" RESOLUTION NO._98-2l7 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO HILLSIDE CONTRACTORS. INC. FOR INSTALLATION OF TRAFFIC SIGNAL AT TIPPECANOE AVENUE AND CENTRAL A VENUE/PALM MEADOWS DRIVE. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. HILLSIDE CONTRACTORS, INC. is the lowest responsible bidder for: INSTALLATION OF TRAFFIC SIGNAL AT TIPPECANOE AVENUE AND CENTRAL A VENUE/PALM MEADOWS DRIVE per Plan No. 9647. A contract is awarded accordingly to said bidder in a total amount of $112,537.50 but such award shall be effective only upon being fully executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby authorized to execute said contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it within sixty (60) days of the passage of this resolution. Deliver all bids to the City Engineer's Office, Third Floor, City Hall, 300 North "D" street, San Bernardino, California, with the Specification title and number clearly marked on the outside of the envelope. Said bids or proposals will be received up to the hour of 2:00 p.m., on June 16. 1998 , at which time all of said bids or proposals will ne publicly opened, and examined and declared in the City Engineer'S Conference Room, Third Floor, city Hall. No bid will be received unless it is made on a proposal form furnished by the City. All bids or proposals shall be signed, sealed and accompanied by cash, cashier' check, certified check or bid bond made payable to the City of San Bernardino, in the amount of ten percent (10%) of the bid. Such cash, check or bond shall be given as a guarantee that the bidder will enter into the contract if awarded to him. In the event the bidder refuses to execute said contract, the use by the public of the improvements will be de- layed, and the public will suffer great damage. From the nature of the case, it would be extremely difficult and impractical to fix said amount of damages. Therefore, the City and the bidder agree that the above sum of 10% percent shall be paid to the City upon the condition above set forth as liquidated damages and not as a forfeiture. All bonds furnished pursuant to this notice must be underwritten by a surety company having a rating in Best's most recent Insurance Guide of "A" or better. I I I I I I I I I I I I I I I I I I I ~8 .217 Pursuant to law, the Mayor and the Common Council of the City of San Bernardino, by Resolution No. 90-358 and any and all amendments thereto which are hereby referred to and made a part thereof by references as fully as though set at length herein, have ascertained and determined the general prevailing rate per diem wages, and of per diem wages for legal holidays and overtime work for each craft or type work of workman needed in the execution of contracts under jurisdiction of said Mayor and Common Council. Said prevailing rates of wages shall conform to " General Prevailing Wage Determination made by the Director of Industrial Relations", filed in the office of city Clerk, which are made a part of said Resolution No. 90-358 and amendments thereto. The Contractor may substitute securities for any monies withheld by the Agency to ensure performance under the contract as provided for in section 22300 of California Government Code and section 10263 of the California Public Contract Code. It shall be mandatory upon the Contractor to whom the contract is awarded and upon any sub-contractor under him to pay not less than specified rates to all laborers, workmen, and mechanics employed by them in the execution of the contract, and to prevent discrimin- ation in the employment of persons because of race, creed, color, or national origin, as set forth in the provisions of Resolution No. 7414 of the Mayor and Common Council of the city of San Bernar- dino. The Contractor shall possess a Class "A" License or other ADDroDriate License at the time the contract is awarded. The prime Contractor shall perform, with his own organization, contract work amounting to at least 35 percent of the contract price. SP-1 4 ~I I I I I I I I I I I I I I I I I I ~8 .217 SECTION 2 2-1 PROPOSAL REOUIREMENTS AND CONDITIONS 2-1.01 General -- Bids must submitted on the proposal form contained herein. All bids or proposals shall be signed, sealed and accompanied by cash, cashier's check or bid bond made payable to the City of San Bernardino, in the amount of ten percent (10%) of the bid. Such cash, check or bond shall be given a guarantee that the bidder will enter into the contract, if awarded to him. In the event the bidder, to whom the contact is awarded, refuses to execute said contract, the use by the public of the improvements will be delayed and the public will suffer great damage. From the nature of the case, it would be extremely difficult and impractical to fix said amount of damage. Therefore, the City and the bidder agree that the proposal guarantee of 10% of the bid shall be paid to the City as a forfeiture. Bid bonds shall be underwritten by a surety company having a rating Best's most recent Insurance Guide of "A" or better. 2-1.02 MINORITY AND WOMEN'S BUSINESS ENTERPRISES -- A policy for establishing goals for participation of Minority and Women's Business Enterprises (MBEjWBE) was adopted by Resolution No. 95-409 of the Mayor and Common council of the city of San Bernardino, on 11-20-95. This outreach program superseded Resolution No. 93-411 and the Standard Operation Procedures dated January 1994. Bidder's or Proposer's outreach efforts (good faith efforts) must reach out to MBEs, WBEs and all other business enterprises. Prime bidders could reasonably be expected to produce a level of participation by interested subcontractors of 15 % MBE and 5 % WBE on this project. Bidders shall make every reasonable effort to solicit bids from MBEjWBES. A justification shall be provided to support the rejection of any bid from a minority or women's business enterprise, certified by Caltrans. SP-2 I I I I . I I I I . I I . I . I I I I ~8 .217 POLICY MINORITY, WOMEN AND OTHER BUSINESS ENTERPRISES AND CITY PROCUREMENTS It is the policy of the City of San Bernardino to provide Minority Business Enterprises (MBEs), Women Business Enterprises (WBEs) and all other enterprises an equal opportunity to participate in the performance of all city contracts. Bidders and proposers shall assist the city in implementing this policy by taking all reasonable steps to ensure that all available business enterprises, including local MBEs and WBEs, have an equal opportunity to compete for and participate in city contracts. Bidders' or proposers' good faith efforts to reach- out to MBEs, WBEs and all other business enterprises shall be determined by the following factors: (1) The bidder or proposer attended pre-solicitation or pre-bid meetings, if any, scheduled by the city to inform all bidders or proposers of the requirements for the proj ect for which the contract will be awarded. The city may waive this requirement if the bidder or proposer certifies it is informed as to those project requirements. (2) The bidder or proposer identified and selected specific items of the project for which the contract will be awarded to be performed by sub-contractors to provide an opportunity for participation by MBEs, WBEs and other business enterprises. The bidder or proposer shall, when economically feasible, divide total contract requirements into small portions or quantities to permit maximum participation of MBEs, WBEs and other business enterprises. (3) The bidder or proposer advertised for bids or proposals from interested business enterprises not less than ten calendar days prior to the submission of bids or proposals, in one or more daily or weekly newspapers, trade association publications, minority or trade oriented pUblications, trade journals, or other media specified by the city. (4) The bidder or proposer provided written notice of its interest in bidding on the contract to those business enterprises, including MBEs and WBEs, having an interest in participating in such contracts. (7) The bidder or proposer requested assistance from organizations that provide assistance in the recruitment and placement of MBEs, WBEs and other business enterprises not less than fifteen days prior to the submission of bids or proposals. (8) The bidder or proposer negotiated in good faith with interested MBEs, WBEs and other business enterprises and did not unjustifiably reject as unsatisfactory bids or proposals prepared by any enterprises, as determined by the city. As documentation the bidder or proposer must submit a list of all sub-bidders for each item of work solicited, including dollar amounts of potential work for MBEs, WBEs and other business enterprises. (9) The bidder or proposer documented efforts to advise and assist interested MBEs, WBEs and other business enterprises in obtaining bonds, lines of credit, or insurance required by the City or Contractor. If the city has established expected levels of participation for MBE and WBE sub-contractors, failure to meet those levels shall not be a basis for disqualification of the bidder or proposer. A determination of the adequacy of a bidders' or proposers' good faith effort must be based on due consideration of the indicia of good faith as set forth above. In the event that the city is considering awarding away from the lowest bidder or not awarding a contract to a propose because the bidder or the proposer is determined to be non-responsive for failure to comply with the good faith indicia set forth above, the City shall, if requested, and prior to the award of the contract, afford the bidder or proposer the opportunity to SP-4 I I I I I I I I I I I I I I I I I I I G8 .217 present evidence to the Mayor and Common Council in a public hearing of the bidders' or proposers' good fai th efforts in making its outreach. For the purposes of this Policy, "minority" shall be synonymous with "minority person" as defined in California Public Contract Code Section 2000 (f) . Nothing herein restricts the discretion of the City to reject all bids or proposals in accord with Charter sections 140 and 238 or Chapter 3.04 of the San Bernardino Municipal Code. The bidder, to whom the contract is awarded, shall file with the Engineer all required bonds and insurance policies, and execute the contract within 10 calendar days after receiving notification of the award. Failure to file the stipulated documents and execute the contract within the prescribed time shall constitute good and sufficient grounds for rescission of the award and payment of 10% of the bid to the City as liquidated damages. 3-1.02 CONTRACT BONDS -- The Payment and Faithful Perfor- mance Bonds shall be filed with the Engineer before the contract is executed by the City in accordance with section 2-4, "CONTRACT BONDS", of the Standard Specifications. SP-6 I I I I I I I I I I I I I I I I I I I 98 .217 SECTION 4 4-1 CONSTRUCTION SCHEDULE AND COMMENCEMENT OF WORK. TIME OF COMPLETION AND LIOUIDATION DAMAGES 4-1.01 Attention is directed to the provisions in section 6-1, "Construction Schedule and Commencement of Work", in section 6- 7.1, "Time of Completion", and in Section 6-9, "Liquidated Damages", of Standard Specifications and these Special Provisions. The Contractor shall diligently prosecute the work to completion before the expiration of 90 WORKING DAYS from the date of the "NOTICE TO PROCEED". The Contractor shall pay to the City of San Bernardino the sum of $100.00 per day, for each calendar days delay in finishing the work in excess of the number of working days prescribed above. SP-7 I I I I I I I I I I I I I I I I I I I 98 .217 SECTION 5 5-1 LEGAL REOUIREMENTS 5-1.01 LIABILITY INSURANCE -- The Contractor's attention is directed to section 7-3, "Liabili ty Insurance", of the Standard Specifications, providing that the Contractor shall furnish the city with a policy or certificate of liability insurance as prescribed therein, prior to execution of the contract. The Insurance Policy shall name the city of San Bernardino as additionally insured. The endorsement shall be provided by/or agent of the insurance company and shall be notarized to that affect. ACCORD Forms are not acceptable nor are forms signed by the broker, unless they have Power of Attorney to bind the insurance provider. (See attached sample forms.) 5-1.02 WORKER'S COMPENSATION INSURANCE The Contractor's attention is directed to section 7-4, "Worker's Compensation Insur- ance", of Standard Specifications, providing that the Contractor shall file a signed certification Certificate of Worker's Compensation Insurance before execution of the contract. 5-1. 03 PAYMENT OF PREVAILING WAGE RATE -- The Contractor and all subcontractors shall pay each craft or worker employed on this project not less than the prevailing wage rates specified in Resolution No. 90-358 of the Mayor and Common Council of the City of San Bernardino. The Engineer shall have the right to interview any craft or worker on the project site in order to verify payment of prevailing wage rates in accordance with Resolution No. 90-358. Prevailing wage shall comply with current rates and all updates. 5-1.04 PAYROLL RECORDS The Contractor's attention is directed to the following provisions of Labor Code Section 1776 (Stats.1978, Ch. 1249). The Contractor shall be responsible for the compliance with these provisions by his subcontractors. (a) The Contractor and all subcontractors shall keep an accurate payroll record, showing the name address, social security number, work classification, straight time, and overtime hours worked each day and week, and the actual per diem wages paid to each journeyman, apprentice, worker, or other employee employed by him or her in connection with public work. (b) The payroll records enumerated under subdivision (a) shall be certified and shall be available for inspection at all reasonable hours at the principal office of the Contractor on the following basis: (1) A certified copy of an employee's payroll record shall be made available for inspection or furnished to such employee or his or her authorized representative on request. Warning signs, lights, and devices for use in performance of work upon highways shall conform to the "Manual of Traffic Controls", 1990 Edition, published by the State of California, and the "Work Area Traffic Control Handbook", 1990 Edition, adopted by the City of San Bernardino, California. The Contractor shall so conduct his operations as to offer the least possible obstruction and inconvenience to the public. Convenience access to abutting properties shall be maintained whenever possible and as directed by the Engineer. The full width of the traveled way shall be open for use by public traffic on Saturdays, Sundays, and designated legal holidays, after 3: 00 p. m. on Fridays and the day preceding designated legal holidays, and when construction operations are not actively in progress on working days. Personal vehicles of the Contractor's employees shall not be parked on the traveled way at any time. The Contractor shall notify local authorities of his intent to begin work at least five (5) days before work is begun. The Contractor shall cooperate with local authorities relative to handling traffic through the area and shall make his own arrange- ments relative to keeping the working area clear of parked vehicles. All places of business and residences along the streets that are within the limits of any work shall be notified by the Contractor in writing at least five (5) days prior to commencement of work. This notification shall explain the sequence of work and indicate any restrictions of access. Verbal notification shall be given to all places of business and residences at least 18 hours in advance of commencing work that will affect access to and from their properties. The Contractor shall furnish, install, and upon completion of the work, remove all signs and warning devices required for directing, protecting, and detouring the public during construction. Emergency vehicles shall be permitted access at all times to any street. 9-1.06 PAYMENT Full compensation for furnishing and installing signs, lights, flares, barricades and other traffic control devices necessary to expedite passage of public traffic through the work area shall be considered as included in the prices paid for the various contract items or work involved, and no additional compensation will be allowed therefor. The provisions in this Section may be modified or altered if, in the opinion of the Engineer, public traffic will be better served and work expedited. Said modifications or alterations shall not be adopted until approved in writing by the Engineer. The Contractor shall grade the roadway as required, provide all unclassified excavating and unclassified fill necessary for curbs, gutters, cross gutter and apron, sidewalk, driveways, and paving, as indicated on the Plans and described in these Special Provisions. Excess and/or unsuitable materials shall be removed from the site by the Contractor. Where unclassified fill and grading is necessary in preparation for laying concrete, it shall be made with clean earth which shall be solidly compacted to avoid future settlement. The maintenance manual shall be submitted at the time the controllers are delivered for testing or, if ordered by the Engineer, previous to purchase. Where the Plans refer to the side tenon detail at the end of the signal mast arm, the applicable tip tenon may be substituted. 24-1.05 CONDUIT Conduit shall conform to the provisions in section 86-2.05, "Conduit", of the Standard Specifications and these Special Provisions. . All conduit on this project shall be rigid metal type. Insulated bonding bushings will be required on metal conduit. After conductors have been installed, the ends of conduits terminating in pull boxes and controller cabinets shall be sealed with an approved type of sealing compound. Rigid metal conduit to be used as a drilling or jacking rod shall be fitted with suitable drill bits for size hole required. When a standard coupling cannot be used for coupling metal type conduit, a UL listed threaded union coupling, as specified in the third paragraph in section 86-2.05C, "Installation", of the Standard Specifications, or a concrete-tight split coupling or concrete-tight set screw coupling shall be used. 24-1. 06 provisions in Specifications PULL BOXES Pull boxes shall conform to the section 86-2.06, "Pull Boxes". of the Standard and these Special Provisions. Prior to testing, the materials delivered must display or provide the following information: (a) Project Identification (b) Job Location (c) Contractor's Name, Address and Telephone Number (d) Manufacturer's Name, Address and Telephone Number (e) Controller Program Identification (f) All auxiliary equipment shall be provided prior to testing (sensors, isolators, conflict monitors, etc.) The Contractor shall notify the City Construction Engineer and the Traffic Signal supervisor, (909) 384-5129, a minimum of 48 hours prior to delivery of equipment to be tested. SP-35 I I I I I I I I I I I I I I I I I I I 98 217 When notified by the City, the Contractor shall pick up the complete control system within 48 hours and haul same to the office of the work at his own expense. The Contractor shall allow a minimum of 10 working days for operational testing and adjustment, with the added provisions that if the equipment should fail, an additional 10-day period shall be allowed for retesting. All testing and transportation and/or shipping costs for the complete control system shall be borne by the Contractor. Costs for controller testing shall be paid for in the following manner: 1. Controller systems which do not pass testing shall be paid for by the Contractor as a deduction from his contract. 2. Controller systems which pass testing will be paid for by the city. Controller systems which fail the testing shall be picked up by the Contractor for repairs and then redelivered to the testing lab for retesting. 24-1.10 provisions in specifications DETECTORS Section 86-5, and these Special Detectors shall conform to the "Detectors", of the Standard Provisions. Loop wire shall be Type 1. Loop detector lead-in shall be Type C. Residue resulting from slot cutting operations shall not be permitted to flow across shoulders or lanes occupied by public traffic and shall be removed from the pavement surface. Slots shall be filled with elastomeric sealant or asphaltic emulsion sealant. Slots in asphalt concrete pavement shall be filled with asphaltic concrete sealant as follows: After conductors are installed in the slots cut in the pavement, paint binder shall be applied to all vertical surfaces of slots in accordance with the provisions in section 39-4.02, "Prime Coat and Paint Binder", of the Standard Specifications. SP-36 I I I I I I I I I I I I I I I I I I I 98 217 Temperature of sealant material during installation shall be above 70oF. Sealant placed in the slots shall be compacted by use of an B-inch diameter by liB-inch thick steel hand roller or other tool approved by the Engineer. Compacted conductor coverage shall be one inch. Excess sealant remaining after rolling shall not be reused. On completion of rolling, traffic sill be permitted to travel over the sealant. The Contractor shall test the detectors with a motor-drive cycle, as defined in the California Vehicle Code, that is licensed for street use by the Department of Motor Vehicles of the State of California. The unladen weight of the vehicle shall not exceed 220 pounds and the engine displacement shall not exceed 100 cubic centimeters. Special features, components or vehicles designed to activate the detector will not be permitted. The Contractor shall provide an operator who shall drive the motor-driven cycle through the response or detection area of the detector at not less than 3 miles per hour nor more than 7 miles per hour. The detector shall provide an indication in response to this test. 24-1.11 VEHICLE SIGNAL FACES Vehicle signal faces shall conform to the provisions in Section B6-4, "Traffic Signal Faces and Fittings", of the Standard Specifications and these Special Provisions. Mast arm and arrow signal heads shall have 12" lenses. mounted signal heads shall have 12" lenses. Pole All lamps for traffic signal units shall be furnished by the Contractor. Signal section housings shall be metal type and backplates shall be metal louvered type. 24-1.lla RED OPTICAL UNITS Red optical units shall be illuminated with the latest "LED" technology. Use red as opposed to clear lenses. LED clusters shall not be used in arrow sections. 24-1. 12 Type "A". PEDESTRIAN SIGNALS Pedestrian signals shall be Theaudible pedestrian signal shall supplement the visible "WALK SYMBOL" indicated, and shall be mounted within the housing of the pedestrian signal on the walk symbol side. Additionally, audio output may be adjusting, from an adjustable low to an adjustable high, and shall be responsive to external ambient noise. Directional audio outputs for right-of-way designations shall be presented by 2 distinct bird chirping sounds. The Northerly and Southerly phase(s} shall utilize a "CUCKOO" sound. The Easterly and Westerly phase(s} shall utilize the 'PEEP-PEEP" sound. Operation parameters shall be: l15V AC +/- 25%, 60 Hz, 3 watts -20 degrees C temperature range 90/DB watts at 1 meter (max) output 24-1.13 PEDESTRIAN PUSH BUTTON housings shall be the metal type. Pedestrian push button Pedestrian push buttons shall be Type "B". 24-l.l3A ADA PEDESTRIAN PUSH BUTTON The push button unit shall be Synchronex Part No. lASY202l-40, ADA-2. The housing for the push button shall be either machined aluminum, or die-cast aluminum. All housings shall be coated with powered paint, matching colors of Federal Standard No. 595b, and shall be shock and rain proof. The housing shall be "Bull Nosed" in shape to reduce vandalism. The pedestrian push button switch shall be a precl.sl.on type, single pole, single throw, expandable to three poles, single throw operation, having pressure type terminals, rated at l20vac, and capable of lXl06 operations. The switches shall be UL listed, CSA certified, and meet the requirements of NEMA ICS-l, ICS-2. The switch shall have the following characteristics. A. The switching unit shall have a stainless steel, aluminum, or structural plastic operator and shall be mounted within the housing with a stainless steel, non-corrosive, temperproof, fastening device. It shall be of such a size to permit recessed mounting in most existing standard type pedestrian push buttons without any modifications to either unit. B. The actuator shall be conical in shape with the cone extending 7/16" to 1/2" above bezel of the switch housing, and 2" in diameter. SP-38 I I I I I I I I I I I I I I I I I I I gS 217 C. Spread spectrum radio shall operate with Model 170 masters and local controllers. The operation of the radios shall be transparent to the system (Le., fully capable of operating with the communications protocol required by the signal controller equipment) . The spread spectrum radio vendor shall verify the transparent nature of its radios with signal equipment vendor prior to installation by the Contractor and acceptance by the City. The spread spectrum radio vendor shall also submit a user list or references to the Contractor, to be reviewed by the Engineer. Spread cables, and as It shall be the responsibility of the Contractor to provide a totally functioning system including repeater operation, proper operation with the Model 170 system firmware and communications interface. SP-39 I I I I I I I I I I I I I I I I I I I 98 21'7 24-1.16 INSTALLATION The Contractor shall install master and slave radios in the controller cabinet at the locations shown on the Plans. The antenna for the radios shall be installed by the Contractor on a signal pole as shown on the Plans and as determined in cooperation with the Engineer and the manufacturer. All cabling and connections from the radios to the antennas shall be installed by the Contractor in coordination with the Engineer. 24-1.17 RADIOS Spread spectrum radios shall be Cylink corporation Airlink Model 64MPET, and shall meet FCC Part 15.247 requirements for unlicensed use, and shall operate with a communication protocol that is transparent to the traffic control equipment (Le., the radio shall be compatible with the traffic signal control equipment communications protocol). The radios shall be able to function as either a master or a slave, and use direct sequence to spread the radio frequency (RF) carrier. The radios shall be encased in a hardened unit and meet the National Electrical Manufacturer's Association (NEMA) TS-l environmental standards for traffic signal equipment. All radios supplied by the Contractor shall be from a single manufacturer. The manual shall contain comprehensive lists of parts and costs, with illustrations if necessary, as well as a troubleshooting guide to enable City teChnicians, or others to carry out maintenance operations down to the module level. The Contractor shall furnish one manual. 24-1. 22 INSTALIATION AND OPERATION MANUAL This manual shall be assembled in volumes of 3D-ring binders of 3" maximum thickness and shall be indexed item by item. Sign panel surfaces, including lettering and borders, shall be 3M Brand Visual Impact Performance (VIP 3990) reflective sheeting or approved alternate. Reflective sheeting shall be applied in such a manner as to maintain light transmission levels specified in the Caltrans Specifications. Sign legends shall be white on green as shown on the Plan. Minimum copy size for the legends shall be 8" U.C. and 6" L.C. series D (See Attachment "A"). Minimum sign panel width shall conform to the Standards established by Caltrans. "Periods" shall not be used on abbreviations. Full-size layouts for each legend shall be submitted to the Engineer for approval prior to fabrication. A face will appear on both sides of frame. The Contractor shall provide and install all the necessary hardware and mounting brackets to install the mast arm-mounted reflectorized street name signs.
