HomeMy WebLinkAbout1997-006 1 RESOLUTION NO. 97-6 2 RESOLUTION OF THE CITY OF SAN BERNARDINO ADOPTING GENERAL PLAN AMENDMENT NO. 96-08 TO THE GENERAL PLAN OF THE CITY OF SAN 3 BERNARDINO. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 5 SECTION 1. Recitals 6 7 was adopted by the Mayor and Common Council by Resolution (a) WHEREAS, the General Plan for the City of San Bernardino 8 No. 89-159 on June 2, 1989. 9 (b) WHEREAS, General Plan Amendment No. 96-08 to the General 10 Plan of the City of San Bernardino was considered by the Planning 11 12 13 14 15 16 commission on November 19, 1996, after a noticed pUblic hearing, and the Planning commission's recommendation of approval has been considered by the Mayor and Common Council. (c) WHEREAS, an Initial Study was prepared on September 19, 1996 and reviewed by the Environmental Review Committee and the Planning commission who both determined that General Plan Amendment 17 No. 96-08 would not have a significant effect on the environment 18 and therefore, recommended that a Negative Declaration be adopted. 19 (d) WHEREAS, the proposed Negative Declaration received a 21 20 day public review period from September 26, 1996 through October 21 16, 1996 and all comments relative thereto have been reviewed by 22 the Planning commission and the Mayor and Common Council in 23 compliance with the California Environmental Quality Act (CEQA) and 24 25 26 27 28 local regulations. e) WHEREAS, the Planning Commission conducted a noticed public hearing on November 19, 1996 in order to receive public testimony and written and oral comments on General Plan Amendment 1 RES.97-6 1 No. 96-08 (a proposal to change the General Plan Land Use 2 Designation from RM, Residential Medium to CR-2, Commercial 3 Regional in the area generally bounded by 6th and 7th streets and 4 by "F" and "G" streets) and fully reviewed and considered the 5 Planning Division staff report and the recommendation of the 6 Environmental Review Committee. 7 f) WHEREAS, the Mayor and Common Council held a noticed 8 public hearing and fully reviewed and considered proposed General 9 Plan Amendment No. 96-08 and the Planning commission and 10 Environmental Review Committee recommendations and Planning 11 Division Staff Report on January 27, 1997. 12 (g) WHEREAS, the adoption of General Plan Amendment No. 96-08 13 is deemed in the interest of the orderly development of the City 14 and is consistent with the goals, objectives and policies of the 15 existing General Plan. 16 SECTION 2. Neqative Declaration 17 NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the Mayor 18 and Common Council that the proposed amendment to the General Plan 19 of the City of San Bernardino will have no significant effect on 20 the environment, and the Negative Declaration heretofore prepared by the Environmental Review Committee as to the effect of this proposed amendment is hereby ratified, affirmed and adopted. SECTION 3. Findinqs BE IT FURTHER RESOLVED by the Mayor and Common Council of the City of San Bernardino that: The proposed amendment is internally consistent with the General Plan in that the proposed designation would permit a variety of land uses that could be regionally attracting and 2 21 22 23 24 25 26 A. 27 28 1 2 3 4 5 6 B. 7 8 9 10 11 12 13 c. 14 15 16 17 18 D. 19 20 21 22 23 24 25 26 27 28 A. RES.97-6 that could serve the local community thus meeting the intent of the General Plan Goal IC to provide for the continuation and development of land uses which provide for the needs of and attract regional populations, in addition to local residents. The proposed amendment would not be detrimental to the public interest, health, safety, convenience, or welfare of the City in that any development proposed for the site in the future will be required to meet the extensive development standards that are in place to buffer residential development and that enable commercial projects in the CR-2 designation to blend with adjacent neighborhoods. The proposed amendment would not affect the balance of land uses within the City in that the addition of commercially designated land will provide additional opportunities for economic development that had been unavailable during the recession of the last several years. The subject parcels are physically suitable for the requested land use designations and the anticipated land use developments in that all parcels in the amendment area have access to improved streets and are located in the downtown area with existing infrastructure suitable for urban development. Existing homes within the area could be converted to a variety of commercial or mixed-uses and would not be a major obstacle to the development of this area. SECTION 4. Amendment BE IT FURTHER RESOLVED by the Mayor and Common Council that: The Land Use Plan of the General Plan of the City of San 3 RES.97-6 1 Bernardino is amended by changing the land use designation 2 from RM, Residential Medium to CR-2, Commercial Regional in 3 the area generally bounded by 6th and 7th streets and by "F" 4 and "G" streets. This amendment is designated as General Plan 5 Amendment No. 96-08 and its location is outlined on the map 6 entitled Attachment A and further described in Attachment B, 7 copies of which are attached and incorporated herein by 8 reference. 9 B. General Plan Amendment No. 96-08 shall become effective 10 immediately upon adoption of this resolution. 11 SECTION 5. Map Notation 12 This resolution and the amendment affected by it shall be 13 noted on such appropriate General Plan maps as have been previously 14 adopted and approved by the Mayor and Common Council and which are 15 on file in the office of the city Clerk. 16 SECTION 6. Notice of Determination 17 The Planning Division is hereby directed to file a Notice of 18 Determination with the County Clerk of the County of San Bernardino certifying the City's compliance with California Environmental Quality Act in preparing the Negative Declaration. 19 20 21 I I I I 22 IIII 23 IIII 24 25 26 27 28 4 RES.97-6 1 RESOLUTION. .
