RESOLUTION OF THE CIT~~ OF' 81\.N BERNARDINO ADOPTING GENERAL PLAN
3 AMENDMENT NO, 96-06 TO THE GENERAL PLAN OF THE CITY OF SAN
BERNARDINO,

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
5 SAN BERNARDINO AS FOLLOWS:
6 SECTION 1, Recitals
7 (a) WHEREAS, the General Plan for the City of San Bernardino
8 was adopted by the Mayor and Common Council by Resolution
9 No, 89-159 on June 2, 1989,

(b) WHEREAS, an Initial Study was prepared on September 26,
1996 and reviewed by the Environmental Review Committee and the
Planning commission who both determined that General Plan Amendment
No, 96-06 would not have a significant effect on the environment
and therefore, recommended that a Negative Declaration be adopted.
(c) WHEREAS, the proposed Negative Declaration received a 20
day public review period from August 3, 1996 through August 23,
1996 and all comments relative thereto have been reviewed by the
Planning commission and the Mayor and Common Council in compliance
with the California Environmental Quality Act (CEQA) and local
regulations,
(d) WHEREAS, the Planning commission conducted a noticed

testimony and written and oral comments on General Plan Amendment

General on 8,83 acres of land located on the west side of Del Rosa
27 Avenue between the SR-30 and Lynwood Street and on the east side of

1 reviewed and considered the Planning Division staff report and the
2 recommendation of the Environmental Review Committee.
3 (e) WHEREAS, the Mayor and Common Council held a noticed
4 public hearing on March 3, 1997 and fully reviewed and considered
5 proposed General Plan Amendment No, 96-06 and the Planning
6 commission and Environmental Review Committee recommendations and
7 Planning Division Staff Report of March 3, 1997,
8 (f) WHEREAS, the adoption of General Plan Amendment No. 96-06
9 is deemed in the interest of the orderly development of the City
10 and is consistent with the goals, objectives and policies of the
11 existing General Plan.
12 SECTION 2, Neaative Declaration
13 NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the
14 Mayor and Common Council that the proposed amendment to the General
15 Plan of the City of San Bernardino will have no significant effect
16 on the environment, and the Negative Declaration heretofore
17 prepared by the Environmental Review Committee as to the effect of
18 this proposed amendment is hereby ratified, affirmed and adopted,
19 SECTION 3, Findinas
BE IT FURTHER RESOLVED by the Mayor and Common Council of the
20
City of San Bernardino that:

A, The proposed amendment is internally consistent with the
22
General Plan in that the existing commercial uses are
23
consistent with the CG-1 designation and the permitted status
24
of the existing single-family residences on Park Avenue would
25
not be changed.
26
B. The proposed amendment would not be detrimental to the public
27
interest, health, safety, convenience, or welfare of the City

in that the proposal is to change a commercial land use
designation to another commercial designation that allows a
broader range of commercial uses which would be compatible
with the existing commercial development in the vicinity,
The proposed amendment would not affect the balance of land
uses within the city in that the proposal would not create a
new commercial district but rezone an existing commercial
district.
The subject site is physically suitable for the requested CG-l
land use designation in that the site has provisions for
adequate access and utilities and the existing and proposed
commercial uses are compatible with adjoining land uses,
SECTION 4, Amendment
BE IT FURTHER RESOLVED by the Mayor and Common Council that:
The Land Use Plan of the General Plan of the City of San
Bernardino is amended by changing approximately 8,83 acres of
land from CN I Commercial Neighborhood to CG-l I Commercial
General. This amendment is designated as General Plan
Amendment No, 96-06 and its location is outlined on the map
entitled Attachment A, and further described in Attachment B,
copies of which are attached and incorporated herein by
reference,
General Plan Amendment No, 96-06 shall become effective
immediately upon adoption of this resolution.
SECTION 5, Map Notation
This resolution and the amendment affected by it shall be
noted on such appropriate General Plan maps as have been previously
adopted and approved by the Mayor and Common Council and which are

on file in the office of the city Clerk,
SECTION 6. Notice of Determination
The Planning Division is hereby directed to file a Notice of
Determination with the County Clerk of the County of San Bernardino
certifying the city's compliance with California Environmental
Act in preparing the Negative Declaration,
