HomeMy WebLinkAbout1998-158 , 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO, 98-158 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 1998/99 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1004, INSTALLATION OF TRAFFIC SIGNALS, COMMERCENTER EAST AND HOSPITALITY LANE. WHEREAS, by Resolution No, 91-139, the Mayor and Common Council found that the public interest, convenience, and necessity required the formation of a signalization construction district; and WHEREAS, by said Resolution No, 91-139, the Mayor and Common Council formed an assessment district known as Assessment District No, 1004 for the purpose of providing traffic signals in the area of Commercenter East and Hospitality Lane pursuant to the provisions of Chapter 12,90 of the San Bernardino Municipal Code; and WHEREAS, by Resolution No, 91-91, the Mayor and Common Council declared that all the land included within the boundaries of said district receive a special benefit by the installation of said traffic signals; and WHEREAS, said Resolution No, 91-91 declared that an annual assessment shall be levied on all land within the district to provide funding for said traffic signal installation and the administration thereof; and WHEREAS, an Assessment Roll has been prepared totaling $4,849,38, which sets forth the individual assessments to be levied on each ofthe parcels of land within Assessment District No, 1004 for the fiscal year 1998/99; and WHEREAS, Article XIII D of the California Constitution requires that any and all Assessment Districts existing on the effective date of said Article XIII D shall comply with the procedural and approval process as set forth in Section 4 of said Article XIII D, except as set forth in Section 5 therein, 05/06/98 RESOLlJTION CONFIRMING 1998/99 ASSESSMENT ROLL NO. 1004 (COMMERCENTER EAST AND fIOSPIT ALITY LANE AREA SIGNAL CONSTRUCTION) 1 2 3 4 5 6 7 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION I, That the Mayor and Common Council do hereby find and determine that the assessments as set forth on said Assessment Roll No. 1004 are hereby exempt from the procedural and approval requirements of Article XIII D of the California Constitution, as provided for under Section 5(a) of said Article XIII D, and that the assessment amounts as set forth on said Assessment Roll are equal to or less than any prior approved assessments, 8 9 10 that the proportionate costs to be levied against the parcels ofland within Assessment District SECTION 2, That the Mayor and Common Council do hereby find and determine 11 No, 1004 are correctly set forth on Assessment Ro1l No, 1004, for the fiscal year 1998/99, on 12 file in the office of the City Clerk of the City of San Bernardino, and do hereby confirm said 13 assessments, 14 15 SECTION 3, That the City Clerk is directed to cause a copy of this Resolution to be 16 transmitted to the Office of the Auditor-Controller for the County of San Bernardino with the 17 request that the individual assessments be placed on the subject 1998/99 property tax bills for 18 co1lection together with all other property taxes, 05/06/98 2 RESOLl)TION CONFIRMING 1998/99 ASSESSMENT ROLL NO. 1004 (COMMERCENTER EAST AND HOSPITALITY LANE AREA SIGNAL CONSTRUCTION) 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 I HEREBY CERTIFY that the foregoing resolution was duly adopted by the Mayor and Common Council of the City of San Bernardino at a joint regular meeting thereof 15th day of June , 19~, by the following vote, to held on the wit: Council Members: AYES NA YES ABSTAIN ABSENT ESTRADA x LIEN x ARIAS x SCHNETZ x DEVLIN x ANDERSON x MILLER x () ,# A b.
