A RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
3 EXECUTION OF AN AGREEMENT WITH JEFF AND LISA HARVEY FOR
UTILIZATION OF BLOODHOUNDS AT THE SAN BERNARDINO POLICE
4 DEPARTMENT.
5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
6 DO ORDAIN AS FOLLOWS:

SECTION 1.
The Mayor is hereby authorized and directed to execute on behalf
8
of said City an agreement with Jeff and Lisa Harvey relating to the use of Bloodhounds at the
9

San Bernardino Police Department, a copy of said agreement is attached hereto, marked Exhibit
"A" and incorporated herein by reference as fully set forth at length.

SECTION 2.
The authorization to execute the above referenced agreement is
13 rescinded if the parties to the agreement fail to execute it within sixty (60) days of the passage of
14 this resolution.

AND LISA HARVEY, RELATING TO THE USE OF BLOODHOUNDS AT THE SAN

I AGREEMENT FOR THE USE OF BLOODHOUNDS
2 FOR POLICE WORK
3 Recitals
4 A. JEFF HARVEY is a police officer with the City of San Bernardino and his wife is
5 LISA HARVEY.
6 B, JEFF HARVEY and LISA HARVEY ("Harveys") own two bloodhounds which have
7 been trained to assist police departments in searching and tracking victims, suspects and evidence
8 in crimes, as well as searching for lost or missing persons.
9 C. Both the bloodhounds and the HARVEYS have been trained in search and handling
10 techniques, respectively, and are continuously training to maintain and improve their skills.
II D, The Harveys both wish to donate their services as handlers, as well as the service of
12 their bloodhounds to local law enforcement agencies, including the San Bernardino Police
13 Department.
14 E. The San Bernardino Police Department desires to utilize the services of the Harveys
15 and their bloodhounds on an "as-needed" basis.
16 Agreement
17 The undersigned parties agree as follows:
18 I, The City of San Bernardino Police Department (SBPD) may call the HARVEYS to
19 use either or both of the bloodhounds owned by the HAR VEYS as well as the services of the
20 HARVEYS as handlers as police needs may require.
21 2, The use of the dogs will be on a strictly volunteer basis, Except as otherwise
22 provided in this agreement or by law, the SBPD shall be under no obligation to compensate the
23 HARVEYS in any way for expenses or damages,
24 3, The SBPD shall establish criteria for use of a bloodhound through a Standard
25 Operating Procedure. The SBPD, in its sole discretion, shall determine whether a situation requires
26 use of the bloodhounds.
27 4. The CITY agrees that during any time the bloodhound(s) are actually providing
28 service to the SBPD that the CITY shall be liable for the following:

I a. Any injuries or damages to third parties caused by the bloodhound(s); and,
2 b, Any veterinary charges for treatment of the bloodhound(s) due to injuries
3 incurred by service to the CITY,
4 5, The HARVEYS shall provide a home and all necessary care and comfort for the
5 bloodhound(s) including, without limitations, veterinary treatment, vaccinations and license without
6 any claim for compensation or reimbursement from the CITY,
7 6. The HARVEYS shall provide training both for the bloodhound(s) and for themselves
8 as handlers without any claims for compensation or reimbursement from the CITY.
9 7. If the SBPD requests the HAR VEYS to obtain any specific training for either the
10 HARVEYS or the bloodhound(s), the CITY shall be liable for the expense of such training.
II 8. The HARVEYS shall transport the bloodhound(s) to the locations where the
12 bloodhound(s) will be used without any claims for compensation or reimbursement from the CITY,
13 9. The parties expect that LISA HARVEY will normally be the handler responding to
14 a call with the bloodhounds,
15 10, If JEFF HARVEY responds to a call from the SBPD as the handler for the
16 bloodhounds during his off hours, he will be paid any salary and benefits required by the
17 Memorandum of Understanding between the CITY and the San Bernardino Police Officers'
18 Association and any applicable state and federal laws,

11. The HARVEYS agree to obey any orders issued to them by the SBPD officer or
2 supervisor in charge of the scene of the operation where the bloodhound(s) are deployed,
