RESOLUTION NO. 97-52
RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AMENDMENT NO. TWO TO STANDARD AGREEMENT, CONTRACT
NO. 1'1957032, WITH THE TRUSTEES OF THE CALIFORNIA STATE
UNIVERSITY, CALIFORNIA STATE UNIVERSITY, SAN BERNARDINO, RELATIUG
TO THE INSTALLATION OF TRAFFIC SIGNALS AT NORTH PARK BOULEVARD AND
COYOTE DRIVE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF TilE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
The Mayor of the City of San Bernardino is
8 hereby authorized and directed to execute, on behalf of said
9 City, Amendment No. Two to Standard Agreement, Contract No.
10 1'1957032, with the Trustees of the California State University,
11 California State University, San Bernardino, relating to the
12 installation of traffic signals at Northpark Boulevard and Coyote
13 Drive.
A copy of said agreenent is attached hereto, marked
14 Exhibit "A" and incorporated herein by reference as fully as
15 though set forth at length.

SECTION 2, This agreement and any amendnent or nodifica-
17 tions thereto shall not take effect or become operative until
18 fully signed and executed by both parties. The City shall not be
19 obligated hereunder unless and until the agreement is fully
20 executed and no oral agreement relating thereto shall be implied
21 or authorized.

SECTION 3.
This resolution is rescinded if the parties
23 to the agreement fail to execute it wi thin ninety (90) days of
24 the passage of this resolution.

B. All contrads In excess of S 10,000.00 will be suoJed to the examination and audit of the Auditor General
for a period of three years after tlndl payment under thiS contract.
9. By signing of this contract, the Contractor dOES swear under penalty of perjury that no more than one
final unappealable finding oi contempt of court by a Federal Court has been issued against Contrador
within the immediately preceding tw<>-year p"r1od because of Contractor's failure to comply with an
order of a Federal Cburt which orders Contradc.r to comply with an order of the ,National Labor Relations
Board.

Contract/Contractor Evaluation, Std. Form 4, 'Viii be prepdred and retained on iile ior any contrad in

11. In addition to the right of the State to termlnat" ior cause as provided under the terms of paragraph #3
of Standard Agreement Form 2, either party ma{ terminate the agreement Without cause With thirty (30)
day's written notice.
12. Contractor agrees that the awarding departmen' or its delegatee will have the right to review, obtain and
copy all records pertaining to performance of -he contract. Contractor agrees to provide the awarding
department or its de legatees access to its premises, upon reasonable notice, during normal business hours
for the purpose of interviewing employees and inspecting and copying such ~, records, accounts
and other material that may be relevant to a IT atter under inYl!5fi<<atiori'f~ the purpose 01 determininl
com'pliance with Public Contract Code Section 10115 et.seq. Conlractor further agrees \10 maintlin such
records for a period of three (3) years after fin..1 payment under this contract.
