The Mayor of the City of San Bernardino is hereby authorized 8 9 and directed to execute on behalf of said City an Agreement with SAN BERNARDINO 10 SYMPHONY ORCHESTRA, a copy of which is attached hereto marked Exhibit "A" 11 and incorporated herein by reference as fully as though set forth at length. 12 13 SECOON 2. The authorization to execute the above referenced agreement is rescinded if the parties to the agreement fail to execute it within sixty (60) days of the 98-290 I . Penman, 24 City orney 25 26 27 28 OV: d this7)Aaay of ITH VALLES, Mayor of San Bernardino September 22, 1998 2 . . 98-290 AGREEMENT Fine Arts Fundinq THIS AGREEMENT is entered into between the CITY OF SAN ERNARDINO, a municipal corporation, referred to as "City" and the AN BERNARDINO SYMPHONY ORCHESTRA, a non-profit organization, 1 2 3 4 5 6 7 8 9 10 11 12 activities sponsored by Organization as set forth in Organization's 13 grant proposal (hereinafter "the proposal") approved by the Fine 14 rts Commission of the City. A copy of said proposal is on file in 15 the Mayor's Office of Cultural Affairs. The terms of the proposal 16 are incorporated herein by reference and shall govern the uses of 17 the funds provided herein. The financial assistance provided for 18 in this agreement is made on a one-time only basis, and receipt of 19 said funds shall not imply a continuing obligation of the City 20 beyond the terms of this Agreement. 21 B. The expenditure is for a valid municipal public 22 purpose, to wit: for the promotion of art appreciation in San 23 Bernardino, as more fully set forth in the proposal submitted by 24 Organization. 25 2. Payment. Upon presentation of a claim to the Mayor's 26 Office, City shall pay to Organization from the 27 28 ; eferred to as "Organization." The parties agree as follows: 1. Recitals. A. Use of Funds. The funds paid to Organization shall be sed solely for the purposes set forth in Paragraph 1 and in strict ompliance with the provisions set forth in the agreement. No eviation from the agreement shall be made without the express pproval of the City of San Bernardino. Said funds shall be xpended by June 30, 1999, and any unexpended funds shall be eturned to City by Organization. 4. Accountinq. Within 20 days after the completion of the vent, the Organization shall submit to the Mayor's Office, with a opy to the Director of Finance, an accounting of the actual xpenditures connected with said event as it relates to the funds provided by the City. Financial records shall be in accordance with generally accepted accounting rinciples by Organization in such manner as to permit City to easily trace the expenditures of the funds. All books and records of Organization are to be kept open for inspection at any time 22 during the business day by the City or its officers or agents. 23 24 25 26 27 28 Failure to submit the financial records in accordance with this section will result in the Organization reimbursing the City. 5. Hold Harmless. In addition, Organization shall reimburse to City any funds expended which were used for any urposes other than those authorized under this Agreement. 7. Assiqnment. Organization shall not assign its interest in this Agreement without the prior written approval of City. Insurance. Project Descriptions: The San Bernardino Symphony Orchestra will present and/or provide for: a) Five Symphonic and two Sinfonia Mexicana Programs, three Redlands Bowl, the Nutcracker Event and concerts to be added. (See Attached Season Brochure.) b) Orchestral support for California State University, the Canto Bello Choir, the Riverside Chorale, recitals in downtown San Bernardino and added youth orchestras (Southern California and Chaffey High School) to regular programs. Docent music education in the Schools and the annual New Year's Eve Gala. c) The Guthrie Library to several thousand subscribers. (This library was subsidized by the Symphony at a cost of $2,000 @ in 1997-98.) VII. Need Statement: Families of the San Bernardino Valley are the target audience - adults, children and senior citizens. The Fine Arts Commission provides the Symphony with it's most significant financial contribution: 1997-98 (Actual) 1996-97 1998-99 35% (64,500 - 186,000) with Grant 31 % (63,000 - 202,375) 39% (180,500) Projected without Grant 28% (71,500 - $250,500) Projected with Grant VIII. Intended Results: The development of an integrated program of both fine classical music and family attraction is our goal. The City's Grant allows for the continuation of the San Bernardino Orchestra (it is an anchor for the City's cultural stability). The funding of the current season is dependent upon not only the City's grant, but volunteerism of the Board and Guild members, who generate sponsorship and contributions from the community. HistorylBackground ofthe organization: The San Bernardino Symphony Orchestra's 1998-99 season will be its 69th being one of the oldest in California. In the beginning years, the Symphony was composed primarily of local talent and excellent musical direction (James K. Guthrie). In more recent years, professional musicians have been employed. The Symphony orchestra has a world renown Music Director Maestro Stewart Robertson who is under a three year contract. Our programs have a broad range of music repertoire as well as presentations (i.e., evenings and afternoons) and links to community activities (i.e., the Docents at the schools). The Inland Empire Symphony Association is also the presenter of the Sinfonia Mexicana concerts and anticipates additional productions in the coming years. Our home concerts are at the downtown California Theater and concerts are also given at the Redlands Bowl and in the past at other out-of-town venues. It is the intention of the Board of Directors to stand on sixty-eight years of orchestral experience to present our highly regarded San Bernardino Symphony Orchestra throughout the Inland Empire.
