I RESOLUTION NO. 97-200 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CALLING A MUNICIPAL ELECTION TO SUBMIT TO THE 3 ELECTORS FOR THEIR APPROVAL A BALLOT MEASURE RELATING TO THE CITY'S SERVICE USERS TAX AND REQUESTING THAT SAID MUNICIPAL 4 ELECTION BE CONSOLIDATED WITH THE NOVEMBER 4,1997, CONSOLIDATED ELECTION CONDUCTED BY THE COUNTY OF SAN BERNARDINO 5 6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 7 OF SAN BERNARDINO AS FOLLOWS: 8 SECTION 1. Recitals. 9 (a) California Constitution, Article XIII C, Section 2(b) requires that no local government 10 may impose, extend, or increase any general tax unless and until that tax is submitted to the II electorate and approved by a majority vote. 12 (b) Pursuant to this authority, the Mayor and Common Council have adopted Ordinance 13 No. MC-999, which permits the continued collection and use of the 0.5% increase of the service 14 users tax beyond June 30, 1998, subject to the approval of a majority of the voters. ] 5 (c) The Mayor and Common Council have adopted Resolution No, 97-199submitting 16 this extended general tax to the voters of the City. 17 SECTION 2. City's Municipal Election to be Consolidated and Held on November 4. 1997. ] 8 Pursuant to Resolution No. 97-118, the Mayor and Common Council of the City of San 19 Bernardino have called a municipal primary election to be held in the City of San Bernardino on 20 Tuesday, November 4, 1997, and have further requested that the Board of Supervisors of the County 21 of San Bernardino consolidate the City's municipal primary election with the consolidated election 22 to be held that same date. By adoption ofthis Resolution, the municipal primary election is called 23 for the same time, place and manner as that called for in Resolution No. 97-118 for the additional 24 purpose of submitting to the qualified electors of the City for their approval or disapproval, the 25 proposed ordinance amendment set forth in Exhibit A attached hereto. 26 III 27 III 28 III HTC/js[ servuse.res] 97-200 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CALLING A MUNICIPAL ELECTION TO SUBMIT TO THE 2 ELECTORS FOR THEIR APPROVAL A BALLOT MEASURE RELATING TO THE CITY'S SERVICE USERS TAX AND REQUESTING THAT SAID MUNICIPAL 3 ELECTION BE CONSOLIDATED WITH THE NOVEMBER 4,1997, CONSOLIDATED ELECTION CONDUCTED BY THE COUNTY OF SAN BERNARDINO 4 5 6 7 8 9 10 II SECTION 3. Measure. The measure to be voted on at the municipal primaty election as it is to appear on the ballot shall be as follows: Shall the expiration date of June 30, 1998 be eliminated from Ordinance No. MC-820 so as to permit the City of San Bernardino to continue to collect and use the increased 0.5% service users tax beyond that date? YES [ ] NO [ ] 12 The measure shall be designated on the ballot by a letter printed on the left margin of the 13 square containing the description of the measure as provided in the Elections Code of the State of 14 California. 15 SECTION 4. Notice of Election. 16 The City Clerk is hereby directed to publish a notice of the municipal primaty election which 17 shall contain the following: 18 19 The date of the election; a. b. That the last day for receipt of arguments for or against the measure has been 20 established as 5:00 p.m. on August 15, 1997 at the Registrar of Voters Office, 777 East Rialto 21 Avenue, San Bernardino, CA. 22 That the last day for receipt of rebuttal arguments is 5:00 p.m. on August 22, 1997 c. 23 at the Registrar of Voters Office at the above location. 24 The City Clerk is directed to make arrangements to accept arguments and to arrange for 25 sample ballots, which shall include the text of the proposed ordinance extending the collection and 26 use of the increased 0.5% service users tax, in accordance with Section 306 and Section 9600 et seq. 27 of the Elections Code. This notice may be combined with a notice of any other municipal primary 28 election to be held on the same date.
