building located at 1214 South Waterman Avenue, a copy of
11 which is attached hereto as Exhibit "A" and incorporated herein.
12 SECTION 2. The authorization to execute the above referenced agreement is rescinded if
13 the parties to the agreement fail to execute it within sixty (60) days of the passage of this

AGREEMENT FOR THE PURCHASE OF CITY OWNED BUILDING
This Agreement, dated this ,-=)'b-rJ( day of 01 U)I/ , 194Il, between
JESUS OUTREACH MINISTRIES ("BUYER") and the' CITY OF SAN BERNARDINO
("CITY") for the sale of a City owned building, located at 1214 South Waterman Avenue.
RECITALS
A. The CITY has purchased and is the present legal owner of real property located at
1214 South Waterman Avenue, Assessor's Parcel Number 0136-431-22 & 23, for
right of way purposes for the extension of Orange Show Road.
B. Said property contains a building of approximately 5700 square feet, previously used
as a church.
C. The CITY intends to demolish said building to facilitate the construction of street
improvements for said Orange Show Road.
D. The CITY has estimated the cost of demolition between $10,000 - $15,000.
E. BUYER has presented CITY with a letter of intent to purchase and remove said
building from the property at the BUYER'S expense.
F. CITY desires to sell the building to save the cost of demolition.
NOW THEREFORE, IT IS AGREED BETWEEN THE PARTIES AS FOLLOWS:
1. Description of Property to be Sold - The property to be sold consist of a building
ONLY, approximately 5700 square feet in size, including fixtures and appurtenances,
located at 1214 South Waterman Avenue, on the real property described as Lots 101
and 102, Valley Farms Tract No. 1995, as per map recorded in Book 29 of Maps,
pages 13, records of San Bernardino County, State of California, also known as
Assessor's Parcel Number 0136-431-22 & 23. No land is being sold or transferred as
part ofthis agreement.
2. Purchase Price - BUYER agrees to pay CITY the sum of ONE DOLLAR ($1) as full
consideration for this purchase.
3. Removal of Building - BUYER agrees to remove said building from the above
described real property within sixty (60) days of the date of this agreement. Said
removal shall be done at the BUYER'S sole expense and CITY assumes no liability
or expenses in connection with the removal of said building.

4. Permits - BUYER shall obtain all necessary permits and pay fees in connection with
the removal and relocation of said building and shall comply with all State, County
and City codes and regulations regarding such relocation.
5. Condition of Propertv - The building is being sold is "AS-IS" and CITY makes no
warranties as to the condition of the building, including but not limited to the
inclusion of hazardous materials nor to the fitness for intended use by BUYER.
6. Right of Entry - BUYER shall have right of entry to the herein described real
property for the sole purpose of removal and relocation of said building. Said right of
entry shall cease upon the removal of said building from the premises or sixty (60)
days after the date of this agreement.
7. BUYER shall defend, indemnify and hold harmless the CITY against all claims,
demands, suits, judgements, expenses and costs on account of injury or death of
persons or loss or damage of property arising out of the removal and transportation
of said building.
