SECTION 1. Recitals

10 Governments adopted the Congestion Management Program (CMP) pursuant to California
11
(a)
WHEREAS, on November 3, 1993 the San Bernardino Associated
Government Code Section 65089.3(a) which requires the county and cities to adopt and
12 implement "a program to analyze the impacts of land used decisions, including an estimate of
13
the costs associated with mitigating these impacts" on the Congestion Management Program
14
network of roadways; and
15
(b)
WHEREAS, the Mayor and Common Council adopted a Land
16
17 Use/Transportation Analysis Program for the City pursuant to the Congestion Management
18
19
Program for the City of San Bernardino by Resolution No. 93-74 on March 22, 1993; and
(c) WHEREAS, the City, in conjunction with SANBAG, determined that the
20
Patton Station, as a mixed use development proposal, would exceed the threshold of 250 trips
21
during a peak hour pursuant to City Resolution No. 93-74 and thus warranted the preparation
22
23 of a Traffic Impact Analysis (TIA) Report pursuant to the Congestion Management Program;
24 and
25

(d) WHEREAS, Traffic Impact Analysis was prepared which incorporates future
traffic volume forecasts, and explicit traffic operations analysis to provide a comprehensive
27

portrayal of future traffic impacts associated with the development of the Patton Station
development proposal; and

(e) WHEREAS, the Draft Traffic Impact Analysis Report was made available to
the County of San Bernardino, San Bernardino Associated Governments, City of Highland, and
5
6 CalTrans for their review during a 21-day review period which began July 7, 1998 and ended
7 on July 29, 1998 as required by the Congestion Management Program; and
8
(t) WHEREAS, written comments were received on the Draft Traffic Impact
9 Analysis Report and the Report was revised August 3, 1998 in response to these comments; and

(g) WHEREAS, the Mayor and Common Council conducted a noticed public
hearing on September 8, 1998 and fully reviewed and considered the Revised Traffic Impact
12
13 Analysis Report, the Planning Division Staff Report and the recommendations of the Planning
14 and Public Works Divisions.

SECTION 2. Traffic Impact Analysis Report
NOW, THEREFORE BE IT FOUND, RESOLVED AND DETERMINED BY THE
MAYOR AND COMMON COUNCIL THAT:
A. The Traffic Impact Analysis Report for the Patton Station development proposal has
20 been completed in compliance with the regional Congestion Management Program and the City's
21 Land Use/Transportation Analysis Program and found to be consistent with the regional
22 Comprehensive Transportation Plan model. The Traffic Impact Analysis Report is attached
23
(Traffic Impact Analysis - Revised August 3, 1998) and incorporated herein by reference.

B. The Traffic Impact Analysis Report was presented to the Mayor and Common
Council who reviewed and considered the information in the land use decision and traffic impact
26
27 mitigation process prior to approving the Patton Station development proposal (CUP 98-14 and
28 GPA 98-03).

C. The Traffic Impact Analysis Report has identified all of the traffic impacts of the
4
5 proposed project to designated Congestion Management Program roadways and freeways, the
6 appropriate mitigation and fair share contribution toward Congestion Management Program
7 roadway and freeway improvements.
8 D. All of the traffic impacts can be mitigated by the implementation of the mitigation
9
measures as identified in the Traffic Impact Analysis Report.

E. The Mayor and Common Council have given great weight to the traffic impacts to
12 designated Congestion Management Program roadways and freeways, the appropriate mitigation
13 and fair share contribution toward Congestion Management Program roadway and freeway
14 improvements.

F. The project-related fair share contribution for Congestion Management Program
intersection and roadway links includes the following intersection improvements which must be
completed prior to occupancy: Arden Avenue at Highland Avenue; SR-30 westbound off-ramp
at Highland Avenue; and Central Avenue at Highland Avenue. In addition, other intersection
20 improvements at Central Avenue at Pacific Street, and Boulder Avenue at Highland Avenue,
21 equivalent to $33,784, are offset by other improvements included in the Standard Requirements.

SECTION 3. Certification of the Traffic Imoact Analysis Reoort
NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the Mayor
24
and Common Council that the Traffic Impact Analysis for the Patton Station development
25

proposal is hereby certified.
