HomeMy WebLinkAbout1997-137 It t- 1 2 3 4 5 97-137 RESOLUTION NO. RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING 1997/98 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. INSTALLATION OF TRAFFIC SIGNALS AT UNIVERSITY PARKWAY HALLMARK PARKWAY. THE 973, AND WHEREAS, by Resolution No. 86-247, the Mayor and Common 6 Council found that the public interest, convenience, and 7 necessity required the formation of a signalization construction 8 district; and 9 WHEREAS, by said Resolution No. 86-247, the Mayor and 10 Common Council formed an assessment district known as Assessment 11 District No. 973 for the purpose of providing traffic signals in 12 the area of University Parkway and Hallmark Parkway pursuant to 13 the provisions of Chapter 12.90 of the San Bernardino Municipal 14 Code; and 15 WHEREAS, by Resolution No. 86-182, the Mayor and Common 16 Council declared that all the land included within the 17 boundaries of said district receive a special benefit by the 18 19 20 21 22 23 24 25 26 27 28 installation of said traffic signals; and WHEREAS, said Resolution No. 86-182 declared that an annual assessment shall be levied on all land within the district to provide funding for said traffic signal installation and the administration thereof; and WHEREAS, an Assessment Roll has been prepared totaling $6.106.18, which sets forth the individual assessments to be levied on each of the parcels of land within Assessment District No. 973 for the fiscal year 1997/98; and WHEREAS, Article XIII D of the California Constitution requires that any and all Assessment Districts existing on the 04/29/97 1 ... .... RESOLUTION CONFIRMING 1997/98 ASSESSMENT ROLL NO. 973 (UNIVERSITY PARKWAY AND HALLMARK PARKWAY AREA SIGNAL CONSTRUCTION) 97-137 1 effective date of said Article XIII D shall comply with the 2 procedural and approval process as set forth in Section 4 of 3 4 5 6 7 8 9 10 11 12 said Article XIII D, except as set forth in Section 5 therein. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council do hereby find and determine that the assessments as set forth on said Assessment Roll No. 973 are hereby exempt from the procedural and approval requirements of Article XIII D of the California Constitution, as provided for under Section 5(a) of said Article XIII D. That the Mayor and Common Council SECTION 2 . do hereby 13 find and determine that the proportionate costs to be levied 14 15 16 17 18 19 20 21 22 23 against the parcels of land within Assessment District No. 973 are correctly set forth on Assessment Roll No. 973, for the fiscal year 1997/98, on file in the office of the City Clerk of the City of San Bernardino, and do hereby confirm said assessments. SECTION 3 .
