RESOLUTION OF THE CITY OF SAN BERNARDINO TERMINATING ASSESSMENT DISTRICT NO. 971, FIRE STATION CONSTRUCTION DISTRICT IN THE TRI-CITY AREA. WHEREAS, by Resolution No. 86-82, the Mayor and Common Council found that the public interest, convenience, and necessity required the formation of a fire station construction reimbursement district; and WHEREAS, by said Resolution No. 86-82, the Mayor and Common Council formed an assessment district known as Assessment District No. 971 for the reimbursement of funds for the construction of a fire station in the Tri-City Area pursuant to the provisions of Chapter 12.90 of the San Bernardino Municipal Code; and WHEREAS, by Resolution No. 86-47, the Mayor and Common Council declared that all the land included within the boundaries of said district benefited by the construction of said fire station; and WHEREAS, said Resolution No. 86-47 declared that an annual assessment shall be levied on all land within the district to provide reimbursement to the City of San Bernardino for the construction of said fire station; and WHEREAS, annual assessments commenced with the 1989-90 Tax Year, and were to be collected for a period of ten (10) years, through the 1998-99 Tax Year; and WHEREAS, Article XIII D of the California Constitution requires that the continuation of assessments within any Assessment District existing on the effective date of said Article XIII D shall comply with the procedural and approval 06/02/97 1 RESOLU1'ION TERMINATING ASSESSMENT DISTRICT NO. 971 (FIRE STATION CONSTRUCTION REIMBURSEMENT IN THE TRI-CITY AREA) 7-196 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 process as set forth in Section 4 of said Article XIII D, except as set forth in Section 5 therein. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council do hereby find and determine that Assessment District No.971 is not exempt from the procedural and approval requirements of Article XIII D of the California Constitution, as provided for under Section 5 of said Article XIII D. SECTION 2. That the Mayor and Common Council do hereby terminate Assessment District No. 971 and hereby release all liens effected by said Assessment District against the parcels of land lying within the boundaries of said Assessment District, as evidenced by Assessment District Diagram Map No. 971, recorded on May 23, 1989, Book 54 of Assessment Maps, Pages 64- 71, except for unpaid assessments levied prior to the date of adoption of this Resolution, which shall be subject to collections, including interest and penalties, as set forth in Chapter 12.90 of the San Bernardino Municipal Code and shall remain as a lien until paid. SECTION 3 .
