RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
3 SAN BERNARDINO CREATING UNDERGROUND UTILITY DISTRICT NO. 26,
GENERALLY LOCATED ALONG PORTIONS OF MILL STREET, BETWEEN LENA
4 ROAD AND TIPPECANOE A VENUE, LENA ROAD BETWEEN MILL STREET AND
TENNIS COURT LANE AND TIPPECANOE A VENUE BETWEEN CENTRAL
5 AVENUE AND BENEDICT ROAD.

WHEREAS, a public hearing was held on September 8, 1998 at 10:00 a. m. or as soon
7
8 thereafter, at the Council Chambers, 300 North "D" Street, San Bernardino, California, to
9 determine whether the public necessity, health, safety or welfare required the formation of an
10 Underground Utility District No. 26 located along portions of Mill Street between Lena Road
11 and Tippecanoe Avenue, Lena Road between Mill Street and Tennis Court Lane and Tippecanoe

Avenue between Central A venue and Benedict Road, San Bernardino, California; and
WHEREAS, notice of said hearing has been given to all affected property owners as
14
15 shown on the last equalized assessment roll and to all utilities concerned in the manner and for
16 the time required by law; and
17
WHEREAS, said hearing has been duly and regularly held and all persons interested
18
have been given an opportunity to be heard.

20 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. It is hereby found and determined pursuant to Chapter 13.36 of the San
22
23 Bernardino Municipal Code of the City of San Bernardino, and to definitions contained therein
24 that the public necessity, health, safety and welfare require the formation of an underground
25
26
utility district, located along said public streets as described herein, in order to remove utility
poles, overhead wires and associated structures and to underground utilities along said portions
27
28
of said streets.

AND TENNIS COURT LANE AND TIPPECANOE A VENUE BETWEEN CENTRAL A VENUE AND
BENEDICT ROAD
SECTION 2. An underground utility district to be known as Underground Utility

5 District No. 26 is hereby established in that area located along portions of Mill Street between
6
Lena Road and Tippecanoe Avenue, Lena Road between Mill Street and Tennis Court Lane and
7 Tippecanoe Avenue between Central Avenue and Benedict Road, and more particularly shown
8
on amended Drawing No. 9848A by the Enginering Division, Department of Public Works, City
9
of San Bernardino, on file in the office of the City Clerk's office of the City of San Bernardino.

11 SECTION 3. All poles, overhead wires and associated overhead structures shall be
12 removed and underground installations made in said underground utility district within the
13 following times:
14
a. Underground installation by utility companies and property owners and
15
construct reconnections not later than June 30, 1999.
16
17 b. Removal of poles, overhead wires and other associated structures not
18 later than August 31, 1999
SECTION 4. The City Clerk is hereby directed to mail or cause to be mailed a copy
hereof and a copy of Chapter 13.36 of the San Bernardino Municipal Code at the City of
San Bernardino, to all affected property owners as shown on the last equalized
assessment roll and to all affected utilities within ten (10) days after the adoption of this
resolution.
