BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council of the City of San Bernardino, having heard the evidence offered in relation to the proposed vacation of a portion of Ennis Street between Amos Avenue and Lincoln avenue, described in Resolution of Intention No. 98- 167, hereby find from all of the evidence submitted that such street proposed to be vacated by said Resolution is unnecessary for present and prospective street purposes. SECTION 2. The Mayor and Common Council of said City do hereby vacate a portion of Ennis Street between Amos Avenue and Lincoln Avenue, San Bernardino, California, more fully described as follows: That portion of Ennis Street in the City of San Bernardino, County of San Bernardino, State of California, described as follows: That portion of Ennis Street, as shown on the Map of Valley Truck Farms Tract No. 1995, as per plat recorded in Book 29 of Maps, page 13, records of said County, described as follows: Beginning at the Northeast Corner of Lot 56 of said Tract No.1995, said point also being the intersection of the South line of said Ennis Street with the West line of Burlington Northern and Santa Fe Railroad Right of Way, (formerly the A.T. & S.F. Railroad); thence East, along the South line of said Ennis Street, to the East line of said Railroad Right of Way; thence Northwesterly, along said East line of Railroad Right of Way to the of the North line of said Ennis Street; thence West along said North line of Ennis Street; to West line of said Railroad Right of Way; thence Southeasterly, along the West line of said Railroad Right of Way, to the point of beginning. And also described in Resolution ofIntention No. 98-167. 06/29/98 98-221 1 2 3 4 RESOLUTION ORDERING THE VACATION OF A PORTION OF ENNIS STREET BETWEEN AMOS AVENUE AND LINCOLN AVENUE AND RESERVING CERTAIN EASEMENTS THEREIN. SECTION 3. Nothing in this Resolution shall in any way affect or disturb any existing easements for public utility purposes belonging either to the City of San Bernardino or to any 5 public utility and there is hereby specifically reserved for the City of San Bernardino, an 6 easement for sanitary sewer and appurtenance facilities over the entire area proposed to be 7 8 vacated including the right to construct, maintain, operate, replace and renew said sewer or 9 appurtenances; and there is hereby specifically reserved for the City of San Bernardino 10 Municipal Water Department, an easement for water utility purposes over the entire area 11 12 proposed to be vacated, including the right at any time, or from time to time, to construct, maintain, operate, replace and renew one or more pipelines or appurtenances thereto for the 13 14 transportation of water and for the construction and maintenance of water wells and related 15 incidental purposes, including the right of ingress and egress thereto; and there is hereby 16 specifically reserved to the City of San Bernardino, an easement for street light conduits, wires 20 inspect, maintain, repair, replace and remove underground or overhead electrical transmission 21 and/or distribution structures consisting of wires, cables, conduits, manholes and necessary 22 fixtures and appurtenances and said easement shall include rights of ingress and egress; and there inspect, maintain, repair, and replace underground or overhead structures consisting of wires, cables and necessary fixtures and appurtenances and said easement shall include rights of ingress 27 and egress, 28 06/29/98 2 98-221 RESOLUTION ORDERING THE VACATION OF A PORTION OF ENNIS STREET 1 BETWEEN AMOS A VENUE AND LINCOLN A VENUE AND RESERVING CERTAIN 2 EASEMENTS THEREIN. 3 4 SECTION 6.
