HomeMy WebLinkAbout1997-222 1 RESOLUTION NO. 97-222 2 3 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, MAKING FINDINGS AND DETERMINATIONS AS TO THE BENEFIT TO THE PROJECT AREAS OF PROVIDING CERTAIN ASSISTANCE (DYNAMIC BINDERY) 4 5 6 WHEREAS, the City of San Bernardino, California (the 7 "City"), is a municipal corporation and a charter city duly created 8 and existing pursuant to the Constitution and the laws of the State 9 of California; and 10 11 WHEREAS, the Community Development Commission of the City 12 of San Bernardino (the "Commission") on behalf of the Redevelopment 13 Agency of the City of San Bernardino (the "Agency"), is a 14 redevelopment agency, a public body, corporate and politic of the 15 State of California, organized and existing pursuant to the 16 Community Redevelopment Law (Part 1 of Division 24 commencing with 17 Section 33000) of the Health and Safety Code of the State of 18 California (the "Act"); and 19 20 WHEREAS, the City and the Commission have previously 21 approved and adopted Redevelopment Plans (collectively hereinafter 22 referred to as the "Redevelopment Plans") for various redevelopment 23 proj ect areas wi thin the City which proj ect areas include: the 24 Meadowbrook-Central City Project Area, Central City North Project 25 Area, Central City East Project Area, Central City South Project 26 Area, Central City West Project Area, Tri-City Project Area, 27 Southeast Industrial Park Redevelopment Project Area, South Valley 28 - 1 - 97-222 1 Project Area, State College Project Area, Northwest Project Area, 2 Uptown Project Area and the Mt. Vernon Project Area; and 3 4 WHEREAS, the Agency has deemed it desirable to enter into 5 an owner participation agreement (the "Agreement") with Dynamic 6 Bindery ("Company") relative to the expansion of an industrial 7 facility (the "Project") which is located in the southern portion 8 of the City; and 9 10 WHEREAS, pursuant to the Agreement, the Agency shall have 11 the obligation to assist in the funding of certain capital 12 equipment and facilities and provide assistance through the City's 13 employment linkage program; and 14 15 WHEREAS, it is in the interests of the present landowners 16 within the Project Areas and the residents, both within the Project 17 Areas and within the City generally, that the Agency assist the 18 Company in funding the development of the Project by financing the 19 costs of capital equipment and facilities with the use of funds 20 from the Project Areas; and 21 22 WHEREAS, the Project Areas presently suffer from a high 23 degree of impaired investments and depreciated values along with 24 high business vacancies which conditions are being exacerbated by 25 the lack of economic opportunities within the Project Areas; and 26 27 WHEREAS, .the City is continually attempting to create 28 economic activities and development within the Project Areas and - 2 - 97-222 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 the City generally thereby eliminating blighting conditions within the Project Areas; and WHEREAS, undertaking of Project will provide employment opportunities to residents of the Project Areas and help create such economic activities and development and will help eliminate the blighting conditions within the Project Areas; and WHEREAS, the Agency's assistance to the Company will provide a benefit for the Project Areas and the residents of the adjacent neighborhoods who seek employment opportunities with the Company; and WHEREAS, in order to promote the City's health, safety and welfare, it is important that the Agency assist the Company in order to ensure the orderly development of the Project Areas and neighboring areas; and WHEREAS, it is appropriate at this time for the City to make certain findings and determinations and take certain action with respect to the Agency's provision of assistance to the Company. OF SAN FOLLOWS: NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY BERNARDINO DO HEREBY RESOLVE, DETERMINE AND ORDER AS - 3 - 97-222 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Section 1. The Recitals hereinabove are true and correct and are incorporated herein by this reference. Section 2. The City Council approves the funding by the Agency of the costs of the Project which is of benefit to the Project Areas and other neighborhoods within the City for the reasons set forth in the Recitals hereinabove. The City Council also finds and determines that no other reasonable means of financing said obligations is presently available to the City and that the City and the Agency require the use of revenues generated from the Project Areas in order to fund the obligations. The City Council further finds that the payment of the obligations will enhance the desirability of the City for economic investment which in turn will enhance economic viability in the Project Areas thereby eliminating existing blighting conditions in the Project Areas. Section 3. The Agency's assistance under the Agreement will make the Project Areas more economically viable through the establishment of employment opportunities to the neighborhoods both within and in proximity to the Project Areas which will in turn help eliminate blight within the Project Areas and other areas of the City. Section 4. The City Clerk is hereby authorized and directed to cause this Resolution to be transmitted to the Agency for consideration in connection with appropriate action by that body. - 4 - . 97-222 1 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, MAKING FINDINGS AND DETERMINATIONS AS TO THE BENEFIT TO 2 VARIOUS PROJECT AREAS OF PROVIDING CERTAIN ASSISTANCE (DYNAMIC BINDERY) 3 Section 5. The findings and determinations herein 4 shall be final and conclusive.
