CITY OF SAN BERNARDINO CONFIRMING THE FOR ASSESSMENT DISTRICT NO. 1005, DISTRICT, CAJON BOULEVARD AND PEPPER WHEREAS, by Resolution No. 91-466, the Mayor and Common 6 Council found that the public interest, convenience, and 7 necessity required the formation of a landscaping maintenance 8 district; and 9 WHEREAS, by said Resolution No. 91-466, the Mayor and 10 Common Council formed an assessment district known as Assessment 11 District No. 1005 for the purpose of providing landscaping 12 maintenance in the Caj on Boulevard and Pepper Linden Avenue 13 area, pursuant to the provisions of Chapter 12.90 of the San 14 Bernardino Municipal Code; and 15 WHEREAS, by Resolution No. 91-434, the Mayor and Common 16 Council declared that all the land included within the 17 boundaries of said district receive a special benefit by the 18 maintenance of said landscaping; and 19 WHEREAS, said Resolution No. 91-434 declared that an annual 20 assessment shall be levied on all land within the district to 21 provide funding for said landscaping maintenance and the 22 administration thereof; and 23 24 25 26 27 28 WHEREAS, an Assessment Roll has been prepared totaling $20.294.94, which sets forth the individual assessments to be levied on each of the parcels of land within Assessment District No. 1005 for the fiscal year 1997/98; and WHEREAS, Article XIII D of the California Constitution requires that any and all Assessment Districts existing on the 04/28/97 1 RESOLUTION CONFIRMING 1997/98 ASSESSMENT RCLL NO. 1005 (CAJON BOULEVARD AND PEPPER LINDEN AVENUE AREA LANDSCAPING V~INTENANCE) 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 97-151 effective date of said Article XIII D shall comply with the procedural and approval process as set forth in Section 4 of said Article XIII D, except as set forth in Section 5 therein. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council do hereby find and determine that the assessments as set forth on said Assessment Roll No. 1005 are hereby exempt from the procedural and approval requirements of Article XIII D of the California Constitution, as provided for under Section 5(b) of said Article XIII D. SECTION 2. That the Mayor and Common Council do hereby find determine that the proportionate costs and to be levied against the parcels of land within Assessment District No. 1005 are correctly set forth on Assessment Roll No. 1005, for the fiscal year 1997/98, on file in the office of the City Clerk of the City of San Bernardino, and do hereby confirm said assessments. SECTION 3 . That the City Clerk is directed to cause a copy of this Resolution to be transmitted to the Office of the Auditor-Controller for the County of San Bernardino with the request that the individual assessments be placed on the subject 1997/98 property tax bills for collection together with all other property taxes.
