HomeMy WebLinkAbout1997-172 RESOLUTION NO. 97-172 1 2 RESOLUTION OF THE CITY OF SAN BERNARDINO ADOPTING GENERAL PLAN AMENDMENT NO. 97-01 TO THE GENERAL PLAN OF THE CITY OF SAN 3 BERNARDINO. 4 5 6 7 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals (a) WHEREAS, the General Plan for the City of San Bernardino was adopted by the Mayor and Common Council by Resolution No. 89- 8 159 on June 2, 1989. 9 10 Plan of the City of San Bernardino was considered by the Planning 11 (b) WHEREAS, General Plan Amendment No. 97-01 to the General commission on May 20, 1997, after a noticed public hearing, and the 12 Planning Commission's recommendation of approval has been 13 considered by the Mayor and Common Council. 14 (c) WHEREAS, an Initial Study was prepared on March 27, 1997 15 and reviewed by the Environmental Review Committee and the Planning 16 commission who both determined that General Plan Amendment No. 97- 17 01 would not have a significant effect on the environment and 18 therefore, recommended that a Negative Declaration be adopted. 19 (d) WHEREAS, the proposed Negative Declaration received a 21 20 day public review period from April 3, 1997 through April 23, 1997 21 and all comments relative thereto have been reviewed by the 22 Planning commission and the Mayor and Common Council in compliance 23 with the California Environmental Quality Act (CEQA) and local 24 regulations. 25 e) WHEREAS, the Planning commission conducted a noticed 26 public hearing on May 20, 1997 in order to receive public testimony 27 and written and oral comments on General Plan Amendment No. 97-01 28 1 97-172 1 (a proposal to add Policy 1.16.19 to the General Plan to permit the 2 establishment of the following new uses in the CR-2, Commercial 3 Regional-Downtown land use district: Artist Colony, Microbrewery, 4 Mobile Vendor, and Sales and Production of Handicraft Items) and 5 fully reviewed and considered the Planning Division staff report 6 and the recommendation of the Environmental Review Committee. 7 f) WHEREAS, the Mayor and Common Council held a noticed 8 public hearing and fully reviewed and considered proposed General 9 Plan Amendment No. 97-01 and the Planning commission and 10 Environmental Review Committee recommendations and Planning 11 Division Staff Report on June 16, 1997. 12 (g) WHEREAS, the adoption of General Plan Amendment No. 97-01 13 is deemed in the interest of the orderly development of the City 14 and is consistent with the goals, objectives and policies of the 15 existing General Plan. 16 SECTION 2. Neqative Declaration 17 NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the Mayor 18 and Common Council that the proposed amendment to the General Plan 19 of the City of San Bernardino will have no significant effect on 20 the environment, and the Negative Declaration heretofore prepared 21 by the Environmental Review Committee as to the effect of this 22 proposed amendment is hereby ratified, affirmed and adopted. 23 SECTION 3. Findinqs 24 BE IT FURTHER RESOLVED by the Mayor and Common Council of the 25 City of San Bernardino that: 26 A. The proposed amendment is internally consistent with the 27 General Plan in that it meets Goal IC by adding new permitted 28 uses which will allow Main street, Inc. to bring in unique and 2 1 2 3 B. 4 5 6 7 8 9 c. 10 11 12 13 D. 14 15 16 17 18 19 20 21 22 23 24 A. 25 26 27 B. 28 91-172 innovative businesses that can provide jobs in the downtown area. The proposed amendment would not be detrimental to the public interest, health, safety, convenience, or welfare of the City in that any development proposed for the site in the future will be required to meet general development standards as well as the specific development standards proposed as part of Development Code Amendment No. 97-01 The proposed amendment would not impact the balance of land uses within the city in that the addition of the proposed uses will provide additional opportunities for new businesses to locate in the downtown area. In the case of an amendment to the General Plan Land Use Map, the subject parcel(s) is physically suitable (including, but not limited to access, provision of utilities, compatibility with adjoining land uses, and absence of physical constraints) for the requested land use designation (s) and the anticipated land use development(s) in that all parcels in the amendment area have access to improved streets and are located in the downtown area with existing infrastructure suitable for urban development. SECTION 4. Amendment BE IT FURTHER RESOLVED by the Mayor and Common Council that: The Land Use Plan of the General Plan of the city of San Bernardino is amended by adding Policy 1.16.19 which is described in Attachment A, which is attached and incorporated herein for reference. General Plan Amendment No. 97-01 shall become effective 3 97-172 1 immediately upon adoption of this resolution. 2 SECTION 5.
