Home My WebLink About1997-020 1 2 RESOLUTION NO. 97-20 RESOLUTION OF THE CITY OF SAN BERNARDINO ORDERING THE 3 VACATION OF A PORTION OF CLUB CENTER DRIVE, EAST OF CLUB WAY AND RESERVING EASEMENTS FOR THE CITY OF SAN BERNARDINO FOR SANITARY 4 SEWER, WATERLINES, STREET LIGHTING CONDUITS, DRAINAGE AND FOR 5 SOUTHERN CALIFORNIA EDISON FOR ELECTRICAL FACILITIES. 6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 7 8 SECTION 1. That the Mayor and Common Council of the City of San Bernardino, 9 having heard the evidence offered in relation to the proposed vacation of a portion of Club 10 Center Drive, East of Club Way, described in Resolution of Intention No. 96-377, and modified 11 herein, hereby find from all of the evidence submitted that such street proposed to be vacated by 12 said Resolution, as modified, is unnecessary for present and prospective street purposes and Plan 13 No. 9603 is hereby approved as revised. 14 15 SECTION 2. The Mayor and Common Council of said City do hereby vacate a portion 16 of Club Center Drive, East of Club Way, San Bernardino, California, more fully described as 17 18 19 20 21 22 23 24 25 26 27 28 follows: Those portions of Club Center Drive, 60 feet wide (formerly Caroline Street) in the City of San Bernardino, County of San Bernardino, State of California, being a portion of Parcel 6, Parcel Map 8401 as per map recorded in Book 88 of Parcel Maps, pages 32-33, portions of which are dedicated on Document No. 87- 359087, Official Records of said County, described as follows: Beginning at the Southeast comer of said Parcel 6, said point also being on the South line of said Club Center Drive; thence South 890 49' 45" West, along the South line of said Parcel 6 and said South line of Club Center Drive, a distance of 287.46 feet; thence Northeasterly, along a non-tangent reverse curve having a radial bearing of North 330 43' 42" West, concave Northwesterly and having a radius of 72 feet, through a central angle of 630 13' 32", an arc distance of 79.45 feet; thence South 450 10' 15" East, a distance of 12.03 feet; thence North 890 49' 45" East, along the North line of said Club Center Drive, a distance of 247.42 feet, more or less, to the East line of said Parcel 6; thence South, along said East line of Parcel 6, a distance of 60 feet, more or less. to the South line of said Club Center Drive and the Point of Beginning. Rev. 01/22/97 RESOLU:TION ORDERING THE VACATION OF A PORTION OF CLUB CENTER DRIVE, EAST OF CLUB WAY AND RESERVING CERTAIN EASEMENTS THEREIN. 97-20 1 2 SECTION 3. Nothing in this Resolution shall in any way affect or disturb any existing 3 easements for public utility purposes belonging either to the City of San Bernardino or to any 4 public utility and there is hereby specifically reserved for the City of San Bernardino, an 5 6 easement for sanitary sewer and appurtenance facilities over the entire area vacated including the right to construct, maintain, operate, replace and renew said sewer or appurtenances; and there is 7 8 hereby specifically reserved for the City of San Bernardino Municipal Water Department, an 9 easement for water utility purposes over the entire area vacated, including the right at any time, 10 or from time to time, to construct, maintain, operate, replace and renew one or more pipelines or 11 appurtenances thereto for the transportation of water and for the construction and maintenance of 12 water wells and related incidental purposes, including the right of ingress and egress thereto; and 13 14 there is hereby specifically reserved to the City of San Bernardino, an easement for street light 15 conduits, wires and cables and appurtenances over the area vacated; and there is hereby 16 specifically reserved to the City of San Bernardino, an easement for drainage purposes and 17 appurtenant facilities over the area vacated; 18 19 and there is hereby specifically reserved for Southern California Edison Company, over the Southerly 30 feet of the area vacated, an 20 easement to construct, place, operate, inspect, maintain, repair, replace and remove underground 21 electrical transmission and/or distribution structures consisting of wires, cables, conduits, 22 manholes, markers and necessary fixtures and appurtenances and said easement shall include 23 rights of ingress and egress. 24 25 26 resolution is filed with the County Recorder of San Bernardino County, and such filing shall not SECTION 6.
