RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS
3 INTENTION TO ORDER THE VACATION OF A SECTION OF NON-VEHICULAR
ACCESS AND A PORTION OF THE 30' FOOT LANDSCAPE EASEMENT ALONG
4 TIPPECANOE AVENUE AND RESERVING EXISTING EASEMENTS FOR PUBLIC
UTILITIES.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1, That the Mayor and Common Council of the City of San Bernardino
9 hereby declares its intention to order the vacation of a section of Non-Vehicular Access and a
10 portion of the 30' foot Landscape Easement along Tippecanoe Avenue, described as follows:

That portion of Lot 19 of Tract No. 12034, in the City of San Bernardino, County
of San Bernardino, State of California, as shown on the Map thereof recorded in
Book 168 of Maps, Pages 75 through 87, inclusive, official records of said
County, more particularly described as follows:
Non-Vehicular Access: The East line of said Lot 19
18' foot Landscape Easement: Beginning at the Southeast corner of said Lot 19,
as shown on said Tract No. 12034; thence along the Southerly boundary of said
lot 19, North 89048'29" west 18.00 feet; thence leaving said Southerly boundary
North 00007'46" West 585.65 feet to the beginning of a curve concave
Southwesterly, having a radius of 20.00 feet; thence Northwesterly along said
curve 31.42 feet through a central angle of90000'00"; to a point on the Northerly
boundary of lot 19 said point also being on the Southerly Right of Way of
Hospitality Lane as shown on said Tract No. 12034; thence along said Northerly
line of Lot 19 North 89052'14" East 18.00 feet to the beginning of a tangent
curve concave Southwesterly, having a radius of 20.00 feet; thence Southeasterly
along said curve 31.42 feet through a central angle of 90000'00", said point also
being on the Westerly Right of Way of Tippecanoe Avenue as shown on said
Tract No 12034; thence continuing along said Right of Way south 00007'46"
East 585.75 feet to the point of beginning.

26 vacating the above described portion of said street, elects to proceed under and in accordance

SECTION 2. That the Mayor and Common Council of the City of San Bernardino, in
with the provisions of the "Public Streets, Highways, and Service Easements Vacation Law",
28 being Division 9, Part 3, of the Street and Highways Code of the State of California.

SECTION 3. That the hour of 10:00 a.m., on August 17, 1998, in the Council Chambers

5 of City Hall, 300 North "D" Street, San Bernardino, California, is fixed as the time and place
6

when and where all persons interested in or objecting to the proposed vacation may appear before
the said Mayor and Common Council and offer evidence in relation thereto, for further
particulars as to the proposed vacation, see that map marked "Plan No. 9820", approved on
9
10 06/01/98, attached as Exhibit' A' .
11 SECTION 4. Nothing in this Resolution shall in any way affect or disturb any existing
12 easements for public utility purposes belonging either to the City of San Bernardino or to any
13
public utility.

SECTION 5. That the City Engineer of the City of San Bernardino hereby is directed to
16 cause Notices of Street vacation to be posted as required by said "Public Street, Highways and
17 Service Easements Vacation Law."
18 SECTION 6. That the City Clerk shall certify to the adoption of this Resolution of
19
intention and shall cause the same to be published once a week for two successive weeks in The
20
Sun, a newspaper published and circulated in the City of San Bernardino, prior to the above date
21
22 set forth for the public hearing.
