RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE
1997/9B ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 951, ZONE 1
AND ZONE 2, LANDSCAPING CONSTRUCTION AND MAINTENANCE DISTRICT,
WAGONWHEEL ROAD AREA.
WHEREAS, by Resolution No. 81-482, the Mayor and Common
Council found that the public interest,
convenience,
and
necessity required the formation of a landscaping construction
8 and maintenance district; and
9 WHEREAS, by said Resolution No. 81-482, the Mayor and
Common Council formed an assessment district known as Assessment
District No. 951 for the purpose of
providing
landscaping
12 construction and maintenance in the Wagonwheel Road area
13 pursuant to the provisions of Chapter 12.90 of the San
14 Bernardino Municipal Code; and
15
WHEREAS, by Resolution No. 81-360, the Mayor and Common
16 Council declared that all the land included within the
17 boundaries of said district receive a special benefit by the
18 construction and maintenance of said landscaping; and ~
19 WHEREAS, said Resolution No. 81-360 declared that an annu~
20 assessment shall be levied on all land within the districyto
21 provide funding for said landscaping construction and
22 maintenance and the administration thereof; and
23 WHEREAS, the payments on the construction portion of the
24 district were spread over a five (5) year period and the last
25 assessment levied thereon was on the 1987-88 Assessment Roll and
26 subsequent assessments are only for the maintenance and
27 administration of the landscaping; and
28 WHEREAS, an Assessment Roll has been prepared totaling

$5.251.40 for Zone 1, 6.822.20 for Zone 2, which sets forth the
individual assessments to be levied on each of the parcels of
land within Assessment District No. 951 for the fiscal year
1997/98; and
WHEREAS, Article XIII D of the California Constitution
requires that any and all Assessment Districts existing on the
effective date of said Article XIII D shall comply with the
procedural and approval process as set forth in Section 4 of
said Article XIII D, except as set forth in Section 5 therein.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

That the Mayor and Common Council do hereby

13 find and determine that the assessments as set forth on said
14 Assessment Roll No. 951, are hereby exempt from the procedural
15 and approval requirements of Article XIII D of the California
16 Constitution, as provided for under Section 5(a) of said Article
17 XIII D.
18 SECTION 2. That the Mayor and Common Council do hereby
19 find and determine that the proportionate costs to be levied
20 against the parcels of land within Assessment District No. 951,
21 Zone 1 and Zone 2, are correctly set forth on Assessment Roll
22 No. 951, Zone 1 and Zone 2, for the fiscal year 1997/98, on file
23 in the office of the City Clerk of the City of San Bernardino,
24 and do hereby confirm said assessments.

SECTION
3 .
That the City Clerk is directed to cause a
26 copy of this Resolution to be transmitted to the Office of the
27 Auditor-Controller for the County of San Bernardino with the
28 request that the individual assessments be placed on the
